AMENDMENT No.2
TO CITY SECRETARY CONTRACT
WHEREAN, the City of Fort Worth (CITY) and Brown & Gay
Engineers, Inc. , (ENGINEER) made and entered into City Secretary
Contract No. 44281, (the CONTRACT) which was authorized by M&C
C-26438 on the 5t' day of March, 2013 in the amount of
$1, 158,764 . 00; and
WHEREAS, the CONTRACT was subsequently revised by
Amendment No. 1 in the amount of $175,805 . 00 which was
authorized by M&C C-26438 on September 17, 2013; and
WHEREAS, the CONTRACT involves engineering services for
the following project:
Northside II 48-inch Water Main, Phase 1, from Heritage
Trace Parkway to Alta Vista Road.
WHEREAS, it has become necessary to execute Amendment
No.2 to the CONTRACT to include an increased scope of work and
revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and
through their duly authorized representatives, enter into the
following agreement, which amends the CONTRACT:

Article I of the CONTRACT is amended to include the
additional engineering services specified in a proposal dated
July 9, 2014, a copy of which is attached hereto and
incorporated herein. The cost to City for the additional design
services to be performed by Engineer totals $301, 462 . 00 .
2 .
Article II of the CONTRACT is amended to provide for an
increase in the fee to be paid to Engineer for all work and
services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall be an
amount of $1, 636,031 . 00 .

Design Services for Northside I148-inch Water Main, Phase 1 from Heritage Trace Parkway

Dear Mr. Sauceda:
As we have worked together to develop the construction documents for the referenced project,
we have identified additional items for the scope of the project. These additional services
include:
• Part 2—Reroute Design
• Keller Hicks Road Sanitary Sewer Extension
Part 2—Reroute Design
This project is critical to the City of Fort Worth's ability to serve the fast-growing northern part
of the City. As a means to expedite project completion, we divided Phase I into two parts. The
proposed Part 1 alignment,which is under construction, is primarily located in existing rights-of-
way and easements, while the proposed Part 2 alignment was contingent on easement negotiation
across long stretches of private property.
The design team has worked diligently together to find a corridor for Part 2 acceptable to the
impacted landowners. Over the last twelve months, two primary alignment options were
proposed and negotiated with the adjacent landowners.
• The initial alignment option developed utilized preliminary development plans that
proposed to align the main long or within planned rights-of-way. This initial alignment
was negotiated and approved by the landowner in late May of 2013. The design team
moved forward with developing 60% construction plans based on the agreed upon
alignment. In late August, the design team was notified by the landowner that the

previously agreed upon alignment was no longer available and requested an alternative
alignment.
• The second alignment option proposed by the landowner and evaluated by the design
team placed the transmission main adjacent to the proposed IH-35 W ROW.
Conversations with TxDOT and their representatives indicated that the final right-of-way
has not been acquired, and they expected the final right-of-way to vary from the proposed
right-of-way identified on the schematics. Because of the risk associated with acquiring
easements along a corridor"in flux",the second alignment option is not viable until the
final IH-35W right-of-way is acquired by TxDOT. Continuing with this option would
significantly delay the project.
The design team developed a third alignment option that aligns Part 2 along Golden Triangle
Boulevard and crosses IH-35W. The transmission main continues to follow Golden Triangle
Boulevard right-of-way until the intersection with Harmon Road. Turning south,the
transmission main remains inside the Harmon Road right-of-way and ties into the 36-inch water
main at the intersection of Heritage Trace Pkwy. A stub out connection is proposed for a future
connection to Northside II, Phase 1. This alignment provides greater schedule certainty and
significantly reduces the risk of future relocation.
Because preliminary plans were developed based on the initial alignment option, all survey funds
and the majority of preliminary design funds for Part 2 have been expended. To complete the
redesign required for the Part 2 realignment,the following additional design services are
proposed.
• Approximately 14,000 linear feet of topographic survey within various right-of-ways.
• Level "A" Subsurface Utility Engineering(SUE) of critical utilities crossing the
alignment.
• Design of 15,400 linear feet of 48-inch water main with contract documents.
The additional proposed fee for this revised work is $260,117 and is summarized in the
following table.

