L. HANSBOROUGH SURVEY, ABSTRACT NO. 748 AND IN THE PETER HAUGHT SURVEY, ABSTRACT NO. 708, IN THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, AS RECORDED IN THE DEED RECORDS OF TARRANT COUNTY, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; THE RETAINMENT OF EXISTING UTILITY EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That a portion of Country Day Lane, situated in the Walter Houston Survey, Abstract No. 745 and the Jos. L. Hansborough Survey, Abstract No. 748, in the City of Fort Worth, Tarrant County, Texas, as recorded in the deed records of Tarrant County, Texas, and containing approximately 0.781 acres of land more or less, and as more specifically described in Exhibits "A" and `B" attached hereto and incorporated herein by reference be and the same is vacated and extinguished. SECTION 2. That a portions of Bryan Henderson Road situated between Bryant Irvin Road and Country Day Lane and also being in the Peter Haught Survey, Abstract No. 708 and the Jos. L. Hansborough Survey, Abstract No. 748 in the City of Fort Worth, Tarrant County, Texas, and containing 1.035 acre of land more or less, and as more specifically described in Exhibits "C" Country Day Lane and Bryan Henderson Road Vacation VA-14-006 Ordinance No.21466-09-2014 Page 1 of 2 and "D" attached hereto and incorporated herein by reference be and the same is vacated and extinguished. SECTION 3. That the fee to the lands in the above-described vacated alleys and streets are hereby released and shall revert to the adjacent owner as provided by law. SECTION 4. That all existing utility easements shall be retained by the City until such time all utilities located in the easements are relocated at the owner's expense. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 6. That this ordinance shall take effect upon adoption. Adopt the attached ordinance vacating a portion of Country Day Lane and Bryan Henderson Road to replat as private roads and provide better security for Fort Worth Country Day School PAS Holdings, LLC; and 2. Waive any and all purchase fee value of the vacated land in accordance with City Policy, Mayor and Council Communication G-15624. DISCUSSION: Pape-Dawson Engineers, on behalf of PAS Holdings, LLC (Fort Worth Country Day School), has requested the vacation of this portion of Country Day Lane and Bryan Henderson Road to provide better security for Country Day School by privatizing these roadways and relocating the guard shack closer to Southwest Boulevard. The City Plan Commission recommended approval of this request at its meeting on April 23, 2014. An acceptable final plat (FS-14-068) has been received in accordance with the Subdivision Ordinance. The City of Fort Worth (City) originally obtained the above mentioned right-of-way through the platting process. The City does not own any fee interest in the right-of-way or own any property adjacent to the right-of-way and did not expend any City funds to purchase the right-of-way easements. In accordance with the City's Policy regarding street and alley vacation transactions approved by the City Council on March 6, 2007 (M&C G-15624), Staff recommends waiving the fair market value or any portion thereof of purchase price of the right-of-way easements for the streets and alley.
