ADVANCE FUNDING AGREEMENT
AMENDMENT#3
THIS AMENDMENT IS MADE BY AND BETWEEN the State of Texas, acting through the Texas Department of
Transportation, hereinafter called the State, and the City of Fort Worth, acting by and through its City Council, hereinafter
called the Local Government.
WITNESSETH
WHEREAS, the State and the Local Government executed a contract on November 19, 1996 to effectuate their agreement
to construct North Tarrant Parkway from IH 35W to US 377; and,
WHEREAS, Supplemental Agreement No. 1 authorized the City to get reimbursed for the purchase of right-of-way; and,
WHEREAS, Supplemental Agreement No. 2 authorized Tarrant County to do construction on the project; and,
WHEREAS, it has become necessary to amend that contract;
NOW THEREFORE, in consideration of the premises and of the mutual covenants and agreements of the parties hereto,
the State and the Local Government do agree as follows:
AGREEMENT
Article 1. Description of Amended Items
The total cost of the project has been increased by$7,670,222 for a total of$10,400,982. This includes
$8,320,786 in federal funds and $2,080,136 in local funding. $1,000,000 ($800,000-federal & $200,000-
local) has been transferred to CSJ: 0902-48-515 leaving a total of$9,400,982 for construction.

Page 5 of 12. Article 9, Construction Funding, Paragraph "A", The total cost of the Project has been
increased by$6,432,232 to $9,400,982. Making the federal share of the project$7,520,786 and
increasing the City's share of the estimate project funding to $1,880,196.
The project will be divided into two (2) projects.
1. 0902-48-194 will have the limits of: North Tarrant Parkway from 300' East of IH 35W to Rainey
Lake Drive. The estimated cost of this portion of the project is $2,838,016. This includes
$1,948,700 in federal funds and $487,175 in local matching funds to the federal funds, plus
$402,141 in additional local funds.
2. 0902-48-575 is the CSJ for the other portion of the original project. The limits for this portion are:
North Tarrant Parkway from 510' East of Rainey Lake Drive to US 377. The estimated cost of this
portion of the project is $6,376,160. This includes $5,100,928 in federal funds and $1,275,232 in
local matching funds to the federal funds.

phases. Phase 1 is CSJ: 0902-48-194 from 300' East of IH 35W to Rainey Lake Drive. Phase 2 is
CSJ: 0902-48-575 from 510' East of Rainey Lake Drive to US 377. See Attachment A for Location Map.

• Supplemental Agreement No. 2 is revised to allow the State to let and construction the project:
Page 6 of 12. Construction Responsibilities,
A. The State shall advertise for construction bids, issue bid proposals, receive and tabulate the bids and award a
contract for construction of the Project in accordance with existing procedures and applicable laws. Any field
changes, supplemental agreements or additional work orders which may become necessary subsequent to the
award of the construction contract shall be the responsibility of the City and subject to the approval of the State.
B. The State will supervise and inspect all work performed by the construction contractor and will provide such
engineering, inspection and testing services as may be required to ensure that the construction of the Project is
accomplished in accordance with the approved P.S.& E.
C. Upon completion of the Project, the State will issue to the City a "Notification of Completion", acknowledging
that the Project has been completed. Upon the City's receipt of the "Notification of Completion", the roadway will
be removed from the State Highway System and will revert under the jurisdiction of the City.
All other provisions of the original contract are unchanged and remain in full force and effect.
Article 2. Signatory Warranty
The signatories to this amendment warrant that each has the authority to enter into this agreement on behalf of the
organization they represent.
IN WITNESS WHEREOF,THE STATE AND THE LOCAL GOVERNMENT have executed duplicate counterparts to
effectuate this agreement.