Keller Hicks Road Sanitary Sewer Extension
During a public meeting to discuss the construction of Part I with the nearby residence several
City of Fort Worth property owners along Keller Hicks Rd between Old Denton Rd and Misty
Run expressed the desire to connect to the city sewer system. BGE was asked to provide a fee
for the design of a sanitary sewer line to the properties along this reach and prepare necessary
change order documents to be included in the Part 1 construction contract. Design services for
the additional sewer line include:
• survey of existing septic system clean out locations.
• design of approximately 2,200 linear feet of 8-inch sewer line.
• contract modifications to incorporate sewer line design into Part 1 construction.
The proposed fee for this work is $41,345 and is summarized in the following table.

In accordance with our contract,Article V, Section K of the STANDARD AGREEMENT FOR
ENGINEERING RELATED DEISIGN SERVICES, Brown& Gay Engineers, Inc.,requests an
equitable adjustment to our contract to account for the additional cost required to perform the
City's requested additional services.
The proposed man hour breakdown for the additional services is attached. The proposed
$341,172 for these services was determined based on the time estimated to complete at the
hourly rates established in negotiated total budget outlined in Exhibit B-1. This includes $88,250
for MBE/SBE sub consultants resulting in approximately 25.9% MBE/SBE participation for this
amendment. The breakdown of the proposed fee for additional services is as follows:
$ 64,800—Gorrondona&Associates Inc. (Surveying)
$ 23,450—The Rios Group (Subsurface Utility Exploration)
$ 2,500—V&A Consulting Engineers, Inc. (Cathodic Protection)
$ 210,712—Brown& Gay Engineers (Project Management&Engineering)
This proposed amendment increases the total contract amount summarized below:

for a Total Revised Contract in the Amount of$1,636,031.00 for Northside 11 48-Inch Water
Main, Phase I, from Heritage Trace Parkway to Alta Vista Road (COUNCIL DISTRICT 2)
RECOMMENDATION:
It is recommended that the City Council authorize the execution of Amendment No. 2 to City
Secretary Contract No. 44281, an Engineering Agreement, with Brown & Gay Engineers, Inc., in the
amount of$301,462.00 for the Northside 11 48-inch Water Main, Phase I, from Heritage Trace
Parkway to Alta Vista Road, thereby increasing the contract amount to $1,636,031.00.
DISCUSSION:
On March 5, 2013, Mayor and Council Communication (M&C C-26144) the City Council authorized
an Engineering Agreement with Brown & Gay Engineers, Inc., in the amount of$1,158,764.00 for
Northside II 48-inch Water Main Phase I from Heritage Trace Parkway to Alta Vista Road. The
Agreement was subsequently revised by Amendment No. 1 (M&C C-26438 on September 17, 2013)
in the amount of$175,805.00. In order to expedite construction, the project was divided into two
parts:
Part 1, from Alta Vista Road to Old Denton Road (primarily located in existing right-of-way and
easement) is under construction.
Part 2, from Old Denton Road to Heritage Trace Parkway, which requires easement acquisition
across private property.
The City has been negotiating for a water line easement from the majority property owner adjacent to
the original Part 2 alignment. Due to potential conflicts with the 1-35 expansion and to avoid other
utility conflicts the City determined that this alignment needs to be revised. In order to avoid further
delay on the project, it is necessary to revise the original alignment proposed for Part 2.
Amendment No. 2 will provide for the following additional services:
Design and survey for the new alignment for Part 2
Subsurface utility engineering
Cathodic protection
Design and survey to provide sanitary sewer service to residents who were previously annexed on
Keller Hicks Road (Old Denton Road to Misty Run)
Brown & Gay Engineers, Inc., proposes to perform the necessary design work for a lump sum fee of
$301,462.00. Staff considers this fee to be fair and reasonable for the scope of services proposed.
M/WBE Office- Brown & Gay Engineers, Inc., is in compliance with the City' s BIDE Ordinance by
committing to 29 percent SBE participation on this Amendment No. 2. The City' s goal on this
amendment is 12 percent.
The project is located in COUNCIL DISTRICT 2, Mapsco 21 Q, 21 L, 21 M and 22J.
