AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF
MIRA VISTA BOULEVARD AS RECORDED IN VOLUME 388-205,
PAGE 49 OF THE PLAT RECORDS OF TARRANT COUNTY TEXAS
CONTAINING APPROXIMATELY 21,511 SQUARE FEET OR 0 493
ACRES OF LAND PROVIDING FOR REVERSION OF FEE IN SAID
LAND PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING
UTILITIES EASEMENTS REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE. DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS
SECTION 1
That a portion of Mira Vista Boulevard, as recorded m Volume 388-205 Page 49 of the
Plat Records of Tarrant County Texas, containing approximately 21,511 square feet or 0 493
acres of land, and as more specifically described m Exhibits A and `B" attached hereto and
incorporated herein by reference be and the same is vacated and extinguished.
SECTION 2.
That the easement to the land m the above-described vacated street nght of way is hereby
released and shall revert to the adjacent owner as provided bylaw
SECTION 3.
All existing utility easement be shall be retained by the City until such time all utiht~es
located in that easement are relocated at the owner's expense.
SECTION 4
That all ordinances or parts of ordinances m conflict herewith are hereby repealed.

SECTION 5.
That this ordinance shall take effect upon adoption.

PROPERTY DESCRIPTION
BEING a tract of land situated in the J. Heath Survey, Abstract Number 641, City of Fort Worth, Tarront County, Texas,
being a portion of Miro Vista Boulevard as shown on plat recorded in Volume 388-205, Poge 49, Plat Records, Tarrant
County, Texas, said tract of land being more particularly described by metes and bounds as follows:
COMMENCING at the northwest corner of Lot 27, Block 1, Trinity Heights Addition, on additidn to the City of Fort Worth,
according to the plat recorded in Cabinet A, Slide 4956, Plat Records, Tarrant County, Texas, southwest corner of that
certain 0.413 acre tract of land as described by deed to Mira Vista Homeowners Association, Inc., recorded in County
Clerk's Document No. D208143424, Deed Records, Tarront County, Texas and being in an east line of Block E, Mira Vista
Addition, an addition to the City of Fort Worth, according to the plat recorded in Cabinet A, Slide 423, 'Plat Records, Tarront
County, Texas;
North 16'54'28" East, with the west line of said Mira Vista Homeowners tract and with an east line of sold Block E, Mira
Vista 'Addition, o distance of 49.72 feet to a point for the northwest corner of said Mira Vista Homeowners tract and the
re-entrant corner of sold Block E, Mira vista Addition;
South 88'20'39" East, with an east line of said Block E, Mira Vista Addition, with a north line of said Mira Vista
Homeowners tract, a distance of 130.29 feet to a point in the southerly right-of-way line of aforementioned Mira Vista

northeasterly direction, an arc length of 0.25 feet to a point for o reverse curve to the right having a central angle of

THENCE continuing with the northerly right-of-way line of said Mira Vista Boulevard, with said reverse curve to the right in a
northeasterly direction, an arc length of 75.37 feet to a point for the beginning of o compound curve to the right having a
central angle of 10'11'32", a radius of 490.00 feet and a chord bearing and distance of South 71'00'01" East - 87.05 feet;
THENCE continuing with the northerly right-of-way line of said Mira Vista Boulevard, with said compound curve to the right
in a southeasterly direction, an arc length of 87.16 feet to a point;
THENCE South 65'54'15" Eost, continuing with the northerly right-of-way line of said Mira Vista Boulevard, a distance of
27.53 feet to a point;
THENCE South 13'37'02" West, deporting the northerly right-of-way line of said Mira Vista Boulevard, a distance of 104.35
feet to a point in the southerly right-of-way line of said Miro Vista Boulevard and being the beginning of anon-tangent
curve to the left having a central angle of 02'16'04", o radius of 407.22 feet and a chord bearing and distance of North

THENCE with the southerly right-of-way tine of said Mira Vista Boulevard and with said non-tangent curve to the left in a
northwesterly direction, an arc length of 16.12 feet to a point for a reverse curve to the right having a central angle of
11'10'33", a radius of 510.00 feet and o chord bearing and distance of North 84'19'17" West - 99.32 feet;
THENCE continuing with the southerly right-of-way line of said Miro Vista Boulevard, with said reverse curve to the right in
a northwesterly direction, an arc length of 99.48 feet to the POINT OF BEGINNING and con taininq a calculated area of 21,511
square feet of 0.493 acre of land.

Adopt an Ordinance Vacating a Portion of Mira Vista Boulevard Located Between Bryant Irvin Road and
Forest Highlands Drive and Waive Purchase Fees
RECOMMENDATION
It is recommended that the City Council authorize the City Manager to
1 Adopt an ordinance vacating a portion of Mira Vista Boulevard 115 feet wide by 510 feet long located
between Block 1 Trinity Heights Addition and Block 1 Monarch Hills Addition at the entrance to Mira
Vista Addition in the City of Fort Worth and
2. Waive any and all purchase fee value of the vacated land in accordance with City policy (M&C G-
15624).
DISCUSSION
Dunaway and Associates L P on behalf of Mira Vista Homeowners Association has requested the
vacation of the above referenced public right-of-way in order to replat it with the adjoining private street
right-of-way and construct a new guard shack facility The City Plan Commission recommended approval
of this request at its meeting on May 27 2009 An acceptable replat (FS-09-060) has been received Any
existing utilities will be relocated at the applicant's expense or retained within a designated easement,
along with an appropriate plat note that no permanent structures may be constructed or placed thereon
The City of Fort Worth originally obtained the above mentioned public right-of-way through the platting
process The City does not own land under or adjacent to the above referenced right-of-way Since no City
funds have been expended to purchase property or easement rights collection of the fee value or any
portion thereof is recommended by staff to be waived
This land is located in COUNCIL DISTRICT 3
