COUNTY OF TARRANT §
WHEREAS, the City of Fort Worth (City) and Freese and Nichols, Inc., (Engineer)
made and entered into City Secretary Contract No. 30817, (the Contract) which was
authorized by the City Council by M&C C-20145 on the 6th day of July, 2004; and
WHEREAS, the Contract involves engineering services for the following project:
Operational Assessment and Alternative Evaluations for the Active Pool of the
Fort Worth Water Gardens.
WHEREAS, it has become necessary to execute Amendment No. 2 to said
Contract to include an increased scope of work and revised maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and through their duly
authorized representatives, enter into the following agreement, which amends the
Contract:

Article I, of the Contract is amended to include the additional engineering services
specified in M&C C-20442, adopted by the City Council on the 14th day of December,
2004, and further specified in Attachment A-3, both of which are attached hereto and
incorporated herein. The cost to City for the additional services to be performed by
Engineer total $179,930.00.
2.
Article II, of the Contract is amended to provide for an increase in the maximum fee
to be paid to Engineer for all work and services performed under the Contract, as
amended, so that the total fee paid by the City for all work and services shall not exceed
the sum of $ 493,376.00.
3.
All other provisions of the Contract, which are not expressly amended herein, shall
remain in full force and effect.

GENERAL SCOPE OF SERVICES
AMENDMENT TO
AGREEMENT FOR ENGINEERING SERVICES
BETWEEN
THE CITY OF FORT WORTH AND FREESE AND NICHOLS, INC. FOR
OPERATIONAL ASSESSMENT AND ALTERNATIVE EVALUATIONS FOR
THE ACTIVE POOL AREA OF THE FORT WORTH WATER GARDENS
ADDITIONAL SERVICES
FOR
CONCEPTUAL AND DETAILED ENGINEERING DESIGN FOR
MODIFICATION/REHABILITATION OF PUMP ROOM #2 AND
SITE AND EFFECTS LIGHTING SYSTEMS
SECTION 1 —INTRODUCTION
This amendment is for additional services related to the evaluation, conceptual design and detail
design for rehabilitation of the mechanical equipment in Pump Room#2,and for the site,effects and
security lighting facilities throughout the Water Gardens. As the evaluation of the Active Pool area
of the Water Gardens progressed under the original scope of work, it became known that major
rehabilitation work was also required at Pump Room#2. The mechanical equipment and electrical
switch gear is either failed or near the end of its service life and much of the system is not functional.
Rehabilitation/modification of both Pump Room #1 and Pump Room #2 should be coordinated to
use similar pumping, filtration and chemical feed equipment in order to simplify operations and
maintenance.
It has also been determined that much of the original site and effects lighting is no longer functional
due to damaged fixtures, electrical conduit and conductors. The pole mounted lighting does not
provide adequate light intensity levels in many areas of the Water Gardens for pedestrian safety or
security. An overall plan for rehabilitation or replacement of the site and effects lighting is required.
SECTION 2 —ADDITIONAL SERVICES
This section describes the additional services FNI will provide relative to the
modification/rehabilitation of Pump Room#2 and the Site and Effects Lighting Systems.
A. CONCEPTUAL DESIGN PHASE
1. Pump Room #2
a. Perform a detailed review of Pump Room#2 with City Staff,including Parks and
Community Services, Water Department and Risk Management Office. The
purpose of the site review is to review the current condition of the facilities and

to discuss potential options for improved maintenance, access and employee
safety.
b. Develop a list of potential facility modifications.
c. Develop opinion of probable project costs for potential facility modifications.
d. Develop prioritization criteria and prioritize the potential modifications.
e. Conduct a review meeting with City Staff to discuss the potential modifications
and develop a phased program for rehabilitation of Pump Room 42.
f. Incorporate the alternative evaluation and recommendations for renewal of Pump
Room #2 in the draft and final report.
2. Site and Effects Lighting Systems
a. Perform a detailed review of the Site and Effects Lighting Systems with City
Staff. The purpose of the site review is to review the current condition of the
facilities,determine which lighting system components are functional and make
measurements of light intensity levels at various locations in the Water Gardens
where lights are still functional.
b. Conduct a project review meeting to discuss the City's desired objectives for the
site lighting (security, pedestrian travel, use of park at night, special events
lighting, etc.)
c. Develop alternative conceptual plans (up to three) for site lighting (mounting
alternatives, fixtures, layout plans).
d. Develop opinion of probable project costs for alternative conceptual designs(up
to three).
e. Develop prioritization criteria and prioritize the potential modifications.
f. Conduct a review meeting with City Staff to discuss the potential modifications
and develop a phased program for modifications to the lighting systems.
g. Incorporate the alternative evaluation and recommendations for modification of
the Site and Effects Lighting Systems the draft and final report.
B. DESIGN,BID AND CONSTRUCTION PHASE SERVICES FOR IMPLEMENTATION
OF SELECTED ALTERNATIVE
1. Design Phase—Pump Room#2
a. Prepare engineering drawings and specifications for construction of the selected
modification alternatives for Pump Room#2. Anticipated improvements include
the following:
i. Motor control center(MCC)
ii. Water filtration equipment
iii. Sump pumps
iv. Level sensors
V. Equipment controls (programmable controller)
vi. Alarm system, automatic dialer and remote equipment disable switch.
b. Prepare revised opinion of probable construction cost for modifications of
Pump Room#2.

