VILLAGE WHOLESALE WASTEWATER METER STATION, DOE NO.

The proposed amendment will allow carter & Burgess, Inc. (C&B) to provide additional en-
gineering services on the project as requested by the City.
During construction it was determined that both the Stagecoach Hotel and the Lonesome
Dove Restaurant were experiencing problems with back up, both of which are located on
North Main Street. Upon further investigation by C&B, it was found that the sewer service
line to the Stagecoach Hotel had not been connected to a sewer lateral on Main Street that
was replaced seven years ago. As the building is presently unoccupied, the sewer backup
took some time to develop due to the infrequent use of the facility. City staff has requested
that C&B develop alternatives and make design recommendations to provide functional sani-
tary service options for this property. Options and recommendations were also requested of
C&B as regards the Lonesome Dove Restaurant's problems and their rectification.
Carter & Burgess, Inc., has requested a fee of$13,100.00 for the additional services to be
provided thereby increasing the contract fee from $504,812.00 to $517,912.00. I believe this
fee is fair and reasonable for the additional services that were provided.
Please authorize this additional design fee by your signatures on the attached contract
amendment form.

WHEREAS, the City of Fort Worth (City) and Carter & Burgess,
Inc. , (Engineer) made and entered into City Secretary Contract No.
23666, (the Contract) which was authorized by the City Council by
M&C C-16634 on the 24th day of February 1998; and subsequently
revised by one previous amendment; and
WHEREAS, the Contract involves engineering services for the
following project:
Engineering contract for the design of Mains BR and 279
Drainage Area Sanitary Sewer System Rehabilitation and
Improvements (Group 7, Contract 1) , Part 2 and Edgecliff
Village Wholesale Wastewater Meter Station.
WHEREAS, it has become necessary to execute Amendment No. 2
to said Contract to include an increased scope of work and revised
maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and
through their duly authorized representatives, enter into the
following agreement which amends the Contract:

Article I of the Contract is amended to include the
additional engineering services specified in a proposal letter
dated October 24, 2003, a copy of which is attached hereto and
incorporated herein. The cost to City for the additional design
services to be performed by Engineer total $13, 100 . 00 .
2 .
Article II of the Contract is amended to provide for an
increase in the maximum fee to be paid to Engineer for all work
and services performed under the Contract, as amended, so that the
total fee paid by the City for all work and serviceRk
exceed the sum of $517, 912 . 00.
3 .
All other provisions of the Contract which are not expressly amended
herein shall remain in full or a and effect.

Dear Mike:
At the request of the City of Fort Worth, Carter& Burgess, Inc. performed additional work last
spring of 2003 for the sanitary sewer service in the J. B. Googins Subdivision, North Fort Worth
Addition. This work was preformed under the supervision of Robert Paleschic, which is no
longer employed by Carter& Burgess. This effort was for investigating, recommendation and
preparing plans for sewer service solution for the Stagecoach Hotel and the Lonesome Dove
Restaurant Properties (see attached draft letters by Robert Paleschic). Mr. Paleschic was
supposed to have processed an engineering fee amendment with you to support the effort
made to complete the work effort for the above referenced project. Since Mr. Paleschic is no
longer an employee with Carter& Burgess and there are no records that a fee amendment
(Amendment No. 2) was ever submitted or processed, at this time we hereby respectively
request your consideration for granting additional funds for this Amendment No. 2 in the amount
of$13,100. This is the amount of effort that Carter& Burgess expended on this project for
various tasks for this project's completion. Attached is our accounting documentation supporting
the fee request.
We apologize for our lack of not acting upon this amendment sooner, but would appreciate your
immediate attention and help in getting this matter resolved.

more detail. We would gladly participate in a meeting on this subject, if you think one is needed
to resolve this subject.
