(01S (No M&C Needed) COUNTY OF TARRANT S WHEREAS, the City of Fort Worth (City) and Dunaway Associates, Inc. (Engineer) made and entered into City Secretary Contract No. 26599, (the Contract) which was authorized by the City Council by M&C C-18456 on the 13th day of February 2001 , and subsequently revised by three previous amendments; and WHEREAS, the Contract involves engineering services for the fol- lowing project: Engineering contract for the design of Sanitary Sewer Main M-1-1-1 Condition Assessment and Drainage Area Evaluation Study WHEREAS, it has become necessary to execute Amendment No. 4 to said Contract to include .an increased scope of work and revised maximum fee; NOW THEREFORE , City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agree- ment which amends the Contract: 1 . Article I of the Contract is amended to include the additional en- gineering services specified, in a proposal letter dated July 28, 2003, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer to- tal $17,900 .00. 2. Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $866,670.73. - — ORIGINAL 3. Domenech, P.E., DOE Project Manager DATE: August 8, 2003 RE: DESIGN FEE AMENDMENT NO. 4 TO SANITARY SEWER MAIN M-1-1-1 CONDITION ASSESSMENT AND DRAINAGE AREA EVALUATION STUDY SEWER PROJECT NO. PS170-070170410020 WATER PROJECT NO. PW162-060162141020 DOE NO. 3783 The proposed amendment will allow Dunaway Associates, Inc., to provide engineering services on the project as requested by the City. As requested by staff, Dunaway Associates, Inc., will provide the necessary redesign services to incor- porate water line changes to accommodate T&PW proposed pavement improvements on 4`h and 5`h Streets and Commerce Street. The revisions are also to include the changes necessary to address envi- ronmental issues as the project location contains environmental monitoring zones. This amendment will also allow for the plans and specifications to be revised to include the most recent City standards. The project was ready for advertisement in December 2002. However, in order to avoid interference with the baseball season on La Grave Field, the project was delayed until now. Dunaway Associates, Inc., has requested the amount of$17,900.00 for the additional services, thereby increasing the contract fee from $848,770.73 to $866,670.73. I believe this fee is fair and reasonable for the additional services to be provided. Please authorize the additional design fee by your signatures on the attached contract amendment form. Miguel A.
