CITY SECRETARY CONTRACT NO. CITY OF FORT WORTH, TEXAS CONSTRUCTION CONTRACT EMERGENCY PROJECT THE STATE OF TEXAS KNOW ALL MEN BY THESE PRESENTS: COUNTY OF TARRANT This agreement made and entered into this the Deday of A.D.. 20qy, by and between the CITY OF FORT WORTH, a municipal corporation of Tarrant County,Texas,organized and existing under and by virtue of a special charter adopted by the qualified voters within said City on the 11th day of December, A.D. 1924, under the authority (vested in said voters by the "Home Rule" provision) of the Constitution of Texas, and in accordance with a resolution duly passed at a regular meeting of the City Council of said city, hereinafter called OWNER, and _AA Applicators. Inc of the City of--Dallas County of ---Dallas , State of Texas hereinafter called CONTRACTOR. WITNESSETH: That for and in consideration of the payments and agreements hereinafter mentioned to be made and performed by the Owner, and under the conditions expressed in the bond bearing even date herewith, the said Contractor hereby agrees with the said Owner to commence and complete the construction of certain improvements described in the attached proposal. Upon acceptance of this Proposal by the City Council, the Contractor is bound to execute a contract and, if the contract amount exceeds $25,000.00, furnish Performance and/or Payment Bonds approved by the City of Fort Worth for performing and completing the Work within the time stated and for Proposed Work outlined in the attached Proposal dated June 28, 2004. PROJECT NAME Windstorm Repairs PROJECT NUMBER 2004-08 FACILITY NAME CENTRAL LIBRARY SCOPE: PIT ROOF, REPLACE MEMBRANE AND INSULATION IN THE PIT ROOF AREA That the work herein contemplated shall consist of furnishing as an independent contractor all labor, tools, appliances and materials necessary for the construction and completion of said project in accordance with the Proposal dated June 28, 2004 which is attached and made a part of this agreement. City agrees and binds itself to pay, and the said Contractor agrees to receive,for all of the aforesaid work, and for stated additions thereto or deductions therefrom, the price shown on the Proposal submitted by the successful bidder hereto attached and made a part hereof. Payment will be made in monthly installments upon actual work completed by contractor and accepted by the Owner and receipt of invoice from the Contractor. The agreed upon total contract amount shall be $31,400. Contractor agrees to con p the project, suitable for occupancy and beneficial use, within 90 calendar days. - - Insurance Requirements: The Contractor will provide a Certificate of Insurance listing the Transportation'and Public Works Department as certificate holder, showing the required General Contractors Liability coverage, Auto Liability, and Builder's Risk. Contractor agrees to provide to the City a certificate showing that it has obtained a policy of workers compensation insurance covering each of its employees on the project in compliance ORIGINAL with State law. No Notice to Proceed will be issued until the Contractor has complied with this section. Contractor agrees to require each and every subcontractor who will perform work on the project to provide to it a certificate from such subcontractor stating that the subcontractor has a policy of workers compensation insurance covering each employee employed on the project. Contractor will not permit any subcontractor to perform work on the project until such certificate has been acquired. Contractor shall provide a copy of all such certificates to the City. The undersigned assures that its employees and applicants for employment and those of any labor organization, subcontractors or employment agency in either furnishing or referring employee applicants to the undersigned are not discriminated against as prohibited by the terms of City Ordinance 7278 as amended by City Ordinance 7400 (Fort Worth City Code Section 13A-21 through 13A-29). If this Contract is in excess of $25,000, the Contractor shall provide Payment Bond. If the Contract is in excess of$100,000 Contractor shall provide both Payment and Performance Bonds for the full amount of the Contract. Contractor shall apply for all City of Fort Worth Permits and for any other permits required by this project. City of Fort Worth Permit fees are waived. Separate permits will be required for each facility. The Standard Contract Documents for Emergency Repairs to Facilities, Architectural Services Section, Department of Transportation and Public Works, City of Fort Worth, Dated March 29,2000, are made a part of this contract by reference. If the Contractor should fail to complete the work as set forth in the Plans and Specifications and Contract Documents within the time so stipulated, plus any additional time allowed as provided in the General Conditions, there shall be deducted from any monies due or which may thereafter become due him, the liquidated damages outlined in the General Conditions, not as a penalty but as liquidated damages, the Contractor and his Surety shall be liable to the Owner for such deficiency. IN