WHEREAS, on December 1, 1998, the City of Fort Worth, the "City", and Chiang, Patel & Yerby,
Inc., the "Engineer", made and entered into City Secretary Contract No. 24499 which was duly
authorized by the City Council by M&C C-17171 on December 1, 1998, and
WHEREAS, the "City" and "Engineer" desire to amend City Secretary Contract No. 24499.
NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS:
That the City of Fort Worth, a municipal corporation situated in Tarrant County, Texas, acting
herein by and through its duly authorized City Manager, hereinafter called "City", and Chiang,
Patel & Yerby, Inc., acting and herein by and through its duly authorized President, hereinafter
called "Engineer", hereby make and enter into the following agreement:

AMENDMENT TO SCOPE OF SERVICES
INCLUDING
SECURITY IMPROVEMENTS FOR TREATMENT PLANTS
This amendment to the Attachment"A" Scope of Services for the Emergency Response Plan for
the City of Fort Worth Water Department adds additional task items which provide: 1) additional
design work relating to anti-tailgating and future crash-resistant barrier arms at entrances to the
treatment plants, 2) additional design work relating to the North Holly entrance in Fournier
Street, 3) additional work relating to replacing and adding cameras at Village Creek Wastewater
Treatment Plant, 4) additional work relating to adding more cameras at water treatment plant
chlorine and ammonia storage facilities, and 5) additional work related to surveying, permitting
and other miscellaneous design activities as stipulated in the following task items.

Basic Services Task Items
ATTACHMENT "G" PROJECT DESCRIPTION
The City proposes adding anti-tailgating and future crash-resistant barrier arms as part of the
security improvements at the entrances to the following Water Department treatment facilities:
Eagle Mountain, Rolling Hills, North and South Holly, Field Operations and Village Creek.
Anti-tailgating systems for the entrance and exit of each entrance will include one high-speed
barrier arm followed by an iron-gate. An automated control system will cause the two gates to
work together to reduce the potential for tailgating of vehicles through the entrance and exit
gates.
Crash-resistant barrier arms are proposed for future installation at each entrance. Work will
include making provisions in the existing design for retrofitting each entrance with crash-
resistant barrier arms.
Originally, the North Holly entrance was designed to be located at its existing location
immediately south of the old filter building. Work will include designing the entrance to be
located on Fournier Street.
The City requested engineering services associated with replacing and adding cameras at the
Village Creek Wastewater Treatment Plant. Additional cameras were also requested at each
treatment plant at chlorine and ammonia storage facilities.
ATTACHMENT "G" SCOPE OF SERVICES
Project Tasks
As part of the professional services required to complete this project, the Engineer will perform
the following tasks:
Task G-1 Additional Surveying and Redesign of South Holly Entrance
CP&Y will prepare a topographic survey around the proposed South Holly entrance where
gates, cameras and lights are proposed. CP&Y will use existing record drawings provided by
the City and information from the topographic survey as a guide to locating buried utilities.
CP&Y is not responsible for locating buried utilities not shown on drawings provided by the City.
CP&Y will redesign the South Holly entrances to be located west of the employee parking area
located south of the Field Operations Administration Building. The new entrance will be
accessed via Broadway Ave. CP&Y will design a new emergency exit on 11'h Ave.
Task G-2 Building Permits
CP&Y will assist the City in obtaining building permits for the entrances. City will pay all building
permit fees. This task does not include building permits that may be required for the Alert
Notification Improvements.

Task G-3 Additional Cameras
CPBY will provide engineering services associated with 1) replacing existing cameras at the
Village Creek Wastewater Treatment Plant, and 2) adding cameras at chemical storage areas at
each of the water treatment plants. Subtasks associated with these engineering services are
listed below.
• Conduct additional meetings with plant personnel to develop the exact location
for the additional cameras.
• Conduct site visits to determine conduit routing, power feed and interface to the
existing camera system. The following cameras were included as part of the ADT
construction cost estimate:

• Develop drawings to show the location of the cameras, riser diagram, power feed

Deliverable:Engineer will submit to the City for review camera locations and design drawings at 90%and final.
Task G-4 Revise Construction Drawings
Revise drawings developed during work associated with Attachment "F" that are sufficient for
construction of security improvements at the entrance to each facility. Entrance security
improvements for each facility that are in addition to the improvements discussed in Attachment
"F" are discussed below:
North Holly Water Treatment Plant
• Redesign entrance to be located on Fournier Street.
• Include anti-tailgating system on entrance and exit.
• Plan for future installation crash-resistant barrier arms.
South Holly Water Treatment Plant
• Include anti-tailgating system on entrance and exit.
• Plan for future installation crash-resistant barrier arms.
Field Operations
• Include anti-tailgating system on entrance and exit.
• Plan for future installation crash-resistant barrier arms.

