This contract is by and between the City of Fort Worth, Grantee,and Women's Haven of Tarrant County,Inc., Service Provider,and in aid of Criminal Justice Division Grant Number SF- 05-V30-13414-07, titled Domestic Assault Response Team(DART). It is understood by all parties that payment obligations created by this contract are conditioned upon the availability of State or Federal funds appropriated or allocated for the payment of such obligations.The term of this contract shall commence on September 1, 2004, and shall end on August 31, 2005, unless extended or terminated as otherwise provided for in this contract. 2. The GRANTEE AGENCY is responsible for closely monitoring the Service Provider and the exercise of reasonable care to enforce all terms and conditions of the grant. Service Provider agrees to fully cooperate in the monitoring process. 3. Requirements of the Uniform Grant Management Standards(UGMS)promulgated pursuant to Section 783,of the Government Code are adopted by reference as part of this contract, including the contract provision as in Section 36, Common Rule of OMB, of the above standards. The GRANTEE AGENCY shall keep all project records. Records shall be retained for a least THREE (3) YEARS, following the closure of the most recent audit report and until any outstanding litigation, audit or claim has been resolved. Records are subject to inspection by CJD, or any state or federal agency authorized to inspect the same. 4. The Service Provider will furnish the following: • Provide emergency shelter to women and children who fear they are in danger of domestic abuse. • Provide programs which meet the immediate physical and emotional needs of clients. • Provide programs for clients which will help curtail the cycle of abuse. • Provide programs to increase public awareness of domestic abuse and to address issues relating to its prevention. • Encourage and coordinate cooperation with other organizations to effect and fulfill the purposes of Women's Haven of Tarrant County, Inc. • One Victim Specialist with a salary and fringe benefits of$35,150. / 31 I y„N'n,In11 l'yT I 0 i -_'7-05A1 1 30 RCVG • u 5. Payment for the above(not to exceed$35,150 of the total amount of the grant) will be made upon receipt of a monthly reimbursement request with an itemized statement of expenses. 6. Billing for the above will be provided in the same manner as it would be provided to institutional purchasers in the absence of a grant and shall consist of a brief statement of the service or other item provided and the basis for the billing rate. 7. In the event of a default of the Service Provider, the GRANTEE AGENCY may cancel or suspend the contract and the SERVICE PROVIDER shall be entitled to recover for all services provided or materials delivered prior to the cancellation date (or unused materials may be returned) or shall repay any funds advanced for services not yet rendered. 8. All licenses, legal certifications,or inspections required for the services,facilities,equipment, or materials,and all applicable state and federal laws and local ordinances must be complied with by the SERVICE PROVIDER. Failure to comply with this requirement shall be treated as a default. 9. This contract shall automatically terminate on the grant expiration date or any extension date thereof granted by CJD or upon termination of the underlying grant by CJD. All services billed hereunder must be rendered within the grant period. 10. The provisions of this agreement are severable and if for any reason a clause, sentence, paragraph or other part of this agreement shall be determined to be invalid by a court or federal or state agency, board or commission having jurisdiction over the subject matter thereof,such invalidity shall not affect other provisions which can be given effect without the invalid provision. 11. The failure of Grantee to insist upon the performance of any term or provision of this agreement or to exercise any right herein conferred shall not be construed as a waiver or relinquishment to any extent of Grantee's right to assert or rely upon any such term or right on any future occasion. e.i� 1�``,T if:.. �S�G•J fy.J ^ U 12. Should any action, whether real or asserted, at law or in equity, arise out of the execution, performance, attempted performance or non-performance of this contract and agreement, venue for said action shall lie in Tarrant County, Texas. 13. Authorize the City Manager to apply for and accept the Fiscal Year 2004-2005 Domestic Assault Response Team (DART) grant from the Governor's Office, Criminal Justice Division (CJD), in the amount of $73,619; 2. Authorize the City Manager to designate Assistant City Manager Joe Paniagua as the authorized official to accept, reject, or alter the DART grant after it is awarded; 3. Provide assurance that funds will be returned to the Criminal Justice Division in full in the event of loss or misuse of CJD grant funds; 4. Authorize the transfer of$30,095 from the Fiscal Year 2005 Federal Awarded Assets for the City's match; 5. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund by $103,714; 6. Authorize the City Manager to waive indirect costs in the amount of$1,472; and 7. Authorize the City Manager to execute a contract with Women's Haven of Tarrant County in an amount not to exceed $103,714. DISCUSSION: Each year the Criminal Justice Division of the Governor's Office funds grant projects throughout the state. The Fort Worth Police Department for the past 6 years has received federal pass-through funds from the Violence Against Women Act (VAWA) to operate the DART project. Due to technical problems in reviewing this year's application, DART was not funded through VAWA but will be funded through the Texas Criminal Justice Planning Fund. DART was originally funded with Community Oriented Policing Services (COPS) funds and provides on- scene crisis intervention to victims of family violence through an active volunteer program. This is a companion program to the Enhanced DART project which was accepted by the City Council via M&C G- 14478, on August 31, 2004.
