HomeMy WebLinkAboutContract 45511-A1 AMENDMENT NO. 1 to STANDARD AGREEMENT for ENGINEERING RELATED DESIGN SERVICES A NEW COMMUNITY FACILITY in the EVANS-ROSEDALE BUSINESS & CULTURAL DISTRICT STATE OF TEXAS § § CITY SECRETARY CONTRACT NO. COUNTY OF TARRANT § WHEREAS, The City of Fort Worth and CMJ Engineering, Inc., made and entered into City Secretary Contract No. 45511 (the"Contract")which was administratively executed, the 22nd day of April, 2014; and WHEREAS, further amendment is necessary for engineering related design services to include additional services for additional material testing due to the increase of occurrences of concrete pours; and NOW THEREFORE, The City of Fort Worth, a Texas home-rule municipality (the "City"), and CMJ Engineering and Testing, Inc, d/b/a CMJ Engineering, Inc., a domestic corporation (the "Engineer"), collectively the ("Parties"), acting herein by and through their duly authorized representatives, enter into the following agreement: 1. The Contract is hereby ratified by the Parties and incorporated into this Amendment No. 1 by reference. 2. Scope of Services — Article I of the Contract is amended to include the following additional engineering services: "Provide engineering services to include additional services for additional material testing due to the increase of occurrences of concrete pours. The cost of this Additional Service is (Not-To-Exceed) $20,000.00. The Additional Services is described more fully in the CMJ Engineering, Inc.'s letter dated October 16, 2014 subject: Budget Increase, Construction Materials Testing Services for New Bethlehem United Community Center—Evans Avenue, Fort Worth, Texas, which is attached hereto as Attachment"A" and made a part of this Agreement." 3. Compensation — Article II of the Contract is amended to provide for an increase in the amount of total compensation to be paid to the Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed $41,425.75. 4. All other terms and conditions of the Contract not expressly amended herein remain unaffected and in full force and effect, are binding on the Parties, and are hereby ratified by the Parties.
