HomeMy WebLinkAboutOrdinance 18757-08-2009ORDINANCE NO 18757-08-2009 AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF A TWELVE FOOT WIDE ALLEY SITUATED BETWEEN LOTS 4 AND 5, BLOCK 1, BROOKS AND BAILEY SUBDIVISION OF BLOCK 25, FIELD ADDITION AN ADDITION TO THE CITY OF FORT WORTH AS RECORDED IN VOLUME 32, PAGE 431 OF THE DEED RECORDS OF TARRANT COUNTY TEXAS PROVIDING FOR REVERSION OF FEE IN SAID LAND PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES EASEMENTS, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That a portion of a twelve foot wide alley nght-of way situated between Lots 4 and 5 Block 1 Brooks and Bailey Subdivision, Fields Addition, an Addition to the City of Fort Worth as recorded m Volume 32, Page 431 of the .Deed Records of Tarrant County Texas and containing approximately 1,200 square feet more or less, and as more specifically described in Exhibit A attached hereto and incorporated herein by reference be and the same is vacated and extinguished. SECTION 2. That the easement to the land m the above-described vacatedalley nght of way is hereby released and shall revert to the adjacent owner as provided by law SECTION 3 All existing utility easement be shall be retained by the City until such time all utilities located in that easement are relocated at the owner's expense. SECTION 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5. That this ordinance shall take effect upon adoption. No. 18757-08-2009 DATE Tuesday August 18 2009 LOG NAME 060065030 VA-08-029 REFERENCE NO *PZ 2840 SUBJECT Adopt an Ordinance Vacating an Alley 12 Feet Wide by 100 Feet Long Located Adjacent to Lots 4 and 5 Block 1 Brooks and Bailey Subdivision Southwest of the Intersection of Magnolia Avenue and Alston Avenue in the City of Fort Worth RECOMMENDATION It is recommended that the City Council authorize the City Manager to 1 Adopt an ordinance vacating an alley 12 feet wide by 100 feet long located adjacent to Lots 4 and 5 Block 1 Brooks and Bailey Subdivision in the City of Fort Worth and 2 Waive any and all purchase fee value of the vacated land in accordance with City policy (M&C G- 15624). DISCUSSION Grant Engineering Inc on behalf of Synchron City Investments has requested the vacation of the above referenced alley in order to replat it with the adjoining properties to allow for a private drive and parking The City Plan Commission recommended approval of this request at its meeting on November 21 2008 An acceptable replat (FS-09-010) has been received Any existing utilities will be relocated at the applicant's expense or retained within a designated easement, along with an appropriate plat note that no permanent structures may be constructed or placed thereon The City of Fort Worth (City) originally obtained the above mentioned public right-of-way through the platting process The City does not own land under or adjacent to the above referenced right-of-way Since no City funds have been expended to purchase property or easement rights collection of the fee value or any portion thereof is recommended by staff to be waived This land is located in COUNCIL DISTRICT 9 FISCAL INFORMATION /CERTIFICATION The Financial Management Services Director certifies that this action will have no material effect on City funds FUND CENTERS TO FundlAccountfCenters FROM Fund/Account/Centers CERTIFICATIONS Submitted for City Manager's Office bv: Fernando Costa (6122) Logname. 060065030 VA-08-029 Page 1 of 2 Originating Department Head.
