PRIOR ORDINANCES; REPEALING ALL ORDINANCES AND PROVISIONS OF THE FORT WORTH CITY CODE IN CONFLICT HEREWITH; PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVI ING AN } EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: i SECTION 1. That Section 35-56(a) of Chapter 35 of the Code of the City of Fort Worth (1986), as amended, is hereby amended to add the following definition in alphabetical order: The super user customer class shall consist of those customers which have a minimum annual usage of water of thirty (30) million cubic feet served by a sin�le water meter. A I super user shall not use more or less than fifty percent (5,0%) of it average monthly usage in any month. SECTION 2. That Section 35-56(b) of Chapter 35 of the Code of the City of Fort Worth (1986), as I amended, is hereby amended to read as follows: (b) The following schedule of rates per month, or fraction thereof, shall be the charges to all residential and nonresidential customers for fixiiishing water to such customers located within the city. The residential monthly volume charge for I water service shall be the charges to the residential class, is defined in this chapter, for furnishing water to residential water customers ocated within the city. SECTION 3. That the monthly wastewater volume rates as described in Secti in 35-56(c)(2) of Chapter 35 of the Code of the City of Fort Worth (1986), as amended, i3 hereby amended to read as follows: i (2) A monthly volume charge shall also be charged to residential customers in the, amount of three dollars and thirteen cents ($3.13) per one hundred (100) cubic feet of water used, and to nonresidential/non-monit red customers in i Ordinance No.21448-09-2014 Page 3 of 5 i the amount of three dollars and ninety-seven cents ($3.9 ) per one hundred (100) cubic feet of water used, or wastewater produced, a$ more specifically set forth hereinafter. The monthly volume charges for residential class customers will be based on the individual customer's average monthly water used ing the preceding winter quarter months of December,, January and February. The volumes used to compute these charges are based on the amount o water used by the residential class customer as measured by a meter. ere no preceding winter quarter average is available from records, the director shall estimate a volume to be used for this monthly volume charge. I I The monthly charges to the nonresidential/non-monitored customers will be l based on total water use as measured by appropriate meters, with the provision that if a customer can prove, to the satisfaction of the director, that a significant portion of the metered water usage does not enter the sanitary j sewers, the customer will be charged for only that vo ume entering the sewers, as determined by a method approved by the directo . e SECTION 4: i That the monthly volume rates for the monitored class as described in Section 35-56(d) I of Chapter 35 of the Code of the City of Fort Worth (1986), as amended, is hereby amended to read as follows: Volume charge, per 100 cubic feet $2.(71 i BOD strength charge,per pound of BOD $0.2668 Suspended solids strength charge per pound of suspended solids $0.1215 i i Dissolved solids strength charge, per pound of dissolved solids (applicable to gas well drillers) $0.0420 Monitoring and pretreatment charge= Total actual cost I The monitoring charge shall consist of all cost for personnel, material and I equipment used to collect and analyze samples from� the customer's wastewater to determine the strength of the wastewater produced and, when appropriate, to inspect pretreatment facilities, to admix ster pretreatment permit systems and to enforce ordinance requirements. Pretreatment requirements primarily affect industries that are subject to 40 CFR,,Part 403, General Pretreatment Regulations. i This schedule shall replace all other charges previously made for industrial waste strength. i Ordinance No.21448-09-2014 Page 4 of 5 I 1 I I 1 i I SECTION 5. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended,, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in ! which event conflicting provisions of such ordinances and such Code are hereby repealed. i SECTION 6. ` I It is hereby declared to be the.intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unco stitutional by the valid judgment or decree of any court of competent jurisdiction, such constitutionality i shall not affect any of the remaining phrases; clauses, sentences, parag aphs and sections of this ordinance, since the same. would have been enacted by the Cit� Council without the incorporation in this ordinance of any such unconstitutional phrase) clause, sentence, paragraph or section. i SECTION 7. DISCUSSION: t Each year the Water Department staff conducts cost of service studies to establish annual operating revenue requirements for retail water and wastewater services. The resulting revenue requirements are shared with the informal Water and Wastewater Retail Rate Structure Stakeholder Group which provides input concerning the City's fair and equitable cost allocation among the retail r to classes. The ! Stakeholder Group is made up of representatives of the residential, commerci I, industrial, super user and j irrigation classes. Staff conducted four meetings with the Stakeholder Group to receive input and feedback I on topics including fixed versus variable revenue recovery for the water and wastewater systems and elimination of the Winter Quarter Average (WQA) cap on residential wastewater billings. The Fiscal Year 2015 cost of service studies identified a need for an increase in retail revenue requirements of 7.37 percent for the water system and 4.87 percent for the wastewater system. The recommended water rates include the second year of a multi-year revenue sta ility plan to increase cost recovery from the fixed water revenues through a small increase in the monthly fixed service charge, and the first year of a similar multi-year plan to improve revenue stability'in wastewater cost recovery. Staff ! also recommends eliminating the WQA cap of 30CCF on residential wastewater billing to align practices with industry norms. This change impacts only 0.7 percent of Fort Worth's retai residential customers and ! will ensure that all customers are billed for the wastewater flows that they gene ate. { To meet the water revenue requirements, Staff recommends increases in the v lume rate and monthly service charges for Residential, Commercial, Industrial, Super User, Irrigation nd Gas Well Driller classes. The primary drivers of the water system rate increase are a 12.02 percent increase in raw water rates paid to the Tarrant Regional Water District, funding for lead-free meters required by new federal regulations, implementation of a new Water Condition Assessment Program to identify and minimize leaks ! within the distribution system, and increases in transfers to other funds within t e City. For wastewater, Staff recommends raising the volume rate and monthly service charges for Residential, Non-Monitored and Monitored classes to generate additional funds to meet op rating revenue requirements. The primary drivers of this rate recommendation are increased tr nsfers to other funds within the City, increases in contractual obligations for wastewater treatment pr rating by the Trinity River 1 Logname: 60RETAIL WATER AND WASTEWATER RATES ORD FY15 Page I of 4 Authority and biosolids treatment and disposal through a third party contractor. i I Finally, Staff is recommending new guidelines for the Super User class to rec gnize customers' conservation efforts. Currently, the guidelines require that Super Users use 40 million cubic feet of water per year from a single meter to qualify for Super User classification. With conservation and increased efficiency in operations, Super User customers are using less water. Staff rec mmends the addition of a new definition in the City Code with a new requirement of 30 million cubic feet 3f usage from a single i meter per year. The other guideline requires that a Super User not use more r less than 50 percent of its average monthly usage in any month.