c. Incorporate work items related to Pump Room 42 into bidder's proposal
forms (project quantities) for the improvements to be constructed.
2. Design Phase— Site and Effects Lighting Systems
a. Prepare engineering drawings and specifications for construction of the
selected modification alternatives for the Site and Effects Lighting Systems,
including demolition plans, electrical one-line diagrams, lighting layout
plans,lighting panel schedules,power supply plans,control circuit diagrams,
installation details, concrete cut and replace details.
b. Prepare revised opinion of probable construction cost for modifications of
Pump Room #2.
c. Incorporate work items related to Pump Room #2 into bidder's proposal
forms (project quantities) for the improvements to be constructed.
3. BID OR NEGOTIATION PHASE
No Changes to Bid/Negotiation Phase Services
4. CONSTRUCTION PHASE
The services described in Section 3,paragraphs (a)through(n)shall be modified to include
work associated with Pump Room#2 and the Lighting Systems.
C. OPERATING PROCEDURES MANUAL
1. Prepare draft and final Operating Procedures Manual for Pump Room #2.
2. Prepare training materials and quick reference materials (wall mounted diagrams and
instructions)for Pump Room#2.

Authorize Second Amendment to City Secretary Contract No. 30187, Agreement for an Operational
Assessment and Alternative Evaluation for the Active Pool of the Fort Worth Water Gardens and
Adopt Appropriation Ordinances
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Capital Projects Reserve Fund by $179,930 from available funds;
2. Authorize the transfer of $179,930 from the Capital Projects Reserve Fund to the Specially Funded
Capital Projects fund;
3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Specially Funded Capital Project Fund by $179,930; and
4. Authorize the City Manager to execute an amendment to City Secretary Contract No. 30187 with Freese
and Nichols, Inc. (FNI) not to exceed $179,930 for additional services to evaluate and plan the replacement
and enhancement of the lighting and electrical systems and plumbing facilities related to pump room #2.
DISCUSSION:
On July 6, 2004, in M&C C-20145, the City Council authorized the City Manager to execute an agreement
with FNI for the operational assessment and alternative evaluation for the Active Pool of the Fort Worth
Water Gardens. The first contract amendment provide for preliminary design, engineering and architectural
analysis to determine modifications that best address the needs to enhance safety, improve maintenance,
preserve the aesthetic, quality and reduce costs.
As City staff continued to evaluate the Water Gardens, malfunctions have been identified in the electrical
system throughout the gardens and the mechanical and plumbing systems in pump room #2. FNI has
agreed to alter the scope to include the following additions:
1. Evaluation of the electrical and lighting system for the entire Water Garden;
2. Evaluation of the plumbing and mechanical systems in pump room #2; and
3. Prepare preliminary engineering solutions and cost estimates for pump room #2.
City staff anticipates completion of this additional scope of work by January...__.2QQ5- _and the
recommendations will be included in the City Manager's complete report on the Water Caardens.,
FNI is in compliance with the City's M/WBE ordinance by committing to 14% M/WBE ' artipJpatkon__on-,this
contract amendment.
The Fort Worth Water Gardens is located in Council District 9 and serves the entire city.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that upon approval of the above recommendations and adoption of the
attached appropriation ordinance, funds will be available in the current capital budget, as appropriated in
the Specially Fund Capital Projects Fund.
The cash balance of the Capital Projects Reserve Fund after the transfer will be $2,210,437.
