HomeMy WebLinkAboutOrdinance 21414-09-2014 Ordinance No. 21414-09-2014 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $825,825.00, SUBJECT TO RECEIPT OF FUNDS FROM THE UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT,FOR THE PURPOSE OF FUNDING A FAIR HOUSING ASSISTANCE PROGRAM; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2014-2015 in the Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $825,825.00, subject to receipt of funds from the United States Department of Housing and Urban Development, for the purpose of funding a Fair Housing Assistance Program. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way I impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. j That this ordinance shall be incorporated into the ordinance effecting the budget of the municipal government of the City of Fort Worth for the ensuing Fiscal Year beginning October 1, 2014, and ending September 30,2015, and cumulative of all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the execution of a Fair Housing Assistance Program Cooperative Agreement through the Fort Worth Human Relations Commission with the United States Department of Housing and Urban I Development for Fiscal Year 2015 and accept funds in the amount up to $825,825.00 for a contractual award in the amount up to $810,825.00, plus current and future accrued interest from contractual award funds in the amount up to $15,000.00; and ' 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund in the amount up to $825,825.00. i DISCUSSION: On July 22, 2014, the Fort Worth Human Relations Commission voted to recommend the approval of the Fair Housing Assistance Program (FHAP) Cooperative Agreement with the United States Department of i t Housing and Urban Development (HUD). Pursuant to a Cooperative Agreement, HUD will provide funding i to the Fort Worth Human Relations Commission, a designated FHAP, based on the number of fair housing complaints resolved from July 1, 2013 to June 30, 2014. The Human Relations Unit staff, on behalf of the i Fort Worth Human Relations Commission, resolved 246 complaints.during this time period. Additional funds are awarded to qualifying FHAP agencies for administrative costs and training. The Cooperative Agreement provides payment for the following: a. Resolution of housing discrimination complaints in the amount up to $639,000.00; i b. Administrative costs in the amount of$149,325.00 (20 percent of the Fiscal Year 2014 Agreement which was $746,623.00); i c. Training funds in the amount of$22,500.00 for mandatory HUD training; and d. Current and future accrued interest in the amount up to $15,000.00.
