1 . Meeting with Mr. Stuart P. Walsh - 4:00 p .m. lull
Monday, June 7 , 1965
The City Manager reminded the Council of the
Stuart Walsh meeting at 4:00 p.m. Monday in the
Pre-Council Conference Room. Mayor Pro-Tom Jones
said he wanted to be able to discuss the report in
depth but lie was concerned about a possible conflict
of interest because of his investment in land that
might be involved in annexation action or as an
extra-territorial industrial district. lie said that
the City Attorney had ruled previously that no
con? lice of interest was involved. Mr. Jones. said
`hat the City Manager had furnished Mayor Pro-Tem
Jones with sample codes of ethics last fall , including; i
one published by ICMA, which Mr. Jones considers very
good. Mr. Jones commented the only way to determine
conflicts of interest by councilmen is for the councilmen
themselves to determine it. Mayor Pro-Tom Jones said that
the property is now arranged so lie has no control over it,
but he still desires the Council discuss the matter
of conflicts of interest. Mayor Barr said he felt no
conflict of interest existed in the ,.utter because
Council intended to talk only };eneral. policy with
Mr. Walsh, and not specifics on any land . The Mayor
said the charter provides that the only reason for
not voting is a financial interest , direct or
indirect. Councilman Hamm said that at the Walsh
meeting everyone should be free to discuss all
matters . (Councilman Hoover arrived at this point) „
Councilman Shannon said that the meeting; Monday
afternoon should be wide open for discussion.
2. Proposed Booby-Trap Ordinance GENE - gather supplemental
(MSEC G-804 and I.R. 747) information
The City Manager asked the Council if they had
all the information they wanted on the proposed booby-
trap ordinance. Councilman Hamm asked to be furnished
information on what incidents had occurred with booby-
traps, who was involved, or whether there had been
any experience in the matter of booby-traps . Council-
man Eagle asked that the Council be furnished a

statement from the Police and Fire Departments on
how the proposed ordinance would enhance the
performance of these departments. The Council
asked to hold further consideration of the
proposed ordinance for this information.
3. Requested Traffic Island Revisions JLB - instructed Buckman to
2300 Oakland Blvd . (I,R. 750) contact each property owner
individually.
The Traffic Engineer explained the proposal GENE - follow-up regarding
to construct a 285 foot island in 2300 block contacts.
Oakland Blvd . which would store six cars for left
turn. He explained that the only way to shorten
the island would be to have a three-car capacity
storage , which would reduce the island length only
60 feet, Mr. Buckman explained this could not help
the parties who are protesting construction of the
island because it would block driveway entrances
from left-turn movements .
Councilman Hoover asked if it wasn't illegal
to turn left across oncoming traffic anyway. Mr.
Buckman replied , yes, but the law was not generally
enforced except in cases of accident. Councilman
Hoover asked if Oakland is a high-density street. Mr..
Buckman answered that the street has been torn up for
nearly two years, and it has not been possible to ac-
curately measure density. Councilman Hamm inquired
about the design information on the plat furnished the
Council , and questioned its accuracy. The consensus
of the Council was to make no change in the traffic
island as originally proposed ,
Mayor Barr requested that someone from the staff
be sent out to talk the situation over with the peti-
tioners and explain reasons why it was not desirable
to change the island design.
4. Purchase of Automobile for City Manager-is Office JLB - RUBOTTOM - follow-up on
(M&C P-445) purchase.
The City Manager told the Council he would be
pleased with any decision the Council made on which auto-
mobile to purchase for his office.
Councilman Stovall suggested the Council authorize
purchas of an Oldsmobile, according to the bid . The
City Manager said that would be fine with him. The Council
agreed to authorize purchase of the Oldsmobile..

Councilman Shannon asked about the 9:12 P.M. Monday.
Central Avenue route., He said the elimination of this
route would cause hardship in the area. Councilman
Hamm said he would like to see some new approach made
by the transit company, other than cutting routes and
and cutting fares, Mayor Barr wondered if a little
less scheduling during the day would help hold evening
routes as they are. Councilman Haran asked to hold this
matter one week and see if a readjustment could be made

in the request . The City Manager explained the
Council legally has no authority over scheduling,
on routes , only on discontinuance of routes.
Councilman Hamm asked that the discontinuance
request be held for possible adjustment of the

formal meeting

Gas Company (I.R. 744) to Council by Utilities Supervisor
Referring to I.R. 641 , as revised December 4,
1964, Mayor Pro-Tem Jones asked if it wasn't the
responsibility of the City Utilities Supervisor to DICK - edit report when submitted
continuously examine utility financial matters, and by us next week.
he said that thirty days is required for notice of
hearing on adjustment of rates , for purposes of
studying the request. Mr. Jones mentioned that
lie thought the Council was not required to have a
hearing, or not even have a study made. The City
Attorney advised that the ordinance does not
require the Utilities Supervisor's examination.
Mayor Pro-Tern Jones said he thought the gas
company would have a right to make a rate
adjustment, whether or not the Council called
a hearing. The City Attorney advised that the
Council would not lose any right to hold a
hearing, and it could not delegate such rights
to the Utilities Supervisor or any other party.
Mayor Barr said lie believed the Utilities
Supervisor should always be prepared to give
City Council advice on utility rates . The
Mayor said he wanted more factual information
from the Utilities Supervisor on this matter.
Councilman Hamm indicated he would like to
know the amount of street rental payments to
the City paid by the Gas Company, Councilman
Kemble wanted more information on retail
business other than gas sales done by the
Gas Company. Mayor Barr said he did not
desire a recommendation from the Utilities
Supervisor, but only factual information.
Councilman Hoover asked what street rental
payment the City gets . The City Manager said
a three percent rate (composite) , based on
4 percent of residual and consumer sales .
The Mayor asked what effect a hearing date
would have on the effective increase request
date of July 1. The City Manager reported
that a written report on these matters
could be furnished in two weeks. Councilman
Hamm asked whether an independent Utility
Rate Consultant could be employed, and he
wanted to know what firms are available,

and at what cost to theCity. Councilman
Kemble asked it the Council could turn the
rate increase request down, and then the
company institute other proceedings to
obtain the increase. The City Attorney said
the ordinance contemplated an increase in
rates in the future, that Lhe company is
entitled to a hearing (with sufficient notice
of hearing), that the burden of proof is on
the company, and that Section VII of the
Ordinance governs these matters. Council-
man Hamm asked how binding the decision of
the Council was in the matter. Councilman

by the City Attorney to the Council . Mayor
Pro-Tem Jones asked about the "arbitrary and
capricious" phrase in the ordinance, referring
to the matter of a rate increase request
after only 5 months under a new 25-year
franchise. Councilman Shannon asked if the
Utilities Supervisor had reconunended the
increase. Mayor Barr answered that he had
not made any recommendation.

funeral for Phil Loving imuld be held Tuesday
at 11 :00. Mayor Barr asked that a resolution
of appreciation for Mr. Wviny, 's services he
introduced at the regular Council meeting.