Rolling Hills Water Treatment Plant—Main Entrance

Rolling Hills Water Treatment Plant—Rear Entrance
• Include anti-tailgating system on entrance and exit.
• Plan for future installation crash-resistant barrier arms.
Eagle Mountain Water Treatment Plant
• Redesign entrance to be located parallel to Bowman Roberts and approved by
City. The existing main entrance will be used as an emergency/large equipment
entrance.
• Include anti-tailgating system on entrance and exit.
• Plan for future installation crash-resistant barrier arms.
Village Creek Wastewater Treatment Plant
• Include anti-tailgating system on entrance and exit.
• Plan for future installation crash-resistant barrier arms.
In addition to the above improvements, the design also includes miscellaneous civil and
electrical tasks needed to modify entrances as well as to supply power to gates, cameras,
monitors, and lights.
General Information
When working with closed-architecture SCADA systems, CP&Y will coordinate the design with
the SCADA system supplier. Fees charged by SCADA suppliers are considered an additional
cost or the City will directly pay SCADA suppliers under separate contract.
Cost for engineering services are based on availability of the following components:
• Adequate instrumentation and SCADA at each plant
• Adequate electrical availability for the equipment.
CP&Y will develop one set of Construction Drawings for each entrance. CP&Y will deliver drafts
of Construction Drawings at 95% complete to the City for review and comment. After comments
are included in the Construction Drawings, CP&Y will assist the City in obtaining Building
Permits as discussed in Task G-2.

Task G-5 Evaluation of Sewage Storage Alternatives and Design of Package Lift
Station at Rolling Hills main entrance
CP&Y will evaluate methods of storing and/or disposing of the sewage generated by the Guard
Station at the Rolling Hills main entrance. After obtaining approval from the City on a
recommended method, CP&Y will provide general layout drawings and equipment data sheets
sufficient for the City to use to install the equipment using City personnel.
Deliverable:Engineer will submit to the City general layout drawing and equipment data sheets for the recommended alternative.
Task G-6 Vacate Fournier Street Services
Engineer will assist City to vacate Fournier Street by providing the following services.
• Subcontract surveyor to develop legal descriptions and drawings as required by
the Development Department.
• Complete forms as required by the Development Department.
• Attend meetings with Development Department and City Council as needed
during the process.
City will sign the forms and acquire signatures of adjoining property owners. Engineer is not
responsible for paying any City fees associated with vacating the street.
Task G-7 Alert Notification Bidding Documents and Standard Operating Procedures
Engineer will develop plans and technical specifications sufficient for bidding alert notification
improvements for North Holly, South Holly and Field Operations areas. Plans and specifications
will be based on the previous design developed under Amendment No. 2. Engineer's design
includes the following:
• Prepare floor plans based on available existing floor plan drawings to be
provided by City. Detailed field surveying by Engineer of each facility to verify
floor plans is not included in this task.
• Layout of system equipment and devices for each building. Layout will include
routing of conduit and cable where applicable.
• Design power circuits for equipment requiring 120 VAC source and design
connections to existing electrical distribution system.
Engineer will coordinate with City of Fort Worth Development Department to determine
requirements for electrical permits specific to this work.
Deliverable:Engineer will submit to the City for review plans and specifications at 95%and final.
Engineer will develop Standard Operating Procedures (SOPS) for each Alert Notification alarm.
SOPS will be developed in both electronic form and paper copies. Engineer will conduct one (1)
workshop with City staff to discuss current SOPS for each alarm event and to discuss additional
procedures that are necessary as part of the Alert Notification system. Engineer will submit draft

