AGREEMENT FOR TEMPORARY RIGHT OF ENTRY
FOR ARCHEOLOGICAL SURVEY
FOR VALUABLE CONSIDERATION, the receipt and sufficiency of which is acknowledged,
MARIANNE BR-ANTS and HARLU LIMITED PARTNERSHIP, a Texas limited partnership
("Owners") hereby grant permission to the CITY OF FORT WORTH ("City") and AR Consultants
("Contractors") to enter upon the property described in Exhibit"A" attached hereto and made a part
hereof for all purposes ("Property"), which is a proposed easement for a new 72" water pipeline
extending from Eagle Mountain Lake south to Robertson Road, for the sole purpose of performing
archeological investigation along the proposed pipeline on the express conditions described below:
1. Access shall be only through the City's existing gate located on Robertson Road at the
southwest corner of the Property. Access is limited to three vehicles: One vehicle for a city crew; one
city backhoe; one vehicle to perform archeological survey.
2. Access is permitted only for seven days total (one week) during a time period beginning
with the date the City executes the Agreement and ending on or before September 15, 2005 . Owners
will be given at least 24 hours notice by fax to 817-732-7832 as to the day and time the City would be
on the property to begin the archeological survey. The access period will begin with the date designated
on the 24 hour notice being day one and end at 7 p.m. on the seventh day after the date designated on the
24 hour notice ("access period"). Entry under this Agreement is permissive and shall not constitute a
trespass to the Property. All work done in connection with this Agreement shall be performed as
expeditiously as possible so as not to interfere unreasonably with the use and occupancy of Owners'
property by Owners, their agents, contractors and subcontractors, employees, invitees, licensees, and
representatives. In performing the work or causing the work to be performed, the City and Contractors
shall make adequate provisions for the safety and convenience of Owners, their agents, contractors and
subcontractors, employees, invitees, licensees, representatives, and Owners' livestock. The City shall
cause all work to be cleaned up and all holes and excavations shall be filled on or before the end of the

access period in order to minimize disruption or inconvenience in Owners' use of Owners' property.
3. Access is limited to the area described in Exhibit A as the proposed easement which is thirty
feet (30') wide. The City and its Contractors shall keep their personnel and equipment within this access
area of thirty feet(30').
4. It is understood that the line to be marked on the Exhibit"A" is the exclusive area where the
archeological survey will be conducted and that no trees shall be cut down or removed for the purpose of
the archeological survey. Only the minimum of brush necessary to conduct the archeological survey
shall be removed.
5. During the course of any surveying, digging and excavating activity under this Agreement,
the City shall require any of the City's contractors (including subcontractors of any tier and AR
Consultants) to obtain and maintain comprehensive general liability and property damage insurance in an
amount not less than $1,000,000 for each occurrence of property damage and bodily injury, including
death. The City shall require any of the City's contractors (including subcontractors of any tier and AR
Consultants)to include Owners as an additional insured party on that contractor's comprehensive general
liability insurance and automobile liability insurance required by the City and shall require the City's
contractors to provide Owners with a waiver of subrogation on the Contractor's workers' compensation
insurance policy. This provision shall not limit nor constitute a substitute for City's liability for any
damages nor shall it constitute a waiver of Owners' right to claim damages from City and/or Contractors
at common law.
6. The archeological survey is limited to three (3) trenches at the locations designated on the
map attached hereto as Exhibit"B"and no more than twenty (20) shovel tests on the upland area of
Exhibit A.. The trenches will be limited to a depth of ten (10)feet and a length of fifteen (15) feet and a
width of eighteen (18) inches and the trenches shall be promptly filled in with soil. The shovel tests are
limited to a depth of two (2) feet and the shovel holes shall be promptly filled in with soil after the

profiles have been recorded. All trenches and shovel tests shall be backfilled on the day of excavation..
7. At the termination of this right of entry all materials brought onto the Property by City or its
Contractors or AR Consultants shall be removed by them from the Property, except for survey stakes and
survey flags.
8. City and its Contractors shall not cut or damage any fences or cattle guards on the Property.
It is expressly understood by City and its Contractors that owners presently maintain horses on the access
area described and adjacent property.
9. The City of Fort Worth will have their surveyors flag the corners and sides of the proposed
easement and the backhoe operation will be conducted by a City of Fort Worth crew.
10. Property owners will be provided with 3 copies of the written draft report submitted to the
Texas Historical Commission and 3 copies of the written final report to the Texas Historical
Commission.
11. Artifacts shall be inventoried and photographed before they may be removed from the
property for scientific analysis. A copy of the Inventory and photographs shall be submitted to the
Owners prior to any removal of artifacts. After analysis is completed and a report has been approved by
the Texas Historical Commission, all artifacts shall be returned to the Owner. In any event, all artifacts
shall be returned to the Owner on or before December 1, 2005.
12. If artifacts are not found, a written notification to the Owner shall be sent to them on the
final day of survey and testing by U.S.Mail and by fax to 817-732-7832.
