FIRST AMENDMENT TO CITY SECRETARY CONTRACT NO. 45092 WHEREAS, on October 31,2013,the City of Fort Worth("City") and IntegrityTexas Construction Ltd., a limited partnership authorized to do business in the State of Texas ("Contractor)made and entered into City Secretary Contract No. 45092 (the"Contract) for construction services for the City's Priority Repair Program. WHEREAS,the Priority Repair Program provides up to $5,000.00 for home repairs for eligible City homeowners for Priority 1 emergency repairs and Priority 2 repairs of failed household mechanical systems to address health and safety issues as more particularly defined by the program. WHEREAS, the Contract was for a 1 year term beginning on the Effective Date and provided for 4 additional 1 year terms; WHEREAS, the Parties have agreed to extend the Contract for an additional 1 year term beginning November 1, 2014 through October 31, 2015; and, WHEREAS, it is the mutual desire of City and Contractor to amend the Contract to meet Contract objectives. NOW, THEREFORE, City and Contractor hereby agree to amend the Contract as follows: I. ARTICLE 1. DEFINITIONS is amended by adding the following definitions: "Effective Date"means November 1, 2014. "Priority Repair Program" or"program"means the City's home repair program for eligible low to moderate income homeowners adopted by the City Council in M&C G- 17589. rry ARTICLE 2. SCOPE OF SERVICES Section A. is amended to be and read as follows r by adding the following as the first sentence. r-n z "A. The purpose of this Contract is to provide home repair services for the Priority Repair Program. All penetration of building components shall be neat, sleeved and fire stopped and shall not compromise structural integrity. Contractor shall submit a diagram, and must use the Air Conditioning Contractors of America (ACCA) Manual J Heat loss calculation tool http://www.acca.org/tech/manualj/), and use ACCA's Manual S for equipment selection. Size of furnace selected should be matched to the living unit considering any areas which may be added or subtracted from the plan plus meet the current Energy Code requirements adopted by the City to efficiently heat the structure. 23. HOURLY RATE FOR LABOR COST HVAC: Service and related work: Services will be provided Monday through Friday between 7:00 am and 5:30 pm. Rate shall include trip charge, travel time, mileage, transportation cost, parking and toll fees. Rate shall start upon $80.00\Hourly Rate for Labor Cost CENTRAL GAS FURNACE:–Complete install –Efficiency or higher configuration types: Up-flow, Down-flow and Horizontal. Central Heat/Furnace all installations shall be code compliant, a mechanical permit is required. Installation cost shall include all labor, material and supplies required to install new unit in accordance with manufacturer requirements, removal of existing unit and properly disposal in accordance with EPA regulation. Installation shall also include, vent flue- complete with outside roof lack and flashing, new gas valve if applicable,gas lines and shut off valve, if applicable, duct modification if needed. Unit shall be properly vented, insulated and/or sealed in accordance to local code requirements (including high low vents). 24.
