COUNTY OF TARRANT §
WHEREAS, the City of Fort Worth (City) and Carter & Burgess, Inc., (Engineer)
made and entered into City Secretary Contract No. 28673 (the Contract) which was
authorized by the City Council by M&C C-19564 on the 29th day of April, 2003; and
WHEREAS, the Contract involves engineering services for the following project:
Engineering Contract for East 7th Street Deep Tunnel Sewer, which includes
replacement of approximately 4,000 linear feet of Sanitary Sewer Main M-34 with
approximately 5,500 linear feet of 24-inch deep tunnel sewer to meet current
demand and future growth in the uptown area of the Central Business District of
Fort Worth, Texas. The project area is located from Sanitary Sewer Main DS-100
at the intersection of 7th Street and Commerce Street to Sanitary Sewer Main M-
545, somewhere in the vicinity of the Burlington Northern Santa Fe Railroad.
WHEREAS, it has become necessary to execute Amendment No. 1 to said
Contract to include an increased scope of work and revised maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and through their duly
authorized representatives, enter into the following agreement, which amends the
Contract:

Article I of the Contract is amended to include the additional engineering services
specified in a proposal letter dated July 31, 2003, a copy of which is attached hereto and
incorporated herein. The cost to City for the additional services to be performed by
Engineer total $1- 14j670-0
2.
Article II of the Contract is amended to provide for an increase in the maximum
fee to be paid to Engineer for all work and services performed under the Contract, as
amended, so that the total fee paid by the City for all work and services shall not exceed

All other provisions of the contract, which are not expressly amended herein, shall
remain in full force and effect.

Dear Mr. Sahu;
At your request I am pleased to submit Contract Amendment No. 1 to our Agreement for
Engineering Services for additional funding. This will cover the necessary expenditures for
additional general liability insurance coverage and bond coverage for our geotechnical sub
consultant, Mas-Tek Engineering & Associates, Inc. This will also cover the extra administrative
effort for Carter& Burgess, Inc. The additional funding request is made due to the increased
insurance coverage as deemed necessary by the Transportation Public Works Department and
different from our original signed contract stipulations. The increased insurance coverage and
bond requirement was communicated to Carter& Burgess by an email from Chris Harder dated
June 26, 2003.
The following is a summary of the additional cost to provide the insurance and bonding as
requested by the city:
• A $25,000 bond will cost $1,410.00
• A $1 million General Liability Insurance with a $10 million umbrella will cost an
additional $10,200.00.
• Time and effort spent on meetings to obtain change of insurance coverage is
$4,250.00
This amendment for a revised design fee provides an increase in the total not to exceed fee of
$15,860.00. The following table summarizes the Amendment No 1 request.

The contract's total M/\NBE commitment will be increased from $87,000.00 or 26% to
$99,410.00 or 27.9% participation.
As soon as Amendment No. 1 is approved, Mas-Tek will be issued a sub consultant agreement
change order from Carter & Burgess, then they will begin the process to obtain the additional
General Liability Insurance and a $25,000 Bond. This Amendment No. 1 also requests that an
additional three (3) weeks be added to our contract schedule to account for lost time during the
change in scope and time to acquire the necessary insurance. A revised schedule is attached
for your reference. Please review this request and contact Terry Foyt or myself should you have

Terry,
Regarding the $25, 000 bond, the cost is 3% of bond plus 2 hours principal
time plus 2 hours administrative time. The typical time frame is 2 to 3
weeks for submittal and review of corporate information including financial
statements . If we walk this through personally, the time frame can be
shortened to about 2 to 3 days. This will require an additional 2 hours
principal time and 2 hours admin time. The total cost will be $1,410 .00.
Regarding the cost of increased General Liability Insurance, for a $1 mil.
policy with a $5 mil umbrella, the additional cost will be $6, 000.00. For a
$1 mil policy with a $10 mil Umbrella, the additional cost will be
$10,200.00