SOPS to City for review and conduct one (1) workshop to discuss comments. Engineer's work is
limited to developing a maximum of 12 SOPS.
Deliverable:Engineer will submit draft SOPs in paper format and final SOPS in electronic and paper format.
Task G-8 Construction Phase Services for Security Improvements at Entrances
Engineer will provide construction phase services for each entrance described in Task G-4.
Construction phase services are based on: 1) a construction schedule of 6 months and seven
entrances, and 2) the City will coordinate the construction work and is responsible for timely
progression of the project.
Services provided by the Engineer are described in the following sections.
G-8-1. General Activities
General activities will consist of the following for each entrance:
• Develop a typical construction schedule for the South Holly Water Treatment
Plant entrance. City will update the schedule as necessary and will use the
typical construction schedule as a template for creating schedules for the
remaining entrances.
• Project Kick-off Meeting - The Engineer will attend one (1) project kickoff meeting
and prepare meeting minutes. City will schedule and coordinate the meeting.
• Pre-Construction Meeting -The Engineer will attend six (6) project pre-
construction meetings and prepare meeting minutes. City will schedule and
coordinate the meetings.
• Monthly Project Meetings - The Engineer will attend six (6) monthly progress
meetings with representatives from the City. City will schedule and coordinate the
meetings.
• Materials Testing Reports — Engineer will review materials testing reports
prepared by the City for soil compaction and concrete testing. City will collect all
samples, perform all materials tests, and prepare test reports.
• Review Contractor Pay Requests - City will review Contractor Pay Requests.
• Shop Drawing Review- The Engineer will receive and keep on file, twenty (20)
submittals. The Engineer will coordinate and make recommendations to the City,
when appropriate, concerning field observations that could impact the disposition
of the shop drawing. City will review shop drawings and provide written
comments for CP&Y to include in comments to City's subcontractors.
• Traffic Control Planning — City will provide traffic control planning for each
entrance.
• Prolog Document Management— Engineer will maintain project documents using
Prolog Management Software. Construction documents will be accessible via a

password protected web site. Documentation responsibilities for the Engineer
and City are listed below:
a) Engineer will create and manage the database.
b) Engineer will pay fees associated with creating and maintaining the web
site for a period of six (6) months.
C) City will provide meeting minutes to Engineer to be entered into the
database by the Engineer.
d) Documents to be maintained on the web site will include: 1) Meeting
minutes with action items; 2) Daily journals; 3) RFI tracking; 4) change
orders; 5) contact lists; 6) official correspondence; 7) drawings in PDF; 8)
construction photographs.
• City is responsible for coordinating all building permit inspections. CP&Y's
responsibilities are limited to Task G-2.
Deliverables:Meeting minutes,progress reports,submittal log, and change order log.
G-8-2. Construction Observations
Construction Observations will consist of activities related to the observation of construction
progress. Inspection activities will be performed by the Engineer to assist Owner in determining
that construction is proceeding in accordance with the design drawings. Construction
observation will be on a part-time basis, involving a pre-determined number of site trips, with
observation occurring during specific construction phases or after specific portions of the work
are complete. Construction management will include the following activities for each entrance:
• Construction Staking — Engineer will retain a surveyor to provide construction
staking. Construction staking is limited to one trip by the surveyor to each
entrance. Additional trips by the surveyor are considered additional work.
• Site Clearing and Excavation: Engineer will observe clearing and excavation.
One (1) trip per entrance.
• Island Formwork/Reinforcing Steel Installation: Engineer will observe island
formwork and reinforcing. Two (2) trips per entrance.
• Island Foundation Concrete Pour— Engineer will observe concrete pour, observe
test cylinder collection, and observe slump testing. One (1) trip per entrance.
• Below Grade Conduit Installation: Engineer will observe the electrical conduit
installation prior to slab pour. Two (2) trips per entrance.
• Plumbing/sewage piping: Engineer will observe the plumbing and sewage piping
prior to slab pour. Two (2) trips per entrance.
• Roadway Formwork and Reinforcing Steel: Engineer will observe roadway
formwork and reinforcing. Four (4) trips per entrance.

• Roadway Concrete Pour— Engineer will observe concrete pour, observe test
cylinder collection, and observe slump testing. Four (4) trips per entrance.
• Building Installation: Engineer will observe building installation. One (1) trip per
entrance.
• Cable Installation: Engineer will observe cable installation. Three (3) trips per
entrance.
• Gate Installation: Engineer will observe gate installation. One (1) trip per
entrance.
• Security Equipment Installation: Engineer will observe installation of security
equipment. Four (4) trips per entrance.
• Instrumentation Installation: Engineer will observe installation of instrumentation.
Three (3) trips per entrance.
G-8-3. Start-up Testing, Final Inspection, As-Built Review
This subtask will consist of activities related to the facility start-up testing, inspection, and
review. The Engineer will observe equipment and instrumentation testing. A substantial
completion inspection will be conducted and the Engineer will generate a punch-list of items to
be addressed or completed. The Engineer will witness the Contractor's facility demonstration
and conduct a final inspection. Subtask activities will include the following:
• Start Up Testing - Engineer will witness testing of equipment, instrumentation,
and controls. Three (3) trips per entrance.
• Substantial Completion Inspection - Engineer will perform a full facility inspection
after the Contractor declares the facility is Substantially Complete. Engineer will
develop a punch list of items for the Contractor to address, based on the
substantial completion inspection. One (1) trip per entrance.
• Punch List Inspection — Prior to the facility demonstration, Engineer will visit each
site to verify punch list items are complete and prepare a status report on the
punch list items. One (1) trip per entrance.
• Facility Demonstration and Final Inspection - Engineer will attend the
Contractor's facility demonstration and conduct a final inspection of the facility.
Engineer will update the punch list items based on the final inspection. One (1)
trip per entrance.
• As-Built Drawings - Engineer will develop as-built drawings based on information
supplied by the City and recorded during field observations.
G-8-4. Supplemental Services
Any services not defined above shall be considered Supplemental Services. Supplemental
Services shall include, but not be limited to the following:

