AMENDMENT NO. 4 STATE OF TEXAS b CITY SECRETARY CONTRACT NO. l - (M&C Not Required) COUNTY OF TARRANT 8 WHEREAS, the City of Fort Worth (City) and A.N.A Consultants, (Engineer) made and entered into City Secretary Contract No. 29018 L.L.C. , (the Contract) which was authorized by the City Council by M&C C-19700 on the 12th day of August, 2003, and subsequently amended by three previous amendments; and WHEREAS, the Contract involves engineering services for the following project: Water and Sanitary Sewer Replacement Contract, 2002 STM-O. WHEREAS, it has become necessary to execute Amendment No. 4 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1 . Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated May 06, 2009, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer total $17, 412 .50 (Water:$12,443.00 ; Sewer: $4, 969.50) . 2 . Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $228,737.50 . No. 3991 Dear Mr. Chaubey: Final plans, specifications and estimated construction costs for STM-0 were submitted for final review on December 22, 2004. During this time period between 2004 and 2009, city specifications, bid documents, cost estimate formats, city border size and city standards have changed. Also, during the time period between our submittal in December 2004 the City has periodically requested additional plan sets, project status and cost estimate updates for internal planning purposes. The additional requests for information and revisions necessary to bring the plans up to current city standards are above the project scope of our original 2003 contract. Also, in August 2007, A.N.A. Consultants was asked to attend a meeting at the City concerning a development project at University Drive and South Hills Drive. Representatives for the developer, Winkelmann &Associates, advised us of their intent to demolish and rebuild a duplex facility on the northwest and northeast corners of this location. This redevelopment created an impact on our sewer design for Line D, sheet 35. At the request of the City, A.N.A. Consultants was asked to modify, coordinate and provide our sewer design for Line D to Winkelmann &Associates for construction under the development contract. A.N.A. Consultants attended additional meetings with the city and developer, modified and coordinated proposed horizontal and vertical alignments and provided signed, sealed reproducible engineering plans for Line D. These services were in addition to our current contract scope requiring A.N.A. Consultants to incur additional costs for project management and engineering design. A.N.A. Consultants, L.L.C. is requesting that our current contract be amended to include the additional services and scope change outlined above and amend our contract and corresponding fee adjustments.
