HomeMy WebLinkAboutContract 29736 AMENDMENT NO. 4 STATE OF TEXAS S CITY SECRETARY CONTRACT NO. � (No M&C Needed) COUNTY OF TARRANT $ WHEREAS, the City of Fort Worth (City) and TranSystems Corporation Consultants, (Engineer) made and entered into City Secretary Contract No. 28436, (the Contract) which was authorized by the City Council by M&C C-19457 on the 4th day of February 2002, and subsequently revised by three previous amendments; and WHEREAS, the Contract involves engineering services for the following project: Engineering contract for the design of Berry Street Streetscape Project from Waits Avenue to Forest Park Blvd. WHEREAS, it has become necessary to execute Amendment No. 4 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services specified in a proposal letter dated March 2, 2004, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer total $2, 000.00. 2 . Article II of the Contract is amended to provide for an increase in the maximum fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $309, 631.20. 3 . All other provisions of the Contract which are not expressly amended herein shall remain in full force and effect. EXECUTED on this the day of 2004, in Fort Worth, Tarrant County, Texas. The additional work is outlined below: 1. Prepare exhibits of each individual property along the Berry Street Reconstruction project and include all roadway/sidewalk improvements, right of way and property information on exhibits. DATE: March 22, 2003 RE: DESIGN FEE AMENDMENT NO. 4, BERRY STREET STREETSCAPE PRO- JECT FROM WAITS AVENUE TO FOREST PARK, DOE NO. 4227, T&PW PROJECT NO. C115-020115023226 The proposed amendment will allow TranSystems Corporation Consultants to provide additional engineering services on the project as requested by the City. City staff has requested that the consultant, TranSystems Corporation Consultants, expand the scope of their project by preparing exhibits of each of the individual properties located within the limits of the project. The exhibits are to include all roadway/sidewalk improvements, right of way and property information and are for purposes of public information. Amendment No. 1 provided compensation for the services of a professional geotechnical engi- neering firm to carry out subsurface testing and make recommendations to aid in the design of the new pavement on Berry Street, in compliance with the Texas Department of Transportation. Amendment No. 2 allowed TranSystems to hire a sub-surface utility contractor to determine the exact location of underground utilities in order to avoid costly delays and additional costs associ- ated with encountering conflicts during the construction phase. Amendment No. 3 provided compensation for the additional engineering services necessary to augment the limits of the project to include the south side of Berry Street between McCart and Forest Park. TranSystems Corporation Consultants has requested a fee of $2,000.00 for the additional ser- vices to be provided thereby increasing the contract fee from $307,631.20 to $309,631.20. I be- lieve this fee is fair and reasonable for the additional services to be provided.
