Mayor Barr reminded Council Members that several Coun- cil Members had met at 7 :00 a.m. on Monday, April 18 with the Special Zoning Committee, and that no further action had been taken. Councilman Hamm requested that this matter be on the informal agenda for the next meeting. Clean-Up, Paint-Up, Fix-Up Campaign NAN Gene Denton reported that the national Clean-Up, Paint- Up, Fix-Up Campaign is conducted throu,, hout the month of May. He said the local campaign is planned for the first two weeks in May. The local committee plans big billboards this year, letters to all civic groups to conduct neiz;hborhood projects, and other such publicity. He said the City normally suspends rules on tra!Ji pick-up and picks up anything during this clean up period. He said the City tries to cooperate with the Chamber in a joint effort. Councilman Shannon Said he had more in mind a long-range program, to fix many of the blighted and substandard homes in the City. He mentioned that Neosho, Mo. is noted as the flower bux city and has an active campai,.;n_ He said there was a na- tional Clean-Up, Paint-Up, Fix-Up Bureau in Washington with much literature on the subject. He said the City should be divided into 25 or 50 sections, and committees organized to promote cleaning up the various sections. He ,,aid it may be too late for this year to get a program going, but he suggested a Council committee to get organized for a long-range continuing program. He said that even some City buildings need work on them. He said if everyone cooperates that the benefits will reach the entire economy. Mrs. Deen thinks that the City should do more substandard housing work. Councilman Kemble mentioned that the City street yards on Montgomery Street have two big piles of dirt which might be screened oi.- removed. Mayor Barr suggested that a committee made up of Council- man Shannon as Chairman, Councilmen Eagle and Stovall might work on this subject. At the regular meeting the Mayor appointed these members to a committee. 3. Agricultural Zoning (M&C PZ.-184) GENIE - list on May 16 agenda. 'There was slight explanatory discu;,.-Jon of this item at the Pre-Council Conference and no action was taken. At the regular meeting, the Council passed a motion calling a hearing on agricultural zoning for May 16, 1966, and to publish notice of the hearing. 4. Newell Industrial Addition (IR #933) DICK - draft memo to PW ;:,d PL::j departments to proceed Councilman Hamm asked for the Public Works Director 's indicated. explanation of hi., statement th.;L "it is highly improbable that the City could long endure the entreaties of taxpaying industries for maintenance of these private streets notwith- it.snding actual obligations relieving the City of such re- spon.:ibility. " The Public Works Director replied that it is a question of who will maintain the streets when owner- ship is in several different parties. He said the City could probably not refuf,c maintenance to such taxpayers even if pri- vate agreements were in effect to handle maintenance responsi- bility. Councilman Hamm asked about the Seminary South situa- tion for private streets in shopping centers. He also inquired how Dallas handles it. The Public Works Director said that one Dallas industrial area has a maintenance fund for the private streets, upon which the City can draw funds if necessary. The Public Works Director said that the difference at Seminary South is that this property remains under single ownership, and there is no question about whose responsibility the maintenance is. Councilman Hamm said he thinks the City has to reserve the right for an industrial subdivision company to do its own paving. He asked why Newell could do work on this subdivision for so long without the City staff noticing the work. He asked about the sanitary sewer re- location. The Water Director explained the recommended cost sharing on the sanitary sewer relocation, Councilman Hamm won- dered if the extra depth cost on the sanitary sewer is much le:;s than he would have to pay to replace the City line with cast iron under a 200,000 square foot building. The Water Director said that un- doubtedly it was cheaper for Newell to pay the extra depth cost than the equivalent cast iron pipe cost. Councilman Eagle asked if Ludelle Street goes through or whether there is any likelihood of the need for an east-west street in this location. The Public Works Director said that it dues not go through and probably never would. Councilman Kemble asked if these are all dedicated streets. The Public Works Director said that they are not, that they are private streets, and that the question for the Council is whether or not regular City specs will be required on building the streets. Councilman Kemble asked whether under this arrangement Newell con- tracts for the street work. The Public Works Director said he would, paying the whole cost, and the City would inspect the work. Councilman Hamm inquired about a private street discussion now going on with a new high school in Wedgwood. The Public Works Director said that there seemed to be much misunderstanding about what was needed or required in this instance. Councilman Hamm asked whether the drainage channel would be private. The Public Works Director said it would be, that Newell wishes to reserve the right to build over it in the future. Councilman Kemble asked what Council action is necessary on this matter. Mr. Denton said that the staff recommendation is for the City Plan Commission to study the question of private versus public streets, and for the Council to clarify whether the streets, drainage, and other community facilities will comply with standard City specs. Also, the staff has suggested that a final plat be permitted with private streets if no determination on this matter is forthcoming soon (in order not to delay Mr. Newell 's work) , and also that Mr. Newell complete physical improvements under City in- spection and to City standards. r In response to a question, the Public Works Director said that the drainage channel and curb and gutter work now in looks all right. Councilman Eagle inquired again whether Ludelle St. goes east or could go east in the future. He asked whether this new subdivision would cut off this street. Councilman Hamm said that the Council has no business discu::sing this matter, because the Plan Commission is re- sponsible. Mr. Denton said that the City Council will need to act on the developer 's contract, and the staff desired to know how to draw the contract. I1ie con:,ensus of the Council at this time appeared to be for the private vs. public street matter to be rcierred to the Plan Commission for its April 27th meeting, and for the staff to draw a standard developer's con- tract requiring City specifications on the streets, drainage channel, and all other community facilities. Action was taken at the regular meeting to refer this matter to the staff and the Plan Commission 5.
