HomeMy WebLinkAboutResolution 1003 Ho& -,- �i�� I�"-A o F fop -t- B6501-V7-1 0 ry o - J o d i JOINT RESOLUTION AND AGREEMENT STATE OF TEXAS § COUNTY OF TARRANT § KNOW ALL MEN BY THESE PRESENTS: WHEREAS, the City of Fort Worth is a home rule city lying and being situated within the confines of the County of Tarrant, State of Texas; and WHEREAS, the City of Everman is a home rule city lying and being situated within the confines of the County of Tarrant, State of Texas; and WHEREAS, the City of Fort Worth and the City of Everman desire to adjust their boundary lines to facilitate the development and maintenance of property within their respective jurisdictions: NOW, THEREFORE, BE IT RESOLVED AND MUTUALLY AGREED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH AND THE CITY COUNCIL OF THE CITY OF EVERMAN: 1 . That the following boundary realignment between the City of Fort Worth and the City of Everman, as hereafter described, is in the best interests of the property owners and inhabitants of both cities and that the City of Fort Worth and the City of Everman will proceed with due diligence in adopting the necessary annexation and disannexation ordinances adjusting their respective corporate boundaries and all other proceedings necessary to effectuate this agreement. 2 . That the City of Fort Worth and the City of Everman do hereby covenant and agree to protect, preserve and defend the hereinafter K described boundary realignment. 3 . That the City of Fort Worth hereby agrees to discontinue from its corporate boundary and to release all its jurisdictional rights it may have in and to all territories embraced_ within the area shown on Exhibit "A" , attached hereto and made a part hereof, and describ- ed by metes and bounds as follows: TRACT 1. A tract, 16.413 acres out of a certain 199.86 acre tract in Block 9, Shelby County School Land Survey, Abstract 1375, known as Block 1, Everman Junior High School Site in deed to the First Penn. Mtg. and Trust of N.J. in Deed Records of Tarrant County, Texas. Beginning at a nail in the centerline of County Road 1098, being 4109.3 feet N. 89° 45 ' E. of the centerline of Oak Grove Road, and being the southeast corner of said 16.413 acre tract. Thence N. 0° 20 ' W. , 916 feet to an iron pin for a corner . Thence S . 89° 40 ' W. , 387.42 feet to an iron pin for a corner. -I.- Thence N. 0° 20 ' W. , 417. 4 feet to an iron pin for a corner. Thence S. 89° 40 ' W. , 124.5 feet to an iron pin for a corner. Thence S. 12 ° 31 ' W. , 1367.0 feet to a nail in the center- line of County Road 1098 for a corner. Thence N. 89° 45 ' E. , 807 .9 feet to the place of BEGIN- NING, containing 16.488 acres, more or less . TRACT 2. That certain tract or parcel of land out of Block 9, Shelby County School Land Survey, Abstract No. 1375, more particularly described as follows: BEGINNING at an iron pin in centerline of a sixty foot public roadway (Townley Drive) , said point being 1284. 59 varas NORTH and 1476.65 varas EAST of the southwest corner of the Shelby County School Land Survey; Thence SOUTH with the centerline of Dan Meyer Road 417.42 feet to a railroad spike for corner; Thence NORTH 89° 55 ' WEST, at 30.0 feet past west right-of-way line of said road and continuing on, in all, a total distance of 417.42 feet to a steel rod for corner; Thence NORTH 417.42 feet to a steel rod for corner; Thence SOUTH 89° 55 ' EAST at 387.42 feet, past the west right-of-way line of road and, continuing on, in all, a total of 417.42 feet to the place of BEGINNING and containing 4 acres of land, more or less . TRACT 3. A tract or parcel of land out of Block 25, Shelby County School Land, Abstract 1375, in the southern part of Tarrant County, Texas, and being a portion of the property conveyed to Charity Griffith in that certain deed recorded in Volume 639 on Page 626 of the Deed Records of Tarrant County, Texas; BEGINNING at an iron pin in the west right-of-way line of Forest Hill Drive, said iron stands SOUTH 0° 20 ' WEST 1395 feet and NORTH 89° 40 ' WEST 40 feet from the northeast corner of said Block 25; Thence SOUTH 0° 20 ' WEST with the west right-of-way line of said Forest Hill Drive for a distance of 250.0 feet to an iron for corner; Thence NORTH 890 40 ' WEST for a distance of 522 . 72 feet to an iron for corner; Thence NORTH 00 20 ' EAST for a distance of 250.0 feet to an iron for corner; -2- Thence SOUTH 890 40 ' EAST for a distance of 522. 72 feet to the place of BEGINNING, and containing 3 .0 acres of land, more or less. 4. That the City of Everman hereby agrees to annex the property disannexed by the City of Fort Worth, as described herein and shown in Exhibit "A and the City of Everman agrees to assume the rights and obligations appurtenant to said property. 5. That these terms and conditions set forth shall become effective and binding on Fort Worth and Everman by the adoption of this Joint Resolution and Agreement in regular open City Council meetings of the City of Fort Worth and the City of Everman, and that this Joint Resolution and Agreement, upon adoption of both cities, shall be executed in several originals and shall be spread in full on the minutes of each city. A copy of this Joint Resolution and Agreement shall be executed by the Mayor and attested by the City Secretary of each city.
