HomeMy WebLinkAboutOrdinance 18864-10-2009Ordinance No 18864-10-2009 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $27 000 00 UPON RECEIPT OF THE COMMUNITY DEVELOPMENT BLOCK GRANT RECOVERY FUNDS FROM THE UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT FOR THE PURPOSE OF FUNDING PUBLIC FACILITIES SIDEWALKS AND ADA RAMP ACTIVITIES PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2009-2010 and in the Budget of the City Manager there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $27 000 00 upon receipt of the Community Development Block Grant Recovery funds from the United States Department of Housing and Urban Development, for the purpose of funding public facilities sidewalks and ADA ramp activities SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid inoperative or void for any reason by a court of competent jurisdiction such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be incorporated into the ordinance effecting the budget of the municipal government of the City of Fort Worth for the ensuing Fiscal Year beginning October 1 2009 and ending September 30 2010 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed SECTION 4 This ordinance shall take effect upon adoption APPROVED AS TO FORM AND LE ALITY i ~ ~! ~. No. 18864-1A-2009 .r DATE Tuesday October 13 2009 REFERENCE NO *C-23837 LOG NAME 1717CDBGRGRANT 2 SUBJECT Correct M&C C-23558 to Increase the Appropriation for Community Development Block Grant-Recovery Funds from $1 769 412 00 to $1 796 412 00 and Adopt Appropriation Ordinance RECOMMENDATION It is recommended that the City Council 1 Approve a correction to M&C C-23558 to increase the appropriation for Community Development Block Grant Recovery funds from $1 769 412 00 to $1 796 412 00 and 2 Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations in the Grants Fund in the amount of $27 000 00 in Community Development Block Grant Recovery funds DISCUSSION On May 26 2009 (M&C C-23558) the City Council approved a plan for the use of $1 769 412 00 of Community Development Block Grant Recovery (CDBG-R) funds from the United States Department of Housing and Urban Development (HUD) and the execution of a related Grant Agreement. The City Council also approved a Substantial Amendment to the City's 2008-2009 Action Plan in order to use the CDBG-R funds (M&C C-23558) HUD approved the Substantial Amendment to the City's 2008-2009 Action Plan When the Grant Agreement was sent to the City for execution it was discovered that staff had inadvertently transposed the numbers in the grant amount. In order for the City to appropriate the correct amount in the executed Grant Agreement, the City Council must adopt a new appropriation ordinance increasing the amount of CDBG-R funds in the Grants Fund from $1 769 412 00 to $1 796 412 00 Recommended Use of Funds City Council previously approved the use of CDBG-R funds for sidewalk infrastructure and administrative costs.
