(No M&C needed) COUNTY OF TARRANT § WHEREAS, the City of Fort Worth (City) and Freese and Nichols, Inc., (Engineer) made and entered into City Secretary Contract No. 28468 (the Contract) which was authorized by the City Council by M&C C-19434 on the 21th day of January, 2003; and WHEREAS, the Contract involves engineering services for the following project: Construction Administration and Inspection of West Cargo Taxiway Improvements at Alliance Airport WHEREAS, it has become necessary to execute Amendment No. 1 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated September 12, 2003 a copy of which is attached hereto and incorporated herein. The cost to City for the additional services to be performed by Engineer total $23,180. 2. Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of$351,868. 3. This increase is a result of expenses associated with filing preliminary plat, final plat and zoning data with the City of Haslet. As you will recall, after this project commenced it was discovered that the above platting and zoning issues were overlooked in the preparation of construction bid documents. The land for this project, although airport property, lies within the City of Haslet. Freese & Nichols at our direction filed the necessary documentation for preliminary plat, final plat and zoning. In order to expedite the work and prevent a work stoppage by the City of Haslet, Freese & Nichols hired the firm of Carter & Burgess to complete this work, since Carter & Burgess was familiar with City of Haslet procedures. With the cooperation of the City of Haslet and the immediate attention to the matter by Freese & Nichols the project continued without interruption. The request for this fee adjustment is justified and I recommend the contract be amended accordingly. FAA was made aware of the platting and zoning issue when it was discovered and will participate in the fee adjustment. The fee increase is for Platting and Zoning requirements for the City of Haslet. As you know, it was brought to our attention recently that the portion of the West Cargo Apron and Taxiways at Alliance Airport located west of the existing AOA fence is actually within the City of Haslet. This made it necessary to file preliminary plat, final plat and zoning data with the City of Haslet. We had no knowledge about the development being primarily within the City Limits of Haslet. According to the Mapsco Map, the Haslet City Limit appears to be west of Harmon Road, a copy is attached. Further, the property map provided by the owner does not distinguish between Fort Worth and Haslet. Referencing the attached document, the Point of Beginning is described to be within the City of Fort Worth. Freese and Nichols, Inc. retained the services of Carter and Burgess to develop the plats and zoning data for this development. Their cost data is attached for your information. We made presentation to the City of Haslet Planning and Zoning Committee as well addressing the City Council regarding the cargo apron development. In addition to the time for developing the plat and meeting with the City of Haslet, we paid fees associated with the platting and zoning as required by the city. Our request fee increase is summarized on the attached spreadsheet and amounts to $23,180. The fee includes all effort for plats and zoning documents, City of Haslet submittal fees and associated expenses. It is our understanding that Article V, Paragraph C of the contract states that the City of Fort Worth will pay for these services. This page from the contract is provided for your reference. It his opinion that the contractor took reasonable precaution to protect the panels, but the intensity of the storm and the quickness in which it generated did not allow for protection to be put in place. we have discussed this matter with Rick Compton of FAA and he has indicated a willingness to participate in a change order to have these panels removed and replaced subject to receipt of the explanation from the engineer, that the circumstance could not have been avoided. In addition, to the above, there are other panels that will need to be replaced by the contractor at his expense. These panels are located adjacent to Runway 16R/34L at Taxiway C and D and throughout the cargo apron area. The panels located adjacent to the runway were not constructed with the proper joint, while the panels on the cargo apron have mid-panel shrinkage cracks.
