AMENDMENT TO ENGINEERING CONTRACT STATE OF TEXAS § CITY SECRETARY COUNTY OF TARRANT § Contract No. 26804 WHEREAS, the City of Fort Worth (City) and Malcolm Pirnie Inc. (Engineer) made and entered into City Secretary Contract No. 26804 (the "Contract") on the 1st day of March, 2001; and WHEREAS, the Contract involves engineering services for the following project: Design of Westside IV Pump Station, Water Transmission Main and Elevated Tank WHEREAS, it has become necessary to amend said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I, Section 1 of the Contract is amended to include the additional engineering services specified in a proposal letter dated February 18, 2004, a copy of which is attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer is $114,090. 2. Article III of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of$ 471,290. 3. Engineer acknowledges its commitment to obtain an additional 26% M/WBE participation for this amendment. The Engineer's commitment for the Contract remains unchanged. 4. All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect. t Rim, I • . At various times during the project additional design was identified and requested by the City. From these requests, Malcolm Pirnie prepared a five separate scope of work description and engineering fee proposals to provide the requested changes. The five project changes prepared and submitted to the Fort Worth Water Department are summarized below. These five project changes result in a project Amendment No. 1 request totaling $114,090, revising the total contract value from $357,200 to$471,290. Change No.l -Transmission Main extension from 5,000 to 9,000-feet $35,618 Provide additional surveys, easement, geotechnical investigations and engineering design to extend the West Side IV Transmission Main an additional 4,000-foot. Change No.2 -Walsh Ranch Elevated Tank evaluation and recommendation $13,604 Provide a hydraulic and engineering evaluation to identify the optimum location of the proposed elevated tank for West Side IV and the Walsh Ranch Area. Change No.3 -Additional survey and easement on Vernon Property $ 1,870 The pipeline was extended to the West property line of the Vernon Investment Property. The field survey and easement documents were revised. Change No.4 -Pump station modifications for delivery to Walsh Ranch $34,186 The West Side IV Pump Station design was revised to provide water supplies to a new ground storage tank located in the future Walsh Ranch Development. The new ground storage tank site is approximately 40,000-feet away from the pump station. Change No.5 - Modify Size of Elevated Storage Tank & 1,600' of 16"Line $28,812 The proposed elevated storage tank located on the Vernon Investment property will be revised from 1 MG to 1/4 MG storage. (City Secretary No. 26804) for design of the West Side IV Tank, Pump Station and Transmission Main, for an amount not to exceed $114,090, increasing the total contract amount to $471,290. DISCUSSION: On May 1, 2001 (M&C C-18578), the City Council approved an engineering agreement with Malcolm Pirnie, Inc. for the design of an elevated storage tank, a pump station and a water transmission main, to improve water pressure and provide water storage in the West Side IV pressure plane, west of IH-820 and north of IH-30. This contract amendment compensates the engineer for additional design services to increase the length of transmission main, prepare a study to evaluate options to provide water service to Walsh Ranch, conduct additional surveys, acquire additional easements, and modify the pump station and elevated storage tank designs as appropriate for a functioning and expandable water distribution system. This project is located in COUNCIL DISTRICT 7. Malcolm Pirnie, Inc. is in compliance with the City's M/WBE Ordinance by committing to an additional 26% M/WBE participation on this Amendment FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that funds are available in the current capital budget, as appropriated, of the Commercial Paper—Water Fund.
