COUNCIL ACTION: Approved on 1/27/2004
DATE: Tuesday, January 27, 2004
LOG NAME: 30LWBOATSKI REFERENCE NO.: **L-13754
SUBJECT:
Authorization of Lease with the Lake Worth Boat and Ski Club for City-Owned Property Located at
4001 Marina Drive, Lots 6, 7, and 8, Block 8, Lake Worth Lease Survey
RECOMMENDATION:
It is recommended that the City Council authorize approval of a lease agreement with the Lake Worth Boat
and Ski Club for City-owned Lake Worth lease property located at 4001 Marina Drive, Lots 6, 7, and 8,
Block 8, Lake Worth Lease Survey for a term of five years, with one option to extend the agreement for
another five-year term commencing on June 1, 2001, and expiring May 31, 2006, for an annual lease rate of
$4,800.
DISCUSSION:
This Lake Worth property was originally leased to the Lake Worth Boat and Ski Club on June 1, 1971, for a
period of 25 years, with an original expiration date of May 31, 1996. The lease provided for a renewal of the
lease under the same terms and conditions as specified in the original lease. The original lease provided
for three five-year renewal options. The first renewal of the lease for a term_ of five years expired on May
31, 2001.
In 2001, the Lake Worth Boat and Ski Club requested a second lease renewal and was provided a revised
lease, which was never executed by the lessee or the City. The Lake Worth Boat and Ski Club has
continued to operate on a month-to-month basis under the terms of the second lease renewal agreement
which expired in 2001.
This five-year lease renewal, if approved, will be retroactive to June 2001, and will expire on May 31, 2006.
The Lake Worth Boat and Ski Club has agreed to pay the difference of the annual lease rate increase
between 2001 and 2003 renewal in the amount of$900.
This lease renewal incorporates the lease rate proposed by the City in 2001, but for which no formal
agreement was reached. The third and final renewal, if approved by the City Council in 2006, will be at the
fair market value established at the time of renewal.
The property is located in COUNCIL DISTRICT 7, Mapsco 45Z.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that the Revenue Division of the Finance Department is responsible for the
collection and deposition of funds from this lease.
