RE: DESIGN FEE AMENDMENT NO. 2 TO SANITARY SEWER REHABILI-
TATION CONTRACT LXVIII (68), DOE NO. 3766, WATER PROJECT NO.
PS58-070580175800
The proposed amendment will allow Carter & Burgess, Inc. (C&B) to provide additional en-
gineering services on the project as requested by the City.
Due to repeated complaints of sanitary sewer backups received by residents of Eastwood
Avenue, staff investigated the complaints and determined that the line was old and severely
deteriorated. This amendment will compensate C&B for the additional effort involved with
redesigning and relocating the Eastwood Avenue sewer line from an inaccessible location
(behind the lots along a brick wall) into the street right-of-way, allowing for deepening of the
line and easier future access for City maintenance purposes, and rerouting all the sewer ser-
vice lines.
Amendment No. 1 provided compensation for surveying services and design for the rerouting
of lateral L-2781 along Eastwood Avenue and the Wildwood Road outfall into Greenwood
Cemetery.
Carter & Burgess, Inc., has requested a fee of $20,376.75 for the additional services to be
provided thereby increasing the contract fee from $214,242.00 to $234,618.75. 1 believe this
fee is fair and reasonable for the additional services that were provided.
Please authorize this additional design fee by your signatures on the attached contract
amendment form.

WHEREAS, the City of Fort Worth (City) and Carter & Burgess,
Inc. , (Engineer) made and entered into City Secretary Contract No.
28236, (the Contract) which was authorized by the City Council by
M&C C-19346 on the 12th day of November 2002 and subsequently
revised by one previous amendment; and
WHEREAS, the Contract involves engineering services for the
following project:
Engineering contract for the design of Sanitary Sewer
Rehabilitation Contract LXVIII (68) .
WHEREAS, it has become necessary to execute Amendment No. 2
to said Contract to include an increased scope of work and revised
maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and
through their duly authorized representatives, enter into the
following agreement which amends the Contract:

Article I of the Contract is amended to include the
additional engineering services specified in a proposal letter
dated November 10, 2003, a copy of which is attached hereto and
incorporated herein. The cost to City for the additional design
services to be performed by Engineer total $20, 376 .75.

Article II of the Contract is amended to provide for an
increase in the maximum fee to be paid to Engineer for all work
and services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall not
exceed the sum of $234, 618 .75.
3 .
All other provisions of the Contract which are not expressly amended
herein shall remain in full force and effect.

is hereby submitted for your review and approval by the City of Fort Worth for additional
ser,71ces performed by Carter & Burgess, Inc.. (C&B) to complete an expanded (changed)
scope of work as given in the initial Basic Engineering Services Agreement referenced
above.

L,-1'781. Additional tasks typically included the preparation of project
presentation drawings and/or illustrations, public meeting notices, agendas,
rneeti.ng notes and documentation, and general attendance by C&B project staff.
2. Preparation ofdet..ailcd drawings and speciicatiors to relocate Sanitary Sewer L-
2.781 from within e::isting,.•esidential lots (back Jot alignment) to City streets
ftonting the stated lots impacted by the sewer's relocation.

INCREASE IN CONTRACT FEE
This amendment for the stated additional engineering services and tasks will result in an
increase to the total not to exceed contract fee. The contract change in engineering, or
professional, services fee is summarized as follows:

labor charges assigned to this amendment request is attached for your review and
approval.
