AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND I
APPROPRIATIONS IN THE INDICATED FUNDS IN THE AMOUNT OF
$1,817,050.66, DECREASING THE UNAUDITED AVAILABLE CASH OR
AVAILABLE FUND BALANCE, AS INDICATED BELOW, BY THE SAME
AMOUNT, FOR THE PURPOSE OF REIMBURSING THE JUSTICE ASSET
FORFEITURE FUND, TREASURY ASSET FORFEITURE FUND AND HIDTA ASSET

FORFEITURE FUND ACCORDING TO THE AMENDMENTS TO THE FY2009,
FY2010 AND FY2011 EQUITABLE SHARING AGREEMENT AND CERTIFICATION
FORMS; PROVIDING FOR A SEVERABII,ITY CLAUSE; MAKING THIS
ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE
DATE.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,

SECTION 1.

That in addition to those amounts allocated to the various City departments for Fiscal Year 2013-2014 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the
General Fund in the amount of$733,710.25, decreasing the unaudited, assigned fund balance by the same
amount and the State Asset Forfeiture Fund in the amount of $1,083,340.41, decreasing the unaudited,
assigned fund balance by the same amount; for the purpose of reimbursing the Justice Asset Forfeiture
Fund, Treasury Asset Forfeiture Fund and HIDTA Asset Forfeiture Fund according to the amendments to
the FY2009,FY2010 and FY2011 Equitable Sharing Agreement and Certification Forms.

SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or
void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining j
provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 20952-09-2013 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions
of said prior ordinances and appropriations are hereby expressly repealed.

This ordinance shall take effect upon adoption.

Adopt Supplemental Appropriation Ordinance Increasing Appropriations in the General Fund and the State
Asset Forfeiture Fund, Authorize Transfer in the Amount of$733,710.25 from the General Fund,
$1,083,340.41 from the State Asset Forfeiture Fund and $9,344.78 from the Crime Control and Prevention
District Fund to the Treasury Asset Forfeiture Fund, the Justice Asset Forfeiture Fund and the HIDTA Asset
Forfeiture Fund for Compliance with the Approved Equitable Sharing Agreement and Certification Forms
for the Police Department, and Adopt Appropriation Ordinance Increasing Estimated Receipts and
Appropriations in the Justice Asset Forfeiture Fund, the Treasury Asset Forfeiture Fund, and the HIDTA
Asset Forfeiture Fund (ALL COUNCIL DISTRICTS)

RECOMMENDATION:
It is recommended that the City Council:
i
1. Adopt the attached supplemental appropriation ordinance increasing appropriations by the indicated
amounts in the following funds:
i
a. General Fund in the amount of$733,710.25 and decreasing the unaudited, assigned fund balance j
by the same amount; and
i
b. State Asset Forfeiture Fund in the amount of$1,083,340.41 and decreasing the unaudited,
assigned fund balance by the same amount.
2. Authorize a transfer in the amount of$733,710.25 from the General Fund, $1,083,340.41 from the
State Asset Forfeiture Fund and $9,344.78 from the Crime Control and Prevention District Fund to the
Treasury Asset Forfeiture Fund, the Federal Asset Forfeiture Fund and the HIDTA Asset Forfeiture Fund i
as listed below for compliance with the approved Equitable Sharing Agreement and Certification forms:
a. Justice Asset Forfeiture Fund in the amount of$928,293.07;
b. Treasury Asset Forfeiture Fund in the amount of$874,868.42; and
c. HIDTA Asset Forfeiture Fund in the amount of$23,233.95. li
3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations by the
indicated amounts in the following funds, subject to receipt of the transfers:
a. Justice Asset Forfeiture Fund in the amount of$928,293.07;
b. Treasury Asset Forfeiture Fund in the amount of$874,868.42; and

DISCUSSION: '
In late Fiscal Year (FY) 2012, the Fort Worth Police Department (FWPD) reviewed and self-reported
required amendments to the FY 2009, FY 2010 and FY 2011 Equitable Sharing Agreement and
Certification forms (ESAC). Working in conjunction with the Department of Justice and the Department of
Treasury, the ESACs were amended. The FWPD was subsequently provided with a letter placing the
FWPD in compliance. At year end, FWPD staff submitted the applicable adjusting journal entries.
However, the journal entries were not processed as FY 2013 year-end adjusting entries. Instead, the
journal entries were processed for FY 2014. It was discovered that Staff did not have the necessary
appropriation authority to make the corrections in FY 2014. As a result, the entries were reversed from FY
2014 and are presented for consideration by the Mayor and Council on this agenda item.
FISCAL INFORMATION /CERTIFICATION:
The Financial Management Services Director certifies that upon approval of the above recommendations,
funds will be available in the Fiscal Year 2014 operating budget, as appropriated, within the General Fund, {
State Asset Forfeiture Fund, Crime Control and Prevention District Fund, Justice Asset Forfeiture Fund,
Treasury Asset Forfeiture Fund and HIDTA Asset Forfeiture Fund. Upon approval, the assigned fund
balance of the General Fund will exceed the minimum reserve, as outlined in the Financial Management
Policy Statements. F
