AMENDMENT NO. 1 TO ENGINEERING CONTRACT
FOR STAGECOACH PUMP STATION CONSTRUCTION MANAGEMENT

WHEREAS, on August 21, 2001, the City of Fort Worth, the "City", and Chiang, Patel & Yerby,
Inc., the "Engineer", made and entered into City Secretary Contract No. 27151, which was duly
authorized by the City Council by M&C C-18719 on August 21, 2001, and
WHEREAS, the Contract involves the engineering services for the construction management for
the Stage Coach Pump Station;
WHEREAS, the "City" and "Engineer" desire to amend City Secretary Contract No. 27151.
NOW, THEREFORE, that the City of Fort Worth, a municipal corporation situated in Tarrant
County, Texas, acting herein by and through its duly authorized City Manager, hereinafter called
"City", and Chiang, Patel & Yerby, Inc., acting and herein by and through its duly authorized
President, hereinafter called "Engineer", hereby make and enter into the following agreement
which amends the Contract:
1.
Article 1, Section 1 of the Contract is amended to include the additional engineering services
specified in Attachment D-1, a copy of which is attached hereto and incorporated herein. The
cost for the additional services to be performed by the Engineer is $57,630.00.
2.
Article III of the Contract is amended to provide for an increase in the maximum fee to be paid to
the Engineer for all work and services performed under the Contract as specified in Attachment
D-2, a copy of which is attached hereto and incorporated herein, so that the total fee paid by the
City for all work and services shall not exceed the sum of$186,699.45.
3.
The Engineer acknowledges its commitment to obtain an additional 15% Minority/Women
Owned Business Enterprise (M/WBE) Participation for this amendment. The Engineer's
commitment for the original contract remains unchanged.
4.
All other provisions of the Contract, which are not expressly amended herein, shall remain in
force and effect.

AMENDMENT TO ATTACHMENT A"SCOPE OF SERVICES"
This amendment to Attachment "A" Scope of Services for the Stagecoach Pump Station for the
City of Fort Worth Water Department incorporates supplemental services items which provide:
1) additional construction management services due to extending the original 8 month project
duration to 17 months, and 2) additional construction management services relating to
correction of defective construction items discovered after Final Inspection of the project.
Supplemental Services Task Additions
Attachment A - Task 5 Supplemental Services is hereby amended by the addition of the
following items:
a. Engineer shall provide additional construction management services for the time period
extending from the original 8-month project duration to 17 months. The 17-month time
period is from the construction contractor's Notice to Proceed dated February 25, 2002,
until the Final Inspection date of July 22, 2003.
b. Engineer shall provide additional construction management services for the correction
of defective construction items discovered after Final Inspection of the project. These
services began in October 2003, and were completed on April 13, 2004.
c. Should additional defective items be discovered after April 13, 2004, another contract
amendment to continue the Engineer's construction management services will be
needed.

COMPENSATION FOR ADDITIONAL SERVICES AS PART OF AMENDMENT#1
I SUPPLEMENTAL ENGINEERING SERVICES
For construction management services under Amendment No. 1, the "City" shall pay the
"Engineer" a lump sum fee of$57,630.
A. Payment: Partial payment shall be made monthly upon receipt of an invoice from the
Engineer based on the percent complete of each task outlined in the following Basis of
Payment.
B. Basis of Payment: For Item 5a, the lump sum fee is $30,000. For item 5b, the lump
sum fee is $27,630.
II ADDITIONAL SERVICES
For additional services provided outside the scope defined in Attachment D-1, as approved by
amendment to this Agreement, the "City" will pay the "Engineer" for labor, other incidental direct
costs, and subconsultants on the same basis as described below.
A. Labor: The Engineer shall be compensated for the services of his personnel on the basis
of Salary Cost times a multiplier of 3.0 for the time such personnel are directly utilized on
the work. Typical billing rates are shown in Exhibit B-3.
Salary cost is defined as the cost of salaries of engineers, technicians, word processors,
surveyors, clerks, laborers, etc., security contributions, unemployment, excise and
payroll taxes, and insurance benefits, sick leave, vacation, and holiday pay applicable
thereto.
The salaries of any personnel assigned are subject to reasonable modification by the
Engineer throughout the term of this Agreement; however, such modification will not
affect the upper limit value of this Agreement.
B. Other Incidental Direct Costs: The Engineer shall be compensated at cost plus 10% for
all costs other than salary costs that are incurred pursuant to this Agreement, but which
are not normally included as part of the Engineer's overhead. These costs include: air
fare, automobile rental, mileage charges, parking, tolls, taxi, meals, lodging, telephone,
printing and reproduction costs, computer and work processors, postage and mailing
costs, and other miscellaneous costs incurred specifically for this project.
C. Subconsultant Services: For all subconsultant services, the Engineer shall be
compensated at the actual subconsultant cost plus 10%.
D. Payment: Partial payment shall be made monthly upon receipt of an invoice from the
Engineer, prepared from the books and records of the Engineer, outlining the amount of hours
worked by each employee, the employee's name and classification, and the employee's billing
rate along with itemized charges for subconsultant services and other incidental direct costs
performed during the period covered by said invoice. This amendment to Exhibit "B-2" Hourly
Billing Rates — 2001 of Attachment "B" Compensation for the Stagecoach Pump Station for the
City of Fort Worth Water Department incorporates revised billing rates for the amendment
supplemental services items

Authorize Amendment No. 1 to the Engineering Agreement with Chiang, Patel & Yerby, Inc. for
Construction Management and Inspection of Stagecoach Pump Station Improvements
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute Amendment No. 1 to the
engineering agreement with Chiang, Patel & Yerby, Inc. for the construction management and inspection of
Stagecoach Pump Station Improvements, thereby increasing the amount of the agreement by $57,630.00,
from $129,069.45 to $186,699.45.
DISCUSSION:
On August 21, 2001 (M&C C-18719) the City Council authorized the City Manager to execute an
engineering agreement with Chiang, Patel & Yerby, Inc. for construction management and inspection of the
Stagecoach Pump Station Improvements. The contract scope was to provide construction management and
inspection during the construction phase of the new Stagecoach Pump Station.
Amendment No. 1 is required to extend the construction management and inspection services of
Stagecoach Pump Station from the original 11 month project duration to 15 months.
The project is located in COUNCIL DISTRICT 7.
Chiang, Patel & Yerby, Inc. is in compliance with the City's M/WBE Ordinance by committing to an
additional 15% M/WBE participation on this Amendment No. 1.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that funds are available in the current capital budget, as appropriated, of the
Water Capital Projects Fund.