WITNESS WHEREOF, the City of Fort Worth has caused this instrument to be signed in four counterparts in its name and on its behalf by the City Manager and attested by its Secretary, with the corporate seal of the City of Fort Worth attached. After an extensive examination of the roof at the above location, we would like to offer the following proposal. SCOPE OF WORK DEMOLITION & CLEANING 1. Tear off existing damaged roofing, flashings and sheet metal down to the deck. 2. Replace rotted and or missing wood nailers with new wolmanized treated wood naflers of similar size and thickness. This work will be performed at an additional cost of $3.85 per linear foot. This replacement will be based upon visual observation only. 3. Replace deteriorated metal decking with new decking of similar size and thickness. This work will be performed at an additional cost of $6.40 per square foot. Roof Area B has a Lightweight Concrete roof deck. Replacement of this deck will be performed at an additional cost of $8.50 per square foot. This replacement will be based upon visual observation only. 4. Sweep deck free of gravel, dirt and debris. INSULATION & ROOFING 5 . Insulation is to be fastened according to Factory Mutual I-60 wind uplift standard fastening pattern using corrosion resistant fasteners. 7. Install a second layer of 3/4" perlite insulation set in a solid mopping of hot asphalt over the first layer of insulation. The joints of the second layer of insulation area to be staggered from the first layer 12" in both directions. 8. Install 1/2" per foot tapered insulation crickets between the drains. 9. Install new 3" cant strips at the base of walls and curbs. 10. Install U.S.Intec ultra base in a solid mopping of hot asphalt over the insulation. I L Install U.S Tntec Brai Sur eme APP Granule Modified Bitumen roofing system consisting of Brai Supreme APP Smooth and Brai Supreme APP Granular over the fiberglass base ply. FLASHING & SHEET METAL 12. Install new metal edge at the pit roof. 13. Metal flanges will be set in a solid bed of plastic cement and fastened in place. 14. Prime surfaces that are to receive new flashings with asphalt primer. 15. Re-use the existing metal wall cap on the north and east parapet walls. MISCELLANEOUS 16. Broadcast new clean granules over laps in modified bitumen. 17. Keep finished roof surface as clean as is reasonably possible. 18. Haul off trash promptly. 19. No more roofing will be removed than can be replaced with new roofing and made watertight that same day. 20.- A tie-in between the existing roof and the nc;w roof will be constructed every night prior to leaving job site. 21. Work is to be done in accordance with U.S. Intec specifications, and installation procedures. WARRANTY 22. Upon completion furnish an U.S. Intec twenty- (20) year "No Dollar Limit" labor and material warranty. There will be no additional warranties expressed or implied other than manufacturer warranties that are issued. 23. In consideration of payment, AA Applicators. Inc. guarantees this scope of work for a period of two (2) years. Should this work fail due to poor workmanship, AA Applicators, Inc. will repair the roof at no cost to the owner. _ , I 24. Note- To reduce the likelihood of mold growth,periodic inspections of ceilings should be made with all leakage reported and le,,,ks promptly repaired. Ail wet materials must be removed and replaced by others. Prices are firm for(30)thirty days. Owner is to provide electricity as required to operate hard tools. Any alteration or deviation from above specifications involving extra costs will be executed only upon written order, and will become an extra charge over and above the estimate. DISCUSSION: The recent storm related damage to several City properties caused over $450,000 in damage, according to the insurance adjuster's estimates. The City's deductible is $250,000 for this type of claim. If the replacement cost for the damage is less than the deductible, any remaining funds will be returned to the Property and Casualty Insurance Fund. The deductible amount will be appropriated immediately upon approval of this Mayor and Council Communication (M&C). The remaining amount will be appropriated as actual funds are received from the insurance company. Although the appropriation ordinance is for up to $500,000, only the amount of the deductible and the actual amount received from the insurance company will be appropriated. If the total costs exceed $500,000, an additional M&C will be submitted to authorize the additional appropriation. This area measures to 78'west of the east parapet and 45' south of the north parapet(to the north edge of the pit roof, inclusive), or about 36 squares of roofing. Cap metal is intended to be reused where possible w/new cover plates. The existing damaged roof is a 20-year warranted U.S. Intec Platinum Series installation (2 ply APP over Ultra base sheet) on a 3" ISO board w/1/8" tapered perlite cricket system (extending from the parapet walls) on a 1- 1/2" metal deck. The roofer is pricing the project at this time, which I will pass on to you and Sue H. as soon as it is prepared. FYI. 1
