HomeMy WebLinkAboutOrdinance 18715-07-2009Ordinance No 18715-07 2009 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER CAP{TAL PROJECTS FUND IN THE AMOUNT OF $25133 00 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING PAVEMENT RECONSTRUCTION AND WATER MAIN REPLACEMENTS ON PORTIONS OF NORTHWEST 22ND STREET AND NORTHWEST 23RD STREET (PROJECT NUMBER 00289) PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2008-2009 there shall also be increased appropriations in the Water Capital Projects Fund in the amount of $25 133 00 from available funds, for the ~urpose of funding pavement reconstruction and water main replacements on portions of Northwest 22" Street and Northwest 23`~ Street (Project Number 00289). SECTION 2 That should any portion, section or part of a section of this ordinance be declared invalid inoperative or void for any reason by a court of competent jurisdiction such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No 18283 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. No. 18715-07-2009 ~.- DATE Tuesday July 14 2009 REFERENCE NO C-23649 LOG NAME 20001NW22NDSTREET SUBJECT Authorize Change Order No 1 in the Amount of $114 315 65 to City Secretary Contract No 35376 with McClendon Construction Company lnc. for Pavement Reconstruction and Water Main Replacements on Portions of Northwest 22nd Street and Northwest 23rd Street and Adopt Appropriation Ordinance RECOMMENDATION It is recommended that the City Council 1 Authorize the transfer of $25 133 00 from the Water and Sewer Operating Fund to the Water Capital Projects Fund 2 Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $25 133 00 from available funds and 3 Authorize the City Manager to execute Change Order No 1 in the amount of $114 315 65 to City Secretary Contract No 35376 with McClendon Construction Company Inc. thereby revising the total cost to $1 118 638 30 DISCUSSION The 2004 Capital Improvement Program (CIP) includes funds for neighborhood streets pavement reconstruction On May 22 2007 (M&C C-22126) City Council authorized the award of Contract to McClendon Construction Company Inc. for the subject project. The project consists of pavement reconstruction and water and sanitary sewer replacement on portions of Northwest 22nd Street and Northwest 23rd Street. Northwest 22nd Street Ellis Avenue to Lee Avenue Northwest 22nd Street Prospect Avenue to Lincoln Avenue Northwest 22nd Street Pearl Avenue to Chestnut Avenue Northwest 23rd Street Ellis Avenue to Clinton Avenue This change order will provide for retaining walls silicone pavement joint sealant, concrete pavement and cast iron fittings that are necessary to complete the project.
