THIRD RENEWAL OF CITY SECRETARY CONTRACT NUMBER 42485 LEASE AGREEMENT BETWEEN THE CITY OF FORT WORTHAND GREGORY ASIKIS This THIRD RENEWAL OF CITY SECRETARY CONTRACT NO. 42485 ("Renewal") is made and entered into by and between the CITY OF FORT WORTH, a home-rule municipal corporation of the State of Texas (hereinafter referred to as "Lessor"), acting by and through its duly authorized assistant City Manager, and GREGORY ASH US, a natural person ("Lessee"). WHEREAS, Lessor acquired a track of land consisting of approximately 245.77 acres, which land will be held in reserve status for future use and development as a park (the "Park") WHEREAS, prior to Lessor's purchase of the Park, Lessee resided on the property and served as a caretaker; WHEREAS, Lessor desires to make arrangements to protect and preserve the Park by providing for basic maintenance and security while the Park remains in reserve status; WHEREAS, Lessee has expressed a willingness to provide the required services in exchange for being allowed to continue residing on the Park; WHEREAS, Lessor and Lessee entered into a Lease to allow Lessee to continue to reside on a specified area of the Park in exchange for providing certain specified services for the preservation and benefit of the Park, the same being City Secretary Contract No. 42485 ("agreement"); WHEREAS, the initial term of the agreement was for one-year from October 1, 2011 through September 30, 2012; WHEREAS, the Agreement provides that the term may be renewed for successive one-year periods by mutual written agreement of the parties; WHEREAS, the parties exercised the first and second renewal terms and the second renewal term expired on September 30, 2014; WHEREAS, the parties desire to continue this relationship by extending and renewing the agreement for a second one-yea , an OFFICIAL RECORD First Renewal CSC 42485—Gregory Asikis CITY SECRETARY Page l of 2 FT.WORTH,TX CEI VED NOV 112014 NOW,THEREFORE, Lessor and Lessee do covenant and agree as follows: 1. The Lessor and Lessee hereby agree to renew and extend Fort Worth City Secretary Contract No. 42485 for a third one-year renewal period, commencing on the 1St day October 2014 and ending on the last day of September 2015 ("Renewal Term") 2. All terms and conditions of City Secretary Contract No. 42485 shall remain in full force and effect during the Renewal Term unless specifically amended herein. CITY COUNCIL AGENDA FORT ii COUNCIL ACTION: Approved on 9/20/2011 DATE: 9/20/2011 REFERENCE NO.: ""L-15248 LOG NAME: 80PARK CARETAKER CODE: L TYPE: CONSENT PUBLIC NO HEARING: SUBJECT: Authorize a Residential Lease Agreement with Greg Asikis for Approximately 0.12 Acres of Property Within Northwest Community Park in Exchange for Providing Basic Caretaker Services for the Park (COUNCIL DISTRICT 7) RECOMMENDATION: It is recommended that the City Council authorize the City Manager to execute a Residential Lease Agreement with Greg Asikis for approximately 0.12 acres of property within Northwest Community Park in exchange for providing in-kind basic caretaking services for the park. DISCUSSION: The purpose of this M&C is to authorize the City Manager to execute a Residential Lease Agreement with Mr. Greg Asikis for approximately 0.12 acres of property within Northwest Community Park in exchange for providing in-kind basic caretaking services for the park. Mr. Asikis has lived in a mobile home located on the property now known as Northwest Community Park since 1982 and served as caretaker for the previous owner. After the City purchased the land, Mr. Asikis asked if he could remain on the property in exchange for continuing to perform basic maintenance and caretaking services. On June 14, 2011, (M&C L-15210)the City Council authorized the acquisition of 245.77 acres of land for a new park in northwest Fort Worth. The Northwest Community Park is in reserve-park status until resources are identified to provide for its development as a fully functional park open to the public. The property includes a large permanent residential dwelling, out buildings, and a 20 acre lake that will require regular monitoring to discourage vandalism and other negative activity. Entering into the proposed Lease Agreement would benefit the City because it will provide for an on- site tenant who can monitor the property while it remains in reserve status and perform some basic general maintenance (minimal mowing, litter removal, and reporting signs of disturbance, damage, and unauthorized use to the Parks and Community Services Department) without any direct cost to the City. This contractual Agreement represents the most cost effective arrangement to manage this property. The proposed lease would have an initial one-year term and allow for annual renewals so that the property can continue to be monitored and maintained until it is developed and opened to the public. In addition, the lease includes a provision allowing either party to terminate with or without cause on a 30 day written notice so that the residential use can be easily discontinued when the park is developed. The Northwest Community Park is located in Council District 7.
