STATE OF TEXAS § § KNOWN ALL BY THESE PRESENTS: COUNTY OF TARRANT § THIRD AMENDMENT TO CITY SECRETARY CONTRACT NO. 42161 CONTRACT FOR EMERGENCY RESPONSE SERVICES FOR ENVIRONMENTAL HAZARDS THIS THIRD AMENDMENT to City Secretary Contract No. 42161 (hereinafter "Amendment") is entered into by and between the City of Fort Worth ("City"), a home- rule municipality in the State of Texas, acting by and through Fernando Costa, its duly authorized Assistant City Manager, and Progressive Environmental Services, Inc. dba SWS Environmental Services ("Contractor"), acting through Jeff Sweren, its duly authorized Chief Financial Officer. WHEREAS, the City and Contractor have entered into that certain agreement identified as City Secretary Contract No. 42161 (also the "Contract") executed on August 22, 2011 for emergency response services for environmental hazards; and WHEREAS, that contract was for an initial term of one year beginning on August 22, 2011 through August 21, 2012; WHEREAS, that contract had a provision under Article 4 (Term) for up to three (3) extensions in the term of the contract for one (1) year each upon mutual agreement of the parties and the contract has been so amended through August 21, 2014; WHEREAS, the parties desire to extend the term for an additional year; NOW WHEREFORE: The City of Fort Worth and Progressive Environmental Services, Inc. dba SWS Environmental Services do hereby agree to extend the term of City Secretary Contract No. 42161, as previously amended by written contract amendments, for one additional year beginning on August 22, 2014 through August 21, 2015. The annual not-to-exceed amount for this contract term shall be $24,999, however the unit prices, including but not � limited to labor and materials shall remain unchanged.
