Z�9 (No M&C Needed) COUNTY OF TARRANT $ WHEREAS, the City of Fort Worth (City) and Gutierrez, Smouse, Wilmut & Associates, Inc. , (Engineer) made and entered into City Secretary Contract No. 26802, (the Contract) which was authorized by the City Council by M&C C-18597 on the 22nd day of May 2001; and subsequently revised by three previous amendments; and WHEREAS, the Contract involves engineering services for the following project: Engineering contract for the design of Sanitary Sewer Rehabilitation Contract LXIII (63) . WHEREAS, it has become necessary to execute Amendment No. 4 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1 . Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated October 15, 2003 , a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer total $7, 229 . 00 . 2 . Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $101, 845. 55 . 3 . Justification In review of the existing L-483 backyard sewer main with City Staff, it has been determined that the best solution to provide sufficient depth for the sanitary sewer service to 2309 Edwin Street and minimize inconvenience to the downstream home owners will be to construct a new 8-inch public sanitary sewer main from L-483R in Mistletoe Drive east up Edwin Street for about 580 feet and then install 100 feet of new sanitary sewer service line for 2309 Edwin Street. This new sewer main was not in the original engineering contract scope or any of the previous amendments, therefore additional surveying and engineering design will be required. GSW's contract with -the MWBE surveyor is attached. The additional costs are summarized below: • Additional surveying for 8-inch sewer main in Edwin St. by A.N.A. Domenech, P.E. DATE: November 7, 2003 RE: DESIGN FEE AMENDMENT NO. 4 TO SANITARY SEWER REHABILI- TATION CONTRACT LXIII (63), DOE NO. 3358, WATER PROJECT NO. PS58-070580175510 The proposed amendment will allow Gutierrez, Smouse, Wilmut & Associates, Inc., (GSWA)•to provide additional survey and design on the project as requested by the City. Subsequent to completing design of the project, it has been determined that lateral L-483 needs to be deepened in order to provide trouble free sanitary sewer service to residences lo- cated on Edwin Street. A new 8-inch sanitary sewer main is proposed from L-483R in Mis- tletoe Drive east up Edwin Street for about 580 linear feet along with 100 linear feet of new sanitary sewer service line. Gutierrez, Smouse, Wilmut & Associates, Inc., has requested a fee of$7,229.00 for the addi- tional services to be provided thereby increasing the contract fee from $94,616.55 to $101,845.55. I believe this fee is fair and reasonable for the additional services that were pro- vided.
