HomeMy WebLinkAboutOrdinance 21492-10-2014 f I i 4 I I ORDINANCE NO. 21492-10-2014 AN ORDINANCE VACATING AND EXTINGUISHING AN EXCESS PORTION OF WYOMING DRIVE, SITUATED IN BAR C RANCH, i PHASE 2, AN ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, AS RECORDED IN CABINET A, SLIDE 12013 IN f THE PLAT RECORDS OF TARRANT COUNTY, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; THE RETAINMENT OF EXISTING UTILITY EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, i TEXAS: SECTION 1. That a portion of Wyoming Drive, a 50 foot wide right-of-way, situated the Bar C Ranch, Phase 2 Addition, an addition to the City of Fort Worth, Tarrant County, Texas as recorded I Cabinet A, Slide 12013 in the Plat Records of Tarrant County, Texas, and containing respectively approximately 240 square feet or 0.006 acres of land more or less, and as more specifically i f described in Exhibit "A" attached hereto and incorporated herein by reference be and the same is vacated and extinguished. SECTION 2. That the fee to the lands in the above-described vacated alleys and streets are hereby i released and shall revert to the adjacent owner as provided by law. I DATE: Tuesday, October 14, 2014 REFERENCE NO.: **PZ-3069 i LOG NAME: 060065030 VA-14-015 SUBJECT: Adopt Ordinance Vacating a Portion of Excess Right-of-Way for Wyoming Drive and Incorporate it Into the j Adjoining Lot for Forestar Real Estate Group (COUNCIL DISTRICT 7) j i RECOMMENDATION: It is recommended that the City Council: I 1. Adopt the attached ordinance vacating a portion of excess right-of-way for Wyoming Drive and incorporate it into the adjoining lot for Forestar Real Estate Group; and i 2. Waive any and all purchase fee value of the vacated land in accordance with City Policy, Mayor and Council Communication G-15624. i DISCUSSION: JBI Partners, Inc., on behalf of Forestar Real Estate Group, has requested the vacation of this portion of excess right-of-way along Wyoming Drive to incorporate it with the adjoining residential lot. The City Plan Commission recommended approval of this request at its meeting on June 25, 2014. An acceptable final j plat(FS-14-169) has been received in accordance with the Subdivision Ordinance. The City of Fort Worth (City) originally obtained the above mentioned right-of-way through the platting process. The City does not own any fee interest in the right-of-way or own any property adjacent to the I right-of-way and did not expend any City funds to purchase the right-of-way easements. In accordance with the City's Policy regarding street and alley vacation transactions approved by the City Council on i March 6, 2007 (M&C G-15624), Staff recommends waiving the fair market value or any portion thereof of purchase price of the right-of-way easements for the streets and alley. i This project is located in COUNCIL DISTRICT 7, Mapsco 33M. i FISCAL INFORMATION /CERTIFICATION: The Financial Management Services Director certifies that this action will have no material effect on City funds.
