HomeMy WebLinkAboutOrdinance 21533-11-2014 i i I k ORDINANCE NO. 21533-11-2014 j AN ORDINANCE AMENDING THE FIRE DEPARTMENT STAFFING ORDINANCE NO. 21515-10-2014 TO REDUCE THE NUMBER OF POSITIONS IN THE CAPTAIN'S RANK IN THE FIRE DEPARTMENT BY THREE AND REDUCE THE OVERALL AUTHORIZED POSITIONS BY THREE; PROVIDING FOR ADOPTION BY REFERENCE OF A j STATEMENT OF INTENT AND PURPOSE IN ADOPTING THIS ORDINANCE; PROVIDING THAT THIS ORDINANCE IS j CUMULATIVE OF ALL PRIOR ORDINANCES NOT IN CONFLICT AND REPEALING CONFLICTING ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. j BE IT HEREBY KNOWN. WHEREAS, pursuant to Section 143.021(a), Texas Local Government Code, the City Council shall establish each classification of fire fighters by ordinance and shall prescribe the authorized number of positions in each classification(rank) by ordinance; and I WHEREAS, on August 19, 2014, the City Council adopted a staffing ordinance for the Fire Department, Ordinance, ("Prior Staffing Ordinance") which, in part, authorized an increase in the number of positions in the rank of Captain by three and in the total authorized positions by three, therefore establishing the Fire Department's sworn personnel staffing levels effective August 19, 2014 as follows: Assistant Chiefs 3 Deputy Chiefs 6 j Battalion Chiefs 27 Captains 87 Lieutenants 121 Engineers 202 Firefighters 465 ; TOTAL 911 i WHEREAS, on October 1 and 28, 2014, Council adopted staffing ordinances in which it authorized changes in the staffing levels of the Fire Department, but did not reduce the number of positions for the rank of Captain, and as of 12:03 a.m. on November 1, 2014, the staffing levels were returned to the August 19, 2014 levels; WHEREAS, as an offset to the increase in the rank of Captain that was authorized on I August 19, 2014, the Fire Department committed to reducing the number of positions in the rank of Captain by three; and i Ordinance No. 21533-11-2014 Pagel of 3 i i P s WHEREAS, the City Council desires to reduce the number of positions in the rank of Captain by three and in the overall authorized positions for the Fire Department by three. f NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: SECTION 1. The number of positions in the rank of Captain shall be reduced by three, effective November 18, 2014, resulting in an overall reduction of authorized positions by three. ` SECTION 2. I Effective Novemberl8, 2014, each classification (rank) authorized in the City of Fort Worth Fire Department shall contain the following number of positions: Assistant Chiefs 3 Deputy Chiefs 6 Battalion Chiefs 27 Captains 84 (reduction of 3) Lieutenants 121 Engineers 202 j Firefighters 465 TOTAL 908 (reduction of 3) SECTION 3. The Mayor and Council Communication ("M&C") that is presented contemporaneously with this ordinance is hereby expressly incorporated herein by reference for further clarification and explanation of the purposes and intent of the Council in their adoption of this ordinance. SECTION 4. f This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 5. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not Ordinance No. 21533-11-2014 Page 2 of 3 i I I i affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph j or section. ! i s SECTION 6. DATE: Tuesday, November 18, 2014 REFERENCE NO.: **G-18364 LOG NAME: 36FIRESTAFFINGORDINANCEFY15-3 SUBJECT: Adopt Ordinance Amending Fire Department Staffing Ordinance No. 21515-10-2014 to Reduce the Number of Positions in the Captain's Rank by Three and Reduce the Total Civil Service Staffing Levels from 911 to 908 (ALL COUNCIL DISTRICTS) RECOMMENDATION: It is recommended that the City Council adopt the attached Ordinance amending the Fire Department's Staffing Ordinance No. 21515-10-2014 adopted October 28, 2014 to reduce the number of positions in the Captain's rank by three and reduce the total Civil Service staffing levels from 911 to 908 effective upon approval. DISCUSSION: During Fiscal Year 2014, the City Council authorized the Fire Department (Department) to increase the number of positions in the rank of Battalion Chief by three (M&C G-18259) and to increase the number of positions in the rank of Captain by three (M&C G-18288). Due to the time required to initiate and complete a Battalion Chief promotional process, the Battalion Chiefs positions had to be created and filled prior to the Captain's positions being vacated and deleted. This necessitated a temporary increase in total number of positions in the Captain's rank as well as an increase in the total Civil Service staffing levels from 908 to 911. As an offset to this temporary increase in the rank of Captain, the Department committed to reducing the number of positions in the rank of Captain by three. The Battalion Chief promotional process is now complete. Therefore, the proposed Fire Department Staffing Ordinance amendment, upon approval, will return total Civil Service staffing levels to 908 through the reduction of three Captain's positions.