• Additional services beyond the specific number stipulated.
• Services required beyond the anticipated six (6) month project schedule from the
Start of Work on the first entrance until final inspection on the last entrance.
• Other services requested by the Owner.
Task G-9 Construction Phase Services for Alert Notification Improvements at North
Holly, South Holly and Field Operations
Engineer will provide construction phase services for Alert Notification Improvements at North
Holly WTP, South Holly WTP and the Field Operations area. These three areas are considered
a single site. Construction phase services for this site are based on a construction schedule of
three (3) months.
Services provided by the Engineer are described in the following sections.
G-9-1. General Activities
General activities will consist of the following for this site:
• Develop a typical construction schedule for the improvements. City will update
the schedule as necessary.
• Pre-Construction Meeting - Engineer will attend three (3) project pre-construction
meetings and prepare meeting minutes. City will schedule and coordinate the
meetings.
• Monthly Project Meetings - Engineer will attend three (3) monthly progress
meetings with representatives from the City. City will schedule and coordinate the
meetings.
• Special Coordination Meetings: Engineer will attend two (2) special coordination
meetings that may be necessary to resolve construction issues.
• Review Contractor Pay Requests - City will review Contractor Pay Requests.
• Shop Drawing Review- Engineer will receive and keep on file, ten (10) contractor
submittals. Engineer will coordinate and make recommendations to the City,
when appropriate, concerning field observations that could impact the disposition
of the shop drawing. City will review shop drawings and provide written
comments for CP&Y to include in comments to contractor.
Traffic Control Planning — City will provide traffic control planning, if necessary.
• Document Management— Engineer will maintain paper copies of project
documents that Engineer originated or reviewed. No project web site is included
for this task.
Deliverables:Meeting minutes,progress reports,submittal log, and change order log.

G-9-2. Construction Observations
Construction observations will consist of activities related to the observation of construction
progress. Inspection activities will be performed by the Engineer to assist Owner in determining
that construction is proceeding in accordance with the plans and specifications. Construction
observation will be on a part-time basis, involving a pre-determined number of site trips, with
observation occurring during specific construction phases or after specific portions of the work
are complete. Construction management will include the following activities:
• Below Grade Conduit Installation: Engineer will observe underground conduit
installation. Two (2) trips.
• Wireless Receivers: Engineer will observe installation of wireless receivers.
Three (3) trips.
• Speakers: Engineer will observe installation of speakers and visual alarms. Three
(3) trips.
• Transmission Tower: Engineer will observe installation of central transmission
tower. One (1) trip.
• Instrumentation Installation: Engineer will observe installation of instrumentation.
Two (2) trips.
G-9-3. Start-up Testing, Final Inspection, As-Built Review
This subtask will consist of activities related to the facility start-up testing, inspection, and
review. The Engineer will observe equipment and instrumentation testing. A substantial

trip per entrance.
• As-Built Drawings - Engineer will develop as-built drawings based on information
supplied by the City and recorded during field observations.

