AN ORDINANCE VACATING AND EXTINGUISHING TWO PORTIONS
OF AVONDALE HASLET ROAD, SITUATED IN THE B.R. LACY
SURVEY, ABSTRACT NO. 990 OF THE CITY OF FORT WORTH,
TARRANT COUNTY, TEXAS; AS RECORDED IN THE DEED RECORDS
OF TARRANT COUNTY, TEXAS AND CONTAINING
APPROXIMATELY RESPECTIVELY 29,970 AND 16,516 SQUARE FEET
ACRE OF LAND MORE OR LESS; PROVIDING FOR REVERSION OF
FEE IN SAID LAND; PROVIDING THAT THE CITY SHALL RETAIN
ALL EXISTING UTILITIES EASEMENTS; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That portion of the right-of-way of Avondale Haslet Road, a public street with variable
width, situated in the B.R. Survey, Abstract No. 990 of the City of Fort Worth, Tarrant County,
Texas; as defined in Ordinance No. 17102-08-2006 of the City of Fort Worth, Tarrant County,
Texas, and containing approximately 0.688 acre or 29,970square feet of land more or less, and as
more specifically described in Exhibits "A" and "B" attached hereto and incorporated herein by
reference be and the same is vacated and extinguished.
SECTION 2.
That a portion of Avondale Haslet Road, a 30 foot wide right-of-way, situated in the B.R.
Lacy Survey, Abstract No. 990 of the City of Fort Worth, Tarrant County, Texas; as recorded in
Cabinet A, Slide 3468 of the Plat Records of Tarrant County, Texas and defined in Ordinance
No. 17102-08-2006 of the City of Fort Worth, Tarrant County, Texas, and containing
Avondale Haslet ROW Vacation(VA-14-018 and VA-14-019) Ordinance No. 21493-10-2014

approximately 0.379 acre of land or 16,516 square feet of land more or less, and as more
specifically described in Exhibits "C" and "D" attached hereto and incorporated herein by
reference be and the same is vacated and extinguished.
SECTION 3.
That the easement to the land in the above-described vacated street right of way is hereby
released and shall revert to the adjacent owner as provided by law.
SECTION 4.
All existing utility easement be shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.
SECTION 5.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 6.
That this ordinance shall take effect upon adoption.

Adopt Ordinance Vacating Two Portions of Rights-of-Way Along Avondale Haslet Road for a Lot
Expansion and a New Medical Office Building for Castle Development (COUNCIL DISTRICT 7)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached ordinance vacating a portion of prescriptive right-of-way and a portion of dedicated
right-of-way along Avondale Haslet Road for a lot expansion and a new medical office building for Castle
Development; and
2. Waive any and all purchase fee value of the vacated rights-of-way in accordance with City Policy
(Mayor and Council Communication G-15624).
DISCUSSION:
Baird Hampton and Brown, Inc., on behalf of Castle Development, request the vacation of two portions of
rights-of-way along Avondale Haslet Road and request to replat it with the underlying land for a new
medical office building and expansion of an adjoining residential lot. The City Plan Commission voted to
recommend approval of these requests at its meeting on July 23, 2014. Two acceptable final plats (FS-
14-127 and FS-14-128) have been received in accordance with the Subdivision Ordinance. The City
relocated Avondale Haslet Road from its original alignment farther to the south leaving these two portions
of rights-of-way running through the adjoining lots.
The City of Fort Worth (City) originally obtained the above mentioned rights-of-ways through the platting
process and by prescription. The City does not own any fee interest in the rights-of-way or own any
property adjacent to the rights-of-way and did not expend any City funds to purchase the right-of-way
easements. In accordance with the City's Policy Regarding Street and Alley Vacation Transactions
approved by the City Council on March 6, 2007 (M&C G-15624), Staff recommends waiving the fair
market value or any portion thereof of purchase price of the right-of-way easements for the streets and
alley.
