FIRST AMENDMENT FOR A REAL ESTATE CONTRACT
BETWEEN THE HURST-EULESS BEDFORD INDEPENDENT SCHOOL DISTRICT
WHEREAS, the City of Fort Worth, a Texas home rule municipal corporation
("Purchaser") entered into a real estate contract ("Contract") (City Secretary Contract No.
45391) effective as of February 25, 2014 with Hurst-Euless-Bedford Independent School District
("Seller") for property located adjacent to Mosier Valley Road and Vine Street; and
WHEREAS, since the Contract was executed, the parties have discovered that the Seller
does not own all of the land described in the Contract; and
WHEREAS, Purchaser and Seller desire to amend the contract to only include the correct
legal description of the land, reduce the sales price proportionately and to provide that Purchaser
will pay all Seller's costs to sell the land.
NOW THEREFORE, in consideration of the Earnest Money set forth in the Contract, the
parties agree as follows:
1.
The Property shall be described as set forth in Exhibit A.
II.
Paragraph 1 shall be amended by providing that the Purchase Price shall be
$195,000.000.
III.
Paragraph 4 shall be amended to provide that Purchaser shall be responsible for the cost
of the title policy.
IV.
Paragraph 10 shall be amended to provide that all Closing Costs shall be paid by
Purchaser.
All other terms and conditions of the Contract remain unchanged and in full force and
effect.

HEARING:
SUBJECT: Amend Mayor and Council Communication L-15656 Regarding the Purchase of Property
for the Creation of Mosier Valley Park so as to Add Tarrant County as a Seller(COUNCIL
DISTRICT 5)
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize an amendment to Mayor and Council Communication L-15656 to purchase property
located at Mosier Valley Road and Vine and Knapp Streets for the creation of Mosier Valley Park to
add Tarrant County as a seller;
2. Authorize the acceptance and recording of the appropriate instruments; and
3. Dedicate the property as parkland upon conveyance.
DISCUSSION:
On February 4, 2014, the City Council approved Mayor and Council Communication (M&C) L-15656
authorizing the acquisition of approximately 4.0 acres of land located on the south side of Mosier
Valley Road and west of Vine Street and Knapp Street from the Hurst-Euless-Bedford Independent
School District (HEB ISD) for the creation of the Mosier Valley Park in the amount of$260,000.00,
plus the amount of$25,000.00 for closing costs. Since that date, HEB ISD has determined that they
own only three acres of the property and that Tarrant County owns the remaining acre. Therefore,
Staff recommends amending City Secretary Contract No. 45391 to acquire three acres from HEB ISD
and one acre from Tarrant County. The property will be used for the development of Mosier Valley
Park, which will serve the citizens in an underserved area of the City. The City has expended the
amount of$10,100.00 of the previously approved amount of$260,000.00 for payment of earnest
money that will be applied to the purchase price of the property from HEB ISD. The City will pay the
costs to survey the property before conveyance and will confirm closing costs with a title company.
The total purchase price of the property remains in the amount of$260,000.00 with an additional
amount of$25,000.00 for closing costs, as approved in M&C L-15656. The legal description is as
follows:
