HomeMy WebLinkAboutOrdinance 21514-10-2014 i i i ORDINANCE NO. 21514-10-2014 i AN ORDINANCE ADJUSTING THE TOTAL NUMBER OF , AUTHORIZED SWORN POSITIONS IN THE POLICE DEPARTMENT y BY ADDING FOURTEEN POSITIONS IN THE CLASSIFICATION OF OFFICER; PROVIDING A STATEMENT OF PURPOSE AND INTENT; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES AND REPEAL CONFLICTING ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. i r WHEREAS, Section 143.021(a), Texas Local Government Code provides that a municipality's governing body shall by ordinance (i) establish the classifications of police officers and (ii)prescribe the number of positions in each classification; and i i WHEREAS, on September 16, 2014, the City Council adopted Ordinance 21457- 1 09-2014, which established the Police Department's sworn personnel staffing levels, effective October 1, 2014, as follows: 1 Assistant Chief 3 Deputy Chief 5 Captain 15 Lieutenant 46 Sergeant 165 Corporal/Detective 212 Police Officer 1,113 Total 1,559; and i i WHEREAS, the Police Chief has requested that the City Council increase the number of authorized positions within existing classification of Police Officer by i i fourteen (14) to accommodate all graduates of the current academy class, and thereafter , prescribe the number of authorized positions in the Police Department to conform with the proposed changes as set forth below in order to effect efficient economy of the operations of the Police Department. li i I i i I Ordinance No.21514-10-2014 I Pagel of 3 I i i i NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: I i SECTION 1. I That, following the formal adoption of this ordinance, the following positions I shall be the only sworn positions in each classification (rank) authorized in the City of i Fort Worth Police Department effective October 30, 2014, until modified by subsequent I ordinance: 1 Assistant Chief 3 Deputy Chief 5 Captain 15 Lieutenant 46 j Sergeant 165 Corporal/Detective 212 j Police Officer 1,127 Total 1,573 ; SECTION 2. I The "Mayor and Council Communication" memorandum, which is presented i contemporaneously with this ordinance, is hereby expressly incorporated herein by reference for further clarification and explanation of the purpose and intent of the City j Council in its adoption of this ordinance as well as the Department in its implementation. I I i SECTION 3. This ordinance shall be cumulative of all provisions of previous ordinances and of I 1 the Code of the City of Fort Worth, Texas (1986), as amended, except where the i provisions of this ordinance are in direct conflict with the provisions of prior police i 1 Ordinance No.21514-10-2014 j Page 2 of 3 I 1 i i staffing ordinances for the Police Department and such Code, in which event conflicting i provisions of such ordinances and such code provisions are hereby repealed and this ordinance shall be controlling. i i SECTION 4. Ii DISCUSSION: The purpose of this Mayor and Council Communication and the attached ordinance is to increase the number of authorized positions in the classification of Police Officer in the Police Department by 14, ; effective October 30, 2014, so that the Fort Worth Police Department (FWPD) will be able to commission all of the graduating recruits in police academy Class 136 as Police Officers. The FWPD currently is training 20 recruits in Class 136, who are expected to graduate on October 30, 2014 and be eligible to be commissioned on November 1, 2014. The FWPD currently has 17 vacancies in all civil service ranks and 6 vacancies in the Police Officer classification. Currently, FWPD does not have the necessary active eligibility lists to promote into vacant classification of a higher rank. In order to commission all 20 graduates of Class 136, 14 additional positions in the Police Officer classification are needed. Addition of these positions would increase the number of authorized positions in the e classification of Police Officer from 1,113 to 1,127 and increase the overall total of authorized civil service positions in the Police Department from 1,559 to 1,573. Because of retirements and other types of separation from employment, FWPD continually has vacancies arise. Yet, the recruit classes graduate approximately every seven months. The FWPD attempts to fill each vacancy with the graduates of the academy and for a portion of the vacancies before the next class ? graduates. The consequence of additional vacancies is that the City has less patrol officers to respond to calls for service. Therefore, in an effort to keep the number of vacancies as close to zero as reasonably f possible, FWPD plans its training academy class sizes in order to, as closely as possible, approximate the number of known and projected vacancies. In this instance, the number of vacancies in the Police Officer ; classification at the time of graduation will not be sufficient to cover the entire class of graduating recruits. Therefore, this request seeks to temporarily increase the number of authorized positions in the classifications of Police Officer in order to accommodate all of the graduates. Following the commissioning of these officers, as new vacancies occur whether through attrition or promotion, the FWPD will hold Police Officer positions vacant to offset the requested increase and expects to submit an updated staffing ordinance to City Council in approximately four months to reduce the number of authorized positions back to the budgeted strength of 1549 per M&C G-18210 and one additional officer li f Logname: 35STAFFING ORDINANCE - OFFICER POSITIONS CLASS 136 Page 1 of 2 i i f position per GO 424.12, for a total of 1,550. f The Fiscal Year 2015 Police Department General Fund Budget took into account projected unfilled vacancies and associated salary savings with the intent to use cost savings and vacancies to field and pay for the recruits of Class 136. However, due to some unplanned rehires and a reinstatement, the FWPD has not yet been able to identify savings to cover the full cost of all of the positions associated with the graduates of Class 136. The FWPD will continue to work with the Financial Management Services Department and to review the department's budget and expenditures to identify additional savings that will be used to offset these costs. I 1 On September 16, 2014, the City Council adopted its most recent authorized staffing ordinance for the f Police Department (Ordinance No. 21457-09-2014) at 1,559 authorized positions. The purpose of this change was to add 10 temporary overage Police officer positions to accommodate graduating recruits in f Police Academy Class 135 as Police officers. These positions have not been converted to permanent positions yet, due to insufficient vacancies in the department.
