HomeMy WebLinkAboutOrdinance 21471-09-2014 Ordinance No.21471-09-2014 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN AN AMOUNT UP TO $51,778.75, SUBJECT TO RECEIPT OF A GRANT FROM THE UNITED STATES DRUG ENFORCEMENT ADMINISTRATION FOR PARTICIPATION IN THE NORTH TEXAS HIGH INTENSITY DRUG TRAFFICKING AREA REGIONAL INELLIGENCE SUPPORT CENTER, FOR THE PURPOSE OF REIMBURSING THE FORT WORTH POLICE DEPARTMENT FOR OVERTIME COSTS RELATED TO THE DEPARTMENT'S PARTICIPATION IN THE NORTH TEXAS HIGH INTENSITY DRUG TRAFFICKING AREA REGIONAL INTELLIGENCE SUPPORT CENTER FOR FISCAL YEARS 2013, 2014 AND 2015; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated for Fiscal Years 2013-2015 in the Grants Fund,there shall also be increased estimated receipts and appropriations in the Grants Fund in an amount up to $51,778.75, subject to receipt of a grant from the United States Drug Enforcement Administration, for the purpose of reimbursing the Fort Worth Police Department for overtime costs related to the department's participation in the North Texas High Intensity Drug Trafficking Area Regional Intelligence Support Center for Fiscal Years 2013-2015. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 20952-09-2013 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. DISCUSSION: The City of Fort Worth has been an active participant in the United States Department of Justice, Drug Enforcement Administration's (DEA) High Intensity Drug Trafficking Area task forces since 1999. The mission of the organization is to reduce the volume of narcotics and controlled substances being trafficked into and distributed from the North Texas High Intensity Drug Trafficking Area Regional Intelligence Support Center (NTHIDTA-RISC). The NTHIDTA-RISC seeks to dismantle high-level drug trafficking organizations through intelligence and comprehensive case support of investigations and NTHIDTA-RISC initiatives, identifying the movement of drugs into and out of North Texas. Subject to the availability of funds, the DEA reimburses the City of Fort Worth for the overtime costs of Fort Worth Police Department's participation in the NTHIDTA-RISC. The Fort Worth Police Department had one officer assigned to the NTHIDTA-RISC in Fiscal Years 2013 and 2014 and will assign one officer to NTHIDTA-RISC in Fiscal Year 2015. Initially, these funds were deposited and expended in accounts created for the HIDTA Group 2 Task Force. This Mayor and Council Communication is necessary to adopt an appropriation ordinance to establish separate accounts for the reimbursement of overtime and other expenses such as mileage, supplies, travel and training related to the Department's participation in the NTHIDTA-RISC for Fiscal Years 2013-2015. FISCAL INFORMATION /CERTIFICATION: The Financial Management Services Director certifies that upon adoption of the attached appropriation ordinance funds will be available in the current operating budget, as appropriated, of the Grants Fund. The Police Department is responsible for requesting reimbursements and for the collection of revenues under this Agreement.
