WHEREAS, the City of Fort Worth (City) and Dunaway Associates,
Inc, (Engineer) made and entered into City Secretary Contract No.
29019, (the Contract) which was authorized by the City Council by
M&C C-19701 on the 12th day of August, 2003 and; subsequently
revised by two previous amendments; and
WHEREAS, the Contract involves engineering services for the
following project:
Water Main Extensions to Serve Walsh Ranch, Phase I.
WHEREAS, it has become necessary to execute Amendment No. 3 to
said Contract to include an increased scope of work and revised
maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and through
their duly authorized representatives, enter into the following
agreement which amends the Contract:

Article I, of the Contract is amended to include the addition-
al engineering services specified in M&C C-20561, adopted by the
City Council on 8t' day of March, 2005 and further amplified in a
proposal letter dated January 26, 2005, copies of which are both
attached hereto and incorporated herein. The cost to City for the
additional services to be performed by Engineer total $125,377.00.

Article II, of the Contract is amended to provide for an
increase in the maximum fee to be paid to Engineer for all work and
services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall not
exceed the sum of $1,157,691 .45 .

All other provisions of the Contract which are not expressly
amended herein shall remain in full force and effect.

Authorize Execution of Amendment No. 3 to the Engineering Agreement with Dunaway Associates,
Inc., for Water Main Extension to Serve Walsh Ranch, Phase 1
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute Amendment No. 3 to City
Secretary Contract No. 29019 with Dunaway Associates, Inc., in the amount of$125,377.00 to provide for
additional design and survey services, thereby increasing the contract amount to $1,157,691.45.
DISCUSSION:
On August 12, 2003 (M&C C-19701), the City Council authorized the City Manager to execute an
engineering agreement with Dunaway Associates, Inc., in the amount of $965,406.95 for Water Main
Extension to serve Walsh Ranch, Phase 1. On January 20, 2004 (M&C C-19940), this contract was revised
by Amendment No. 1 in the amount of $42,605.00 and on February 20, 2004, by Amendment No. 2 in the
amount of $24,302.50 by the City Manager. These amendments provided for the preparation of plans and
specifications for an additional 3,500 feet of the water main and additional investigation for a potential water
tank site.
To avoid protracted negotiations with a property owner and to complete the project on schedule, it is
necessary to construct a proposed water tank at a different site than originally selected. The owner of the
original site was initially favorable to negotiating with the City for acquisition of the tank site. However, the
City has been unable to come to agreeable terms with the property owner and the project will be severely
delayed if another site is not selected.
The additional work to be performed in Amendment No. 3 consists of the design of an additional 1,500 feet
of water line and ground storage tank site design due to the change in the tank site location.
Dunaway Associates, Inc., proposes to provide the necessary additional design and survey services for a
lump sum fee of $125,377.00. City staff considers this amount to be fair and reasonable for the scope of
services proposed.
Dunaway Associates, Inc., is in compliance with the City's M/WBE Ordinance by committing to an
additional 23% M/WBE participation on this Amendment No. 3.
The project will be located in COUNCIL DISTRICTS 3 and 7, pending the completed annexation for the
project, Mapsco 57W and X; 71 Z; 76D, H, J, M, N, P, Q, and R; and 760M and R.
