HomeMy WebLinkAboutContract 29330 AMENDMENT NO. 4 STATE OF TEXAS S CITY SECRETARY CONTRACT NO. r 33v (No M&C Needed) COUNTY OF TARRANT S WHEREAS, the City of Fort Worth (City) and Gutierrez, Smouse, Wilmut & Associates, Inc. , (Engineer) made and entered into City Secretary Contract No. 27181, (the Contract) which was authorized by the City Council by M&C C-18798 on the 16th day of October 2001; and subsequently revised by three previous amendments; and WHEREAS, the Contract involves engineering services for the following project: Engineering contract for the design of Water and Sanitary Sewer Extension for Old Denton Road/Golden Triangle Blvd. Area. WHEREAS, it has become necessary to execute Amendment No. 4 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated October 21, 2003, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer total $4, 580 . 00. 2 . Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $216, 061. 00. Justification The initial alignment of Sanitary Sewer Line "B" followed property lines from Golden Triangle Boulevard south to Prestige Road and minimized the number of easements needed to construct the line. Due to problems in dealing with the owners of the Crawford Farms property and their subsequent submittal of a preliminary plat and plans for the tract, the City staff requested an alternate alignments be provided. The alternate alignment selected moves the majority of the sewer line off the Crawford Farms Tract and onto two other property owners to the west. The original proposed alignment of Line "B" was in direct conflict with the current proposed site plan for the property. No additional surveying is expected except providing two new easements and revising the Crawford Farms proposed easement. AREA, DOE NO. 3311, WATER PROJECT NO. P160-060160151640 AND SEWER PROJECT NO. P170-070170131640 The proposed amendment will allow Gutierrez, Smouse, Wilmut & Associates, Inc., (GSWA)to provide additional engineering services on the project as requested by the City. Subsequent to completing design of the project, the owner of Crawford Farms submitted a subdivision plan, which proposes to build houses over a segment of the project sewer main. Staff had been negotiating an easement for the proposed sewer main with the property owner. In order to avoid protracted negotiations and extensive delays on the project, staff directed GSWA to relocate the line westwards and onto vacant land, which will require that new easements be generated. Gutierrez, Smouse, Wilmut & Associates, Inc., has requested a fee of$4,580.00 for the addi- tional services to be provided thereby increasing the contract fee from $211,481.00 to $216,061.00. I believe this fee is fair and reasonable for the additional services that were pro- vided.
