AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE SPECIAL TRUST FUND, MUNICIPAL COURT
BUILDING SECURITY,PROJECT, IN THE AMOUNT OF $239,408.00, FROM
AVAILABLE FUNDS,FOR THE PURPOSE OF TRANSFERRING THIS AMOUNT TO
THE GENERAL FUND FOR REIMBURSEMENT OF FY2014 BUILDING SECURITY
EXPENSES; PROVIDING FOR A SEVERABIL.ITY CLAUSE; MAKING THIS
ORDINANCE CUMULATIVE OF, PRIOR .ORDINANCES; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE
DATE.

SECTION 1.
i
That in addition to those amounts allocated to the various City departments for Fiscal Year 2013-2014 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the
Special Trust Fund, Municipal Court Building Security Project, in the amount of $239,408.00, from
available funds, for the purpose of transferring this,amount to the General Fund for reimbursement of
FY2014 building security expenses.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or .
void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions,'sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 20952-09-2013 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such'other ordinances and appropriations, in which instance said conflicting provisions
of said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Authorize Transfer of Funds from the Special Trust Fund, Juvenile Case Manager and Municipal Court
Building Security Projects to the General Fund for Salary Reimbursement for Student Attendance Court
Support Staff and Fiscal Year 2014 Building Security and Adopt Appropriation Ordinances (ALL COUNCIL
DISTRICTS)
RECOMMENDATION:
It is recommended that the City Council:

1. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Special Trust Fund, Juvenile Case Manager Project in the amount of$194,713.00 from available funds;
2. Authorize the transfer in the amount of $194,713.00 from the Special Trust Fund, Juvenile Case

Manager Project to the General Fund;
i 3. Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations in the
Special Trust Fund, Municipal Court Building Security Project, in the amount of $239,408.00 from
available funds; and
4. Authorize a transfer in the amount of $239,408.00 from the Special Trust Fund, Municipal Court
Building Security Project, to the General Fund.

DISCUSSION:
The Municipal Courts Building Security fund and the Juvenile Case Manager fund are both designated in
the Special Trust Fund.
Under the authority of Article 102.017 of the Texas Code of Criminal Procedure, the governing body of a
municipality, by ordinance, may create a Municipal Court Building Security fund and require a defendant
convicted of a misdemeanor offense in a municipal court to pay a $3.00 security fee as a court cost. On
October 10, 1995, the City Council adopted Ordinance No. 12204, creating the Municipal Courts Building
Security Project Fund. Proceeds from the fund may be used to purchase equipment (such as parcel x-ray
machines and hand-held and walk-through metal detectors), to pay staff costs for personnel providing
security services and to provide continuing education on security issues for court and security personnel.
On June 20, 2000, (M&C G-12942) the City Council authorized implementation of the Municipal Court
Building Security Enhancement Plan. It authorized the use of Municipal Court Building Security Project
funds for staffing dedicated to building security functions. The staffing level has been established at one
Senior Deputy City Marshal and eight Deputy City Marshals. Additionally, the Municipal Court Services

Department continues to review the security needed at the Court buildings.
The transfer in the amount of$239,408.00 from the Special Trust Fund, Municipal Court Building Security
Project, reimburses the General Fund for Fiscal Year 2014 building security expenses related to the nine
Marshal positions.
Furthermore, under the authority of Article 102.0174 of the Texas Code of Criminal Procedure authorizes
a governing body of a municipality to create a Juvenile Case Manager Fund by ordinance and require a
defendant convicted of a misdemeanor offense in a municipal court to pay a specific-use fee not to exceed
$5.00 as a court cost. On August 17, 2010, the City Council adopted Ordinance No. 19274-08-2010,
creating the Juvenile Case Manager Fund. Proceeds from the Juvenile Case Manager Fund may be used
to provide the salaries and benefits of juvenile case managers/support staff employed by the municipal
court, under Article 45.056 of the Texas Code of Criminal Procedure.
The Comprehensive Truancy Intervention Program is a joint effort of the Fort Worth Independent School
District (FWISD), the Tarrant County District Attorney's Office and the Fort Worth Municipal Court Services
Department. The Program is designed to aggressively address the truancy problem and includes various
efforts by FWISD to encourage school attendance.
On July 16, 2013, (M&C C-26345) the City Council authorized execution of an Interlocal Agreement with
the FWISD for operation of the School Attendance Court for the 2014 contract term. Under the terms of
that Agreement, the amount of$194,713.00 has been paid from the Juvenile Case Manager Fund to cover
the salary and part of the benefit costs of three juvenile case manager/clerk positions (the remaining
benefit and salary costs are included in FWISD's reimbursement amount).

FISCAL INFORMATION /CERTIFICATION:
jThe Financial Management Services Director certifies that upon approval of the above recommendations
and adoption of the attached appropriation ordinance, funds will be available in the current Operating
Budget, as appropriated, of the Special Trust Fund, Juvenile Case Manager and Municipal Court Security
Projects.
