AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $40,000.00 FOR
PARK IMPROVEMENTS AT TRINITY PARK, SUBJECT TO RECEIPT OF A GRANT
FROM MAYFEST, INC.; PROVIDING FOR A SEVERABIL,ITY CLAUSE; MAKING
THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.

That in addition to those amounts allocated to the various City departments for Fiscal Year 2014-2015 in the
Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the Grants
Fund in the amount of$40,000.00 for Park Improvements at Trinity Park, subject to receipt of a grant i
from Mayfest,Inc. 1

SECTION 2. j
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or
void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.

That this ordinance shall be cumulative of Ordinance No. 21457-09-2014 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in !
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions
of said prior ordinances and appropriations are hereby expressly repealed.

This ordinance shall take effect upon adoption. ,

Authorize Acceptance of a Grant from Mayfest, Inc., in the Amount of$40,000.00 for Park Improvements in
Trinity Park and Adopt Appropriation Ordinance (COUNCIL DISTRICT 9)

RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the acceptance of a grant from Mayfest, Inc., in the amount of$40,000.00; and
I
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
I
Grants Fund in the amount of$40,000.00, subject to receipt of the grant.
DISCUSSION:
The purpose of this Mayor and Council Communication (M&C) is to accept a grant from Mayfest, Inc., and
appropriate funds for improvements in Trinity Park. i
Since 1973, the City has allowed a portion of Trinity Park to be used for the annual Mayfest event. In j
1994, the City and Mayfest, Inc., entered into a License Agreement with an initial term of five years, with C
two five-year renewal periods. On April 29, 2009, (M&C C-23491) the City Council authorized the renewal
of that License Agreement. On March 8, 2011, (M&C C-24777) the City Council authorized an
amendment to the fee structure with Mayfest, Inc., modifying the structure from 20'percent of net
operating profits to a fixed annual amount of$25,000.00 plus 10 percent of net profits.
In 2011, Mayfest, Inc., established a grant program that allows the founding organizations of the Mayfest
event, including the Parks and Community Services Department (PACSD), Streams and Valley, Inc., and
the Junior League of Fort Worth to apply for grants funded from the annual Mayfest event's net
proceeds. Since the grant program's inception, the Parks and Community Services Department has been
awarded a total of$94,000.00 in grant funds for improvements to Trinity Park.
On August 6, 2014, Mayfest, Inc., notified the PACSD that it would award the City of Fort Worth a grant in
the amount of$40,000.00 for the replacement of two fabric shade structures with metal shelters in Trinity
Park. The replacement of fabric shade structures will not only enhance the experience and safety of park
users, it will also make the facilities in Trinity Park more sustainable and economically feasible to maintain.
At the September 24, 2014 meeting, the Parks and Community Services Advisory Board endorsed the
acceptance of this grant.
Trinity Park is located in COUNCIL DISTRICT 9. !
