HomeMy WebLinkAboutOrdinance 7259 ORDINANCE NO. AN ORDINANCE PROVIDING THAT WEST HUMBOLT STREET ACROSS THE RIGHT-OF-WAY OF THE ST. LOUIS-SAN FRANCISCO RAILROAD BE VACATED, ABANDONED AND CLOSED; PROVIDING FOR THE REVERSION OF THE IN- TEREST OF THE CITY OF FORT WORTH IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the following described portion of West Humbolt Street crossing the St. Louis-San Francisco Railroad right- of-way be and the same is hereby closed, abandoned and perma- nently vacated as a street or public thoroughfare of any kind or character whatsoever, save and except that the entire area of West Humbolt Street closed by this ordinance is retained as a utility easement: Beginning at the northwest corner of Lot 134 of Carlock's Revision, a subdivision in the City of Fort Worth, also being in the easterly right-of-way line of the St. Louis-San Francisco Railroad and in the southerly right-of-way line of West Humbolt Street; Thence in a southwesterly direction with the said southerly line of West Humbolt Street tO point in the westerly right-of-way line of the said St.., Louis-San Francisco Railroad; Thence northerly with the westerly right-of-way line of said St. Louis-San Francisco Railroad to a point in the northerly right-of-way line of west Humbolt Street; Thence northeasterly with the said northerly right-of-way line of West Humbolt Street to a point in the easterly right-of-way line of said St. Louis- San Francisco Railroad at the southwest corner of Lot 136 of Oarlock's Revision; Thence southerly with the easterly right-of-way line of said St. Louis-San Francisco Railroad to the place of beginning. SECTION 2. That the interest of the City of Fort Worth in the fee to the land in said street is hereby released and shall re- vert to the adjacent owners of the fee as provided by law, SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. Subject right-of-way, acquired by dedication, is open and unpaved and contains gas and telephone facilities, The agencies responsible for these public facili- ties request the vacated right-of-way be retained as a utility easement to pro- vide future maintenance to their respective facilities. This request was initia- ted by the Director of Public Works in conjunction with the St. Louis and Santa Fe Railroad in order to eliminate hazardous and hard to maintain railroad cross- ings. The City Plan Commission has reviewed this request and recommends that an ordin- ance be adopted vacating subject right-of-way as requested. Right-of-Way A strip of land thirty feet in width crossing the St. Louis-San Francisco Railway Co. right-of-way in Fort Worth, Tarrant County, Texas, and being known as Humbolt Street, more particularly described as follows : Beginning at the northwest corner of Lot 134 of Carlock's Revision, a subdivision in the City of Fort Worth, also being in the easterly right-of-way line of the St. Louis-San Francisco Railroad and in the southerly right-of-way line of Humbolt Street.
