Councilman Jones commented that 8 accidents on South Drive had occurred near a hill, where speed control seemed Lo be the major factor. The City Manager also pointed out that the major problem on Burton Hill Road seemed to be speed control, and that any action to permit higher speeds would be of ciuuhtful advisability. He repurted earlier difficulties in dealing with Westover Bills property owners regarding Burton Hill Road improvements. 7. Negotiations with Tarrant Utility Company (M&C G-822) NAN In response to a question by Councilman Stovall, the City :tanager listed five major reasons why the City acquires private water systems within corporate limits : 1) City rates are lower - sometimes half that of the private systems; 2) fire protection is hampered by lack of fire hydrants in areas served by private water systems; 3) contamination of private water systems sometimes causes Health problems ; 41) water supply in private systems is sometimes inadequate during periods of heavy usage; and, 5) it is uneconomic for the City to build parallel lines to private water systems where the customers remain divided between the private and City systems. Councilman Stovall also inquired about the right of the private system to be in the street and whether the City had power to regulate the systems, to which the City Manager replied that an opinion of the City Attorney stated that the City had the power to regulate private water companies but such regulation would imply the right of the systems to be in the public right-of-way, which right has not been fully established. Councilman Shannon inquired whether it was incumbent upon the City to purchase the water systems if the citizens in the affected areas had not requested City service. He added that purchase should be analyzed on a dollar and cents basis to determine whether the initial cost and income would justify the City investment. The City Manager replied that acquisitions were being made in accordance with a 1962 Council policy, and that it was a matter of equity to all residents to provide water at the lowest possible cost, provide adequate fire protection, and provide a safe and abundant water supply. Councilmen Hoover and Shannon inquired whether major investment would be made by the City to replace existing lines in the Westland Addition, to which the City Manager replied that the existing lines were in reasonably good condition and that a minimum investment would be necessary by the Water Department at this time. -3- Councilman '3-Councilman Kemble indicated that extension of a dependable water supply would encourage development of the affected areas, provide fire protection and provide water service to Fort Worth citizens in ample quantity for fire protection, and in healthful quantities at a low price. In response to a request by Mayor Barr, each Council Member indicated his preference as fellows: 1. Jones - If the City has determined to buy the water system, it is his opinion that the re- quested price is not exces,:ive. 2. Kemble - In favor of purchase at compromise price. t. Stovall - Requests "hold. " 4. Eagle - Requests 'hold. " 5. Hamm - Requests "hold, " but remarked that it appeared the owners had compromised on the price and that the amount was acceptable. 6. Shannon - Requests "bold. " 7. Hoover - Agrees with principal of acquisition but questioned whether Lite price might not be better at a later time. He was generally in favor of purchase. 8. Deen - Favors acquisition at price quoted. 9. Barr - In favor of acquisition in accordance with previous Council policy. In recognition of several Council Members ' request that the matter be held for one week, the Mayor requested that the item be placed on the Agenda of July 12, 1965. y, Code Amendment Regulating Curb Painting (M&C G-821) AGENDA - July 12 Councilmen Hoover, Stovall, Sh annon, .and Kamm indicated that the ordinance as written was highly restrictive, and requested who had initiated the action. The City Manager replied that the Public Works and Police Departments had had difficulties with unscrupulous workers and poor workmanship in the painting of addresses on curbings. It was the consensus that action on the proposed ordinance be delayed for one week, which action was taken -it the regular meeting. _ `). Information Regarding Water Meters (I.R. 4763 and 764) NAN Councilman Hamm inquired about the number of meters on hand, which information was indicated for him as found on page 3 of I,R. #763.