G-9-4. Supplemental Services
Any services not defined above shall be considered Supplemental Services. Supplemental
Services shall include, but not be limited to the following:
• Additional services beyond the specific number stipulated.
• Services required beyond the anticipated three (3) month project schedule from
the Contractor's Notice to Proceed until Final Inspection.
• Other services requested by the Owner.
ATTACHMENT "G" COMPENSATION
I BASIC ENGINEERING SERVICES
For engineering services under Amendment No. 3, the "City" shall pay the "Engineer" a lump
sum fee of$596,241.
A. Payment: Partial payment shall be made monthly upon receipt of an invoice from the
Engineer based on the percent complete of each task outlined in Attachment G. Basis of
payment for Basic Engineering Services is shown in Exhibit G-3.
B. Timeliness: Lump sum fees are based on the City providing a notice to proceed for each
phase of the work within two months of the contract date. If a notice to proceed is not
provided within two months of the contract date, the Engineer has the option to
renegotiate the lump sum fee and hourly billing rates.
II ADDITIONAL SERVICES
For additional services provided outside the scope defined in Attachment G, as approved by
amendment to this Agreement, the "City" will pay the "Engineer" for labor, other incidental direct
costs, and subconsultants on the same basis as described below.
A. Labor: The Engineer shall be compensated for the services of his personnel on the basis
of Salary Cost times a multiplier of 3.0 for the time such personnel are directly utilized on
the work. Typical billing rates are shown in Exhibit G-2.
Salary cost is defined as the cost of salaries of engineers, technicians, word processors,
surveyors, clerks, laborers, etc., security contributions, unemployment, excise and
payroll taxes, and insurance benefits, sick leave, vacation, and holiday pay applicable
thereto.
The salaries of any personnel assigned are subject to reasonable modification by the
Engineer throughout the term of this Agreement; however, such modification will not
affect the upper limit value of this Agreement.
B. Other Incidental Direct Costs: The Engineer shall be compensated at cost plus 10% for
all costs other than salary costs that are incurred pursuant to this Agreement, but which
are not normally included as part of the Engineer's overhead. These costs include: air
fare, automobile rental, mileage charges, parking, tolls, taxi, meals, lodging, telephone,
printing and reproduction costs, computer and work processors, postage and mailing
costs, and other miscellaneous costs incurred specifically for this project.

C. Subconsultant Services: For all subconsultant services, the Engineer shall be
compensated at the actual subconsultant cost plus 10%.
D. Payment: Partial payment shall be made monthly upon receipt of an invoice from the
Engineer, prepared from the books and records of the Engineer, outlining the amount of
hours worked by each employee, the employee's name and classification, and the
employee's billing rate along with itemized charges for subconsultant services and other
incidental direct costs performed during the period covered by said invoice.

SUBJECT AMENDMENT NO. 3 TO CONTRACT WITH CHIANG, PATEL & YERBY, INC. FOR
ENGINEERING SERVICES RELATED TO INSTALLATION OF WATER DEPARTMENT
ALERT NOTIFICATION SYSTEMS AND SECURITY IMPROVEMENTS AT
TREATMENT PLANTS
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute an amendment to the
contract with Chiang, Patel & Yerby, Inc. for engineering services related to the installation of Water
Department alert notification systems and security improvements at treatment plants, increasing the
cost by $596,241, for a total contract cost not to exceed $964,765.
DISCUSSION:
On December 1, 1998 (M&C C-17171), the City Council authorized the execution of an engineering
agreement with Chiang, Patel & Yerby, Inc. for engineering services related to the development of the
Water Department emergency response plan.
This agreement was amended on August 3, 1999 (M&C C-17565), to provide for a security evaluation
of treatment facilities and revision of the Water Conservation and Emergency Water Management Plan.
This agreement was subsequently amended on October 2, 2001 (M&C C-18771), to provide for the
design of treatment plant security system improvements and upgrade of the plant alert notification
systems. Under the second contract amendment, the consultant completed the initial design for
treatment plant entrances and recommendations for a new alert notification system for all plants.
After the terrorist attacks on September 11, 2001, security requirements for water treatment plants
increased significantly. The Public Health Security and Bioterrorism Preparedness and Response Act of
2002, required all public utilities serving more than 100,000 customers to conduct a vulnerability
assessment and update their emergency operation plans for water treatment plants. The City Council
approved a contract with CH2M Hill to conduct a comprehensive vulnerability assessment of the system
on February 12, 2002 (M&C C-18956). The assessment report was completed in December 2002.
Chiang, Patel & Yerby, Inc. has proposed to provide engineering services to complete designs for
treatment plant entrances and security improvements recommended in the vulnerability assessment.
Bid documents will also be prepared for the new alert notification system for the Holly Treatment Plant
site. The total security improvement design cost is $254,280. Construction for the plant entrances and
installation of the alert notification system are also included at a cost of $341,961, for a total
amendment cost of$596,241.
Chiang, Patel & Yerby, Inc. is in compliance with the City's M/WBE Ordinance by committing to an
additional 20% M/WBE participation on this Amendment No. 3. The City's goal on this amendment is
20%.
