DISCUSSION: Mr. and Mrs. Clifton Grace own a home addressed as 2533 Waits Avenue. Their home faces Waits Avenue. The Graces have constructed a 6' wooden fence to the rear of their property in order to secure additional security to their home. The fence was constructed approximately 6' beyond their property line and into what appears to be an alley. The fence was also installed to line up with existing fences on either side of their property. The location of the fence allows the Graces to drive their vehicles into their garages which face toward the "alley." If the fence is moved back to the property line, the garage would no longer be accessible for vehicle storage. As a result of a complaint from a neighbor, the Graces received a citation for an unauthorized encroachment into what appears to be an unused alley. Investigation into the issue reveals that the "alley" is actually a dedicated street which has never been used as a street. Observation of plans of the street (named Prairie Avenue) reveal numerous other buildings, fences, and rock walls encroaching into Prairie Avenue. In order to legalize the encroaching fence into Prairie Avenue, the Graces have executed a standard Encroachment Agreement and are requesting approval by the City Council. The Encroachment Committee has agreed to recommend approval of the application. The encroachment is in COUNCIL DISTRICT 9.
