HomeMy WebLinkAboutContract 32118 CITY SECRETARY C ONTRACT No. SECOND AMENDMENT TO LEASE AGREEMENT THE STATE OF TEXAS § COUNTY OF TARRANT § WHEREAS, the City of Fort Worth ("Lessor"), acting by and through its duly authorized Assistant City Manager and Lenda Lane made and entered into a Lease Agreement ("Lease") on February 1, 1984 for property described Lot 1-R-6, Block 15, Lake Worth Lease Survey, aka 7379 Love Circle; and WHEREAS, Lenda Lane has married and her name is now Lenda Lane Lair ("Lessee"); and WHEREAS, the Lease has been amended to provide that the Leased Land is comprised of Lot 1 R6 and 1 R6A, Block 15, Lake Worth Leases, an Addition to the City of Fort Worth, Tarrant County Texas as shown on the plat recorded in Cabinet A Slide 9384-9384A, Plat Records, Tarrant County, Texas; and WHEREAS, Lessee has filed suit against Lessor, Cause No 141-203633-04, in the 141st Judicial District Court, Tarrant County, Texas regarding the Lease; and WHEREAS, in order to settle the lawsuit, the parties have agreed to include additional provisions regarding subleasing the Leased Land. NOW THEREFORE, Lessor and Lessee, acting herein by and through their duly authorized representatives, for and in consideration of the covenants and agreements to be performed, and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, enter into the following agreement, which amends Section VI of the Lease by the addition of Paragraph VI. E as follows: E. Lessee shall provide Lessor the tenant's name and billing information for city utility bills on each occasion the property is sublet. The Lessee agrees that the change from Lessee to Lessee's tenant on city utility bills shall take effect only when the Lessee notifies Lessor in writing of the sublease of the property. The failure of the Lessee to notify the Lessor of the sublease shall result in the Lessee being responsible for the utility bills incurred for the Leased Land. Lessee shall send Lessor notice of any subleases of the Leased Land to the following address: City of Fort Worth Real Property Services Division 1000 Throckmorton Fort Worth, Texas 76102 , W001H, TEX. Except as amended by this Second Amendment, all of the terms and conditions of the Lease are ratified and remain in full force and effect. J EXECUTED as of the Q�o day of L 2005.
