AMENDMENT No.1 TO CITY SECRETARY CONTRACT No. 45217 WHEREAS, the City of Fort Worth (CITY) and Dunaway Associates, L.P. , (ENGINEER) made and entered into City Secretary Contract No. 45217, (the CONTRACT) which was City Council authorized on the 3 day of December, 2013 in the amount of $ 158, 345 . 00; and WHEREAS, the CONTRACT involves engineering services for the following project: Improvements in Harmon Field Park; and WHEREAS, it has become necessary to execute Amendment No. 1 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated August 26, 2014, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $2, 000 . 00 . (See Attached Funding Breakdown Sheet, Page -3-) 2 . Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $160,345 . 00 . 3 . All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect. EXECUTED and EFFECTIVE as of the date last written by a signatory, below. (Dunaway) will provide professional environmental services for improvements to Harmon Athletic Complex as an addition to the existing contract for Harmon Athletic Complex Improvements. It is Dunaway's understanding that the City of Fort Worth (Client)wishes to engage Dunaway to perform site wetland determination services for one particular area of the project located north of the existing parking lot and west of the Ham Branch Creek. SCOPE OF WORK ENVIRONMENTAL SERVICES A. 404 Waters of the U.S. Determination 1. Dunaway will perform a Jurisdictional Determination based upon a field visit to identify not only the current Waters of the U.S., but also classify them as to their existing function. This determination of their function and values is an important component of the Section 404 permitting process. This determination is necessary for the U.S.Army Corps of Engineers (USACE) to verify the adequacy of any delineations and any required mitigation. Using available literature, the soil survey, and USGS topographic maps, Dunaway will provide a description of the functions and values and limits of the Waters of the U.S. for the subject property. As part of the functions/values determination, Dunaway will provide the client with the appropriate wetland delineation forms, map of jurisdictional waters overlain on the site plan (if existing), and any evaluation of the waters of the U.S. within the proposed project site. The wetland forms will include the vegetation characteristics of the jurisdictional waters, soil profiles, and hydrologic information per the 1987 Corps of Engineers Wetland Delineation Manual and regional supplement. Dunaway will use a Global Positioning System (GPS) to map jurisdictional waters of the U.S. Data collected in the field will be downloaded to existing ArcGIS files to overlay on the existing topographic maps for the project. Exhibits indicating all jurisdictional waters of the U.S. will be prepared for inclusion in the wetland survey report. 2. Dunaway will prepare a letter report describing the limits and types of waters of the U.S. found within the project site. The report will contain descriptions of waters of the U.S. and site maps with waters shown. 1 It should be noted that this exercise does not include any permitting activity with the USACE, it simply identifies the function or type, their classification or value, and the quantity of all Waters of the U.S. regardless of type. This will provide the client with guidance on both future permitting and development constraints or strategies as they relate to the Waters of the U.S. FEE Dunaway Associates, L.P. proposes to provide the above described scope of work for a LUMP SUM fee of$2,000.00 including professional fees and normal expenses. Itemized Fee • 404 Waters of the U.S. Determination $2,000.00 Schedule Dunaway anticipates receiving the approved contract amendment and Notice to Proceed (NTP) by September 5,2014. DISCUSSION: The purpose of this Mayor and Council Communication is to authorize the execution of an Engineering Agreement with Dunaway Associates, L.P.,in the amount of$158,345.00 to reassess the current master plan,design and prepare construction documents for park improvements in Harmon Field Park. Staff considers this fee to be fair and reasonable for the scope of services proposed. Improvements will include construction of new competition soccer fields,restoration of competition baseball field,expansion of existing parking lot,new playground,group pavilion areas and other park improvements. Project funding for both design and construction is comprised as follows: Temp Park 2004 CIP Gas Bonus Workspace Donation 2013 CO's Total Agreement Harmon Field 1$528,500.00 $626,105.58 $125,143.37 $18,000.00$300,000.00 $1,597,748.95 Park Parks, Recreation and Community Services Improvements of the 2004 Capital Improvement Program (CIP)allocated the amount of$21,615,000.00 for park improvements at various park sites throughout the City. Funding for athletic fields and ball field lighting systems was included within the park improvements allocation for Harmon Field Park. As the result of the Trinity River Vision Project,the design and construction of the Harmon Field Park improvements required postponement to allow incorporation of the more significant Trinity River Vision Project design elements and to avoid reconstructing newly constructed improvements. This tactical management delay also enabled additional allocations from gas well lease bonus, License Agreements, mitigation fees and Certificates of Obligation funds to be realized and incorporated into the project-enabling a significantly broader scope of improvements. Remaining funds from the the 2004 CIP total the amount of$450,973.52. On May 1,2012, (M&C G-17586)the City Council authorized the appropriation of gas lease bonus funds totaling the amount of$2,491,107.49 in conjunction with the Parks and Community Services Department's Fiscal Year 2012 Gas Related Revenue Project Expenditure Plan. As part of this appropriation,the amount of$626,105.58 in gas bonus funds were allocated for Harmon Field Park. On May 1,2012, (M&C L-15360)the City Council authorized the acceptance of a donation from Texas Midstream Gas Services, L.L.C.,in the amount of$18,000.00 and authorized the execution of a 90 day temporary access and workspace Agreement with Texas Midstream Gas Services, L.L.P. Mitigation fees in the amount of$125,143.37 were received for the access drive and temporary workspace. On August 20,2013,(M&C G-17980)the City Council approved an ordinance authorizing the sale of Series 2013A Certificates of Obligation,of which a portion was earmarked for funding of various park projects totaling$5,350,000.00. M/WBE OFFICE: Dunaway Associates, L.P., is in compliance with the City M/WBE Ordinance by committing 25 percent M/WBE participation. The City's goal on this project was 25 percent. Harmon Field Park is located in COUNCIL DISTRICT 8,Mapsco 63X,63Y,77B and 77C.
