HomeMy WebLinkAboutOrdinance 18836-09-2009ORDINANCE NO 18836-09-2009 AN ORDINANCE AMENDING THE CODE OF THE CITY OF FORT WORTH (1986), AS AMENDED CHAPTER 35 `WATER AND SEWERS SECTIONS 35-56(g) and 35-56(h) BY REVISING AND ADDING CERTAIN RATES AND CHARGES MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES REPEALING ALL ORDINANCES AND PROVISIONS OF THE FORT WORTH CITY CODE IN CONFLICT HEREWITH, PROVIDING A SAVINGS CLAUSE PROVIDING A SEVERABILITY CLAUSE, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH SECTION 1. That Section 35-56(g) of Chapter 35 of the Code of the City of Fort Worth (1986), as amended, is hereby amended to be and read as follows (g) The following schedule of rates per month, or fraction thereof, shall be the charges to all wholesale customers for furnishing water to such customers RATES FOR WHOLESALE WATER SERVICE Volume ($/1 000 gallons)* $0 6366 Maximum Day ($/MGD excess) $131,337 00 Maximum Hour ($/MGD excess) $34 755 00 Customer ($/Meter/Month) $25 00 *plus raw water cost All use per month Distract All use per month District RAW WATER SERVICE $0 7563 per 1 000 gallons inside Tarrant Regional Water $0 7944 per 1 000 gallons outside Tarrant Regional Water CRR09 08.09v2(SS) SECTION 2 That Section 35-56(h) of Chapter 35 of the Code of the City of Fort Worth (1986) as amended, is hereby amended to be and read as follows (h) The following schedule of rates per month, or fraction thereof, shall be the charges to all wholesale customers for furnishing wastewater services to such customers RATES FOR WHOLESALE WASTEWATER SERVICE Volume ($/1 000 gallons) $1 0100 BOD ($/pound) $0 3674 TSS ($/pound) $0.2275 Customer ($/month) $75 00 SECTION 3. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinance and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 4. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valzd judgment or decree of any court of competent ~unsdiction, such unconstitutionality shall not affect any remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation m this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section.
