BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2008-2009 there shall also be increased estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $585 550 50 and the Sewer Capital Projects Fund in the amount of $357 509 00 from available funds, for the purpose of authorizing a contract with BurnsCo Construction, Inc. for water and sanitary sewer main replacements on Edwards Ranch Road, Phase II SECTION 2 That should any portion, section or part of a section of this ordinance be declared invalid inoperative or void for any reason by a court of competent jurisdiction such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect: SECTION 3 That this ordinance shall be cumulative of Ordinance No 18283 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed SECTION 4 This ordinance shall take effect upon adoption TO FOR~~ND LEGALITY City ADOPTED AND EFFECTIVE. Tuesday May 19 2009 REFERENCE NO C-23538 LOG NAME 60EDWARDSPHASE2-BURNSCO SUBJECT Authorize a Contract in the Amount of $483 579 50 with BurnsCo Construction Inc. for Water and Sanitary Sewer Main Construction on Edwards Ranch Road Phase II Accept $87 659 32 from Edwards Geren Limited for Additional Sewer Capacity and Adopt Appropriation Ordinance RECOMMENDATION It is recommended that the City Council 1 Authorize acceptance of funds from Edwards Geren Limited in the amount of $87 659 32 for additional sewer capacity associated with Edwards Ranch Road Phase II 2 Authorize the transfer of $943 059 50 from the Water and Sewer Fund to the Water Capital Projects Fund in the amount of $585 550 50 and Sewer Capital Projects Fund in the amount of $357 509 00 3 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Projects Fund by $585 550 50 ($275 768 00 Phase I and $309 782.50 Phase II) and Sewer Capital Projects Fund in the amount of $357 509 00 ($124,212 00 Phase I and $145 637 68 Phase 11) and 4 Authorize the City Manager to execute a contract with BurnsCo Construction Inc in the amount of $483 579 50 for water and sanitary sewer main construction on Edwards Ranch Road Phase II DISCUSSION On December 7 2004 (M&C C-20437 as amended on April 26 2005 M&C C-20685) the City of Fort Worth (City) authorized an Infrastructure Development Agreement (Agreement) with Edwards Geren Limited (EGL) which required the City to fund and construct certain infrastructure related to the development of Southwest Parkway These infrastructure improvements provide for water sewer paving and drainage improvements on the Edwards Ranch development. As part of the Agreement with EGL, the City escrowed funds to ensure adequate funding was available Edwards Ranch Phase 1 a Community Facilities Agreement (City Secretary No 36109) was executed on November 13 2007 for the construction. of water and sewer improvements The total amount of this contract was $399 980 00 (Water $275 768 00 and Sewer $124 212 00}. Construction of Edwards Ranch Road Phase I was completed on October 27 2008 and these funds have been withdrawn from the escrow account for payment. The appropriation for the.funding of Edwards Ranch Road Phase I is included in Recommendation No 3 Edwards Ranch Road Phase II provides for the construction of an eight inch and 10 inch sanitary sewer main A provision of the Community Facilities Agreement allows for EGL to fund certain improvements enhancements or upsizing as may be required by EGL for the development of the property EGL has Logname 60EDWARDSPHASE2 BURNSCO Page 1 of 3 requested and agreed to pay for additional sewer capacity construction in the amount of $87 659 32 and staff has verified these funds have been deposited into the escrow account by EGL. BurnsCo Construction Inc identified several subcontracting and supplier opportunities However the M/WBEs contacted in the areas identified did not submit the lowest bids The City's goal on this project is 22 percent.
